6.4. SR 10-18-1993 A.I ~( ( II <<Y11, ~ ~ River ITEM 6.4 FROM: MAYOR AND CITY COUNCIL STEVEN B. ACH, CITY PLANNER~ OCTOBER 18, 1993 TO: DATE: SUBJECT: VARIANCE REQUEST BY DENNIS CHUBA/PUBLIC HEARING, CASE NO. V 93-07 ISSUE A ten foot variance to the required ten foot side yard parking setback. LOCATION 317 and 323 Main Street (Lots 1, 2, and 3, Block 2, village of Elk River), Elk River, Minnesota. ATTACHMENT Report to Planning Commission. ANALYSIS e The Chuba Company is proposing to construct an 8,900 square foot office building at the southeast corner of Freeport Avenue and Main Street that will compliment the existing office building immediately to the east. The proposed parking area between the two buildings would abut the common property line, infringing upon the required ten foot parking setback. The concept proposed is a shared parking arrangement between the two office buildings. Therefore, the interior landscaped area which typically occurs along the property line would be relocated adjacent to the building. Parking would then occur in a central location to serve each office building. Attached is the report to the Planning Commission which provides additional information on the requested action. PLANNING COMMISSION RECOMMENDATION The Planning Commission unanimously recommended approval of the variance request. There were no public comments heard at the public hearing. RECOMMENDATION e It is recommended the City Council variance to the side yard parking based on the following findings: approve the ten foot setback for Dennis Chuba P.O. V 93-07 REQUESTED ACTION A 10 foot variance to the required 10 foot side yard parking setback. LOCATION OF REQUEST 317 and 323 Main Street (Lots 1, 2, and 3, Block 2, Village of Elk River), Elk River, MN. ZONING/LAND USE C2 (Office District)/ CB (Central Business District) ATTACHMENTS e Location Map, Zoning Map, Proposed Site Plan, List of Property Owners ANALYSIS The Chuba Company is proposing to construct an 8,900 square foot office building at the southeast corner of Freeport Street and Main Avenue. The proposed building would compliment the existing office building immediately to the east, also built by The Chuba Company. The office building is a permitted use in the C2 (Office District) district, therefore, the site plan is being reviewed administratively for compliance with City zoning standards. The concept proposed by Mr. Chuba is a shared parking arrangement between the two office buildings. The proposed parking area would abut the common property line between the two office buildings. Therefore, no setback would be maintained and a variance is required. Employees and customers from each office building will be able to use either parking lot as well as drive from one parking area to the other. From the street, the two office buildings will appear as one development, so the interior setback in this case is not necessary to maintain separation between properties. e The applicant could meet shifting the green space outside of the parking the 10 foot parking setback by adjacent to the building, to the area. However, from a design P.O. Box 490 · 13065 Orono Parkway · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 . e e ') Variance, Dennis Chuoa September 28, 1993 ) Page 2 standpoint, the green space along with the sidewalk next to the building, is better served than having the green space on the common property line. RECOMMENDATION Staff has reviewed the application in accordance with Section 900.40 and is recommending the Planning Commission approve the 10 foot parking variance based on the following: 1. LITERAL ENFORCEMENT OF THE ORDINANCE WOULD CAUSE A CHANGE IN PROJECT DESIGN THAT WOULD BE LESS DESIRABLE. 2. THE PROJECT IS UNIQUE BECAUSE IT IS DEVELOPED BY THE SAME CONTRACTOR AND HAS SHARED FACILITIES AND COMMON SPACE, SUCH AS PARKING. 3. LITERAL APPLICATION OF PROVISIONS OF THIS ORDINANCE WOULD PREVENT COMPLIMENTING DEVELOPMENTS WITH SHARED PARKING ARRANGEMENTS FROM OCCURRING. 4. THE VARIANCE WILL NOT BE INJURIOUS OR ADVERSELY AFFECT THE HEALTH, SAFETY, AND WELFARE OF THE RESIDENTS OR NEIGHBORS, AND IS KEEPING WITH THE SPIRIT AND INTENT OF THE ORDINANCE. l' y L ~ / / 'f. \1\ LOCATION MAP I -'\( . { ~ ~ Ci~of ~ . @ ElI{ 'River po.
