October 21, 1993 File: 230-195-20 The Honorable Mayor and City Council City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: Deerfield 3rd Addition Storm Sewer Improvements Dear Council Members: On Wednesday, October 20, 1993, we opened bids for the proposed storm sewer improvement in the Deerfield 3rd Addition. As you recall, this is the project intended to remedy the flooding experienced by the Poppen property. The apparent low bidder was in the range of $122,000 vs. our estimated cost of approximately $150,000. However, at this time, the entire bid tabulation has not been completed. That will be completed and ready for presentation at Monday night's City Council meeting. Throughout this project we have been working closely with Mr. Poppen and Mr. Hartman, who is the landowner in the Royal Oaks Addition from whom we need an easement to construct these improvements. Mr. Hartman has requested that several items be included in the project prior to giving the necessary easement. These would include extending the pipe through his property, replanting of any trees removed, resodding of his yard and repair of his driveway in accordance with his directions. Mr. Hartman has also requested that the project construction not take place until the spring of 1994, such that his yard and driveway not be disrupted through the winter months. We are currently working with Mr. Hartman and the Contractor to determine the cost of the requested additional improvements for Mr. Hartman and to determine of some kind of satisfactory agreement can be reached which would allow the project to start this fall and complete the work on the Hartman property as quickly as possible. We are hopeful to have some type of resolution to these issues prior to Monday night's meeting. There were a total of 6 bids received. The following table provides a list of bidders and their total bid: e D.B. Miller, Inc. Northdale Construction, Inc. Forest Lake Contracting, Inc. R.P. Bonine Excavating, Inc. $122,307.00 $124,351.50 $125,945.95 $127,244.50 $128,654.65 $137,021.61 There was no feasibility study prepared for this project; however we have estimated the construction cost at approximately $150,000. The low bidder is 22 % under this estimate. We have been discussing these proposed improvements with Mr. Steve Hartman, the owner of Lots 11 and 12, Block 1 in Royal Oaks Addition. This is the property owner from which an easement is needed to get the flow from Deerfield 3rd through Royal Oaks to the wetland and drainage area in the southeast of that addition. Mr .Hartman has provided us with a listing of conditions he would like to see met in order to provide the necessary easement. A summary of them is as follows and attached for your review is the actual list provided by Mr. Hartman. 1. No work is to be accomplished prior to the spring of 1994. Mr. Hartman indicated that his home is part of a Christmas Parade of Homes for charity and he would prefer that the driveway and yard not be disturbed prior to that time. Therefore construction could not be undertaken prior to spring of 1994. 4. The agreement of a fair price for the granting of the easement. Mr. Hartman indicated this could be either a pro-rata cost based on the area of the easement vs. the value of his lots or even a reduction in the value of his home, thus lowering his taxes due to the encroachment of an easement across his property. We have discussed the potential for a change order to meet Mr. Hartman's conditions with the low bidder. They have indicated a willingness to pursue such a change order . We, however, at this point in time, do not have a cost-estimate for the City Council to consider. Also, the low bidder indicated they would prefer not to construct the project until the spring of 1994. They are very concerned about 191st Avenue in Deerfield 3rd relative to restoration. They believe that at this time of year construction of pipe along that alignment would make it very difficult to provide adequate restoration for people accessing their properties or driving that particular route. They are also concerned with the portion that goes downhill between Deerfield 3rd and Royal Oaks. The inability to restore that could lead to substantial erosion in the spring, which also would impact Mr. Hartman's property. Given the position of Mr. Hartman relative to the easement and to the contractor's desires relative to actual construction of the improvement, we would recommend that the City Council give direction to negotiate the cost of a potential change order and continue discussions with Mr. Hartman' relative to the easement acquisition. At such time that we have completed both discussions, we could then present back to the City Council the construction bid, the cost of the change order, and the potential cost of acquiring the easement. The City Council then could consider whether or not to proceed with this project when all costs are known. I will be in attendance at Monday evening's meeting to discuss this item with you further.
