SUBJECT: CODE AMENDMENT FOR ZERO LOT LINE
DEVELOPMENTS
ISSUE
Consider a request to amend the Zoning Ordinance allowing zero
lot line developments as conditional uses in all
multi-family, C2 (Office District), C3 (Highway Commercial),
and industrial zones.

ANALYSIS

Zero lot line developments occur when a building or parking
area is constructed over a common property line. The ordinance
presently allows zero lot line developments in all
multi-family zoning districts, C-2 (office district), and C-3
(highway commercial) zoning districts. The proposed amendment
would expand and include both the light and heavy industrial
zoning districts and also apply to parking facilities.
In addition, the provision allowing zero lot line developments
would be moved from the Section entitled "Yard Regulations" and
listed as a conditional use permit in each of the appropriate
zoning districts. The primary purpose for this amendment is to
clarify the administration of zero lot line developments and
give the Planning Commission and City Council an opportunity to
review and recommend appropriate conditions, if necessary, on
each application.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission unanimously recommended approving the
code amendment. There were no comments from the public on this
item.
RECOMMENDATION
It is recommended the City Council approve the code amendment
as presented in the attached ordinance.

AN ORDINANCE AMENDING SECTIONS 900.08, 900.12 AND 900.20
OF THE CITY OF ELK RIVER CODE OF ORDINANCES TO MAKE ZERO
LOT LINE DEVELOPMENT A CONDITIONAL USE IN CERTAIN RESIDENTIAL,
COMMERCIAL AND INDUSTRIAL ZONING DISTRICTS
The City Council of the City of Elk River does hereby ordain as
follows:
Section 1: Section 900.08 of the Elk River Code of Ordinances
is hereby amended to add the following definition of zero lot line
development, which shall read as follows:
ZERO LOT LINE DEVELOPMENT: The development or use of land
where a structure or parking area is allowed to be
constructed over a property line.
Section 2: Section 900.12 of the Elk River Code of Ordinances
is hereby amended to add the following new subsections, which make
zero lot line development a conditional use in certain residential,
commercial and industrial zones:
900.12 (6) (c) (vii) Zero Lot Line Development
900.12 (7) (c) (vi) Zero Lot Line Development
900.12(8) (c) (ix) Zero Lot Line Development

900.20 (5) (e).
(4 ) Section 900.20(5) (g) . renumbered to Section
