SUBJECT: UTILITIES EXTENSION POLICY
Earlier this year, the City changed its policy on the extension
of municipal utilities (sewer and water service lines). The
change approved was to extend the sewer and water stub-ins for
subdivided lots beyond the street right-of-way to the edge of
the utility easement. This change in the City policy was
appropriate based on the Elk River Utilities policy of placing
electric lines in the easement and not in the street
right-of-way. The goal of this new policy was to eliminate
future conflicts with underground electric lines when the sewer
and water was extended in the future to new homes.

This new policy was requested to be reconsidered by the City
Council in October. In October the City Council referred this
policy back to the Utilities Commission. The Utilities
Commission discussed this issue at its 11/3/93 meeting (see
attached) and the Utilities have decided to change its policy
regarding the location of electric lines. The Utilities are
now going to place the electric lines in the street
right-of-way if it is possible. Accordingly, the City no
longer needs to extend the sewer and water to the easement line.
Based on this new policy of the Utilities to place the electric
lines in the street right-of-way and not in the easements, it
is recommended to the City Council that the City change its
policy back to its previous status, whereby the sewer and water
stub-ins to new subdivisions are placed up to the right-of-way
boundary. It should be noted that this policy will only relate
to internal residential streets and not to streets which have a
collector designation or where it is possible that the street
will be improved (expanded) in the future.

UTILITIES COMMISSION MINUTES
November 3, 1993
3:00 P.M.

The meeting was called to order at 3: 00 P.M.

2) Motion by Mr. Simpson, seconded by Mr. Zabee to approve the
agenda as amended. The Motion carried.

Motion by Mr. Zabee, seconded by Mr. Simpson to approve the
minutes of the previous meeting. The motion carried.
4) A proposal from the Clinkscales Family Trust for the sale of
property next to the Power Plant was discussed. There was a
large difference between the asking price and the appraisal
price authorized by the Commission. Motion by Mr. Zabee,
seconded by Mr. Simpson, to authorize a second appraisal on the
property and report the results to the Commissioners for future
action. The motion Carried.
5) Bob McCartney reported that MSA had sent us the first payment
request for the water tower with their approval. Motion by 1.lr.
Zabee, seconded by Mr. Simpson to approve Partial Pay Estimate
No. 1 to CBI Na-Con in the amount of $64,840.50 as approved by
MSA. The motion carried.

6) The location of. facilities in public or private Right of Way
was discussed. Motion by Mr. Simpson, seconded by Mr. Zabee
to place the following resolution in the Minutes of the
meeting.
The Elk River utilities would be glad to comply
with the desires of the City Council if they
would like to see the priority placement of
electrical facilities to be in the Street Right
of Way. The utilities would like to retain the
right, if terrain, soil conditions or other
difficulties dictate, to place these facilities
in the private easement.
The motion carried.

The General Manager updated the Commissioners on the status of
construction projects and other operating conditions.
8) The General Manager reviewed the September financial statements
with the Commissioners.
9) Motion by Mr. Zabee, seconded by Mr. Simpson, to approve the
check register.
10) The next meeting was set for Tuesday, December 7, 1993 at 3:00
P.M. at the Utilities office.
11) Motion by Mr. Simpson, seconded by Mr. Zabee to adjourn. The
motion Carried. Meeting adjourned at 4:15 P.M.

RE: Issues at the next meeting
I attended a City Council meeting on October 25 where developers
Rick Foster and Marly Glines requested that, in residential
neighborhoods where there is no chance that the streets will ever
be widened, the utilities be placed in the street right of way
(ROW). This would negate the need for the developer to extend the
sewer and water stubs an additional 10 feet in the private
easement. Our present policy has been to place the electrical
lines in the private right of way unless there is a tree or other
obstacle in the way, when we will veer into the street ROW for a
short distance. I see no reason that we cannot comply with Rick's
and Marly's request, in most cases, as long as we still have the
right to move to private ROW when terrain or other soil conditions
would make the installation more difficult.
I suggest the following resolution be placed in the utilities
Commission Meeting minutes:
