Box 490 13065 Orono Parkway Elk River, MN 55330 RE: TH 10/101/169 IMPROVEMENTS MnDOT COORDINATION Dear Mr. Klaers: As you aware, we are continuing to work with MnDOT relative to adding city storm sewer improvements to the TH 10/101/169 project. We believe we will be successful in getting MnDOT away from the idea of three parallel storm sewer pipes and reduce that to two larger or possibly one 72" diameter storm sewer pipe. We will know better in approximately two weeks what the final design will be. The process by which the city is allowed to add work to a MnDOT project is called a Cooperative Construction Agreement Project. In order to initiate this process, MnDOT rules require that the municipality submit a resolution to MnDOT requesting that the desired improvements be included in the proposed project. The resolution must also indicate the municipality's willingness to pay its fair share. We have prepared the attached draft resolution for the City Council's consideration. Once adopted by the City Council, this will be forwarded to MnDOT to begin the process of the preparation of a Cooperative Agreement. RESOLUTION 93 - A RESOLUTION OF THE CITY OF ELK RIVER A RESOLUTION REQUESTING MnDOT TO CONSTRUCT STORM SEWER FACILITIES UNDER THE T.H. 10/101/169 INTERCHANGE IN CONJUNCTION WITH MnDOT PROJECT S.P. 7101 WHEREAS, the Minnesota Department of Transportation (MnDOT) has proposed the construction of T.H. 101 (S.P. 7101) which involves the reconstruction of the interchange of the T.H. 10/101/169; and WHEREAS, the City of Elk River Comprehensive Drainage Plan proposes a larger diameter storm sewer pipe thru this interchange; and WHEREAS, in conjunction with S.P. 7101, it has been determined that these additional storm sewer facilities be constructed with the project; and WHEREAS, the City and MnDOT agree that the construction of the total project can most efficiently be accomplished by joint efforts of the parties. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The City of Elk River indicates its willingness to enter into agreement with MnDOT to share in the cost of the construction of said project in such amounts determined by the parties according to the latest addition of MnDOT's "Procedure Cooperative Construction Projects with Municipalities". 2. The agreement shall cover the storm sewer cost added to the project by the City of Elk River. 3. The City of Elk River requests MnDOT to construct in conjunction with MnDOT project S.P. 7101 the City of Elk River Storm Drainage Improvement. Passed and adopted this 15th day of November, 1993.
