CU 93-34 REQUEST Richard Peterson is requesting a conditional use permit to construct a metal skin agricultural accessory building greater than 2,000 square feet in size, and to have two agricultural structures on one lot. The proposed building will be located at 11763-201 Avenue NW, Elk River. The parcel is 27.45 acres in size. A memo to the Planning Commission explaining the request in detail is attached. ANALYSIS . Richard Peterson is proposing to construct a 3,190 square foot metal skin agricultural accessory building. Elk River City Code requires that any agricultural accessory structure greater than 2,000 square feet in size must go through the conditional use permit process. Mr. Peterson is also required to go through the conditional use permit process because he is requesting a second agricultural building on his parcel. Elk River City Code requires that only one agricultural accessory structure can be located on a lot. Currently, there is a 12x28 (336 sq ft) agricultural lean-to structure located on the property. This lean-to is used as a shelter for Mr. Peterson's five horses and to cover the applicant's hay. The proposed building will be located directly behind the applicant's home and will be partially screened from view by the heavily wooded site. USE OF BUILDING The proposed structure measures 36x80 with a small office/tack room on the front of the structure. Half of structure will be used to shelter Mr. Peterson's horses and other half of the building will be used to store items such trailers and miscellaneous equipment. 10x30 the the as . BACKGROUND The applicant, Richard Peterson, is requesting a conditional use permit to construct a 3,190 square foot metal skin agricultural accessory structure and to have two agricultural buildings on one lot. Elk River City Code requires any agricultural accessory structure larger than 2,000 square feet in size to go through the conditional use permit process. Mr. Peterson is also required to go through the conditional use permit process because he has more than one agricultural structure on the parcel. Mr. Peterson owns 27.45 acres of wooded property. This property acts as a buffer between the gravel pits to the north and a portion of the Brentwood subdivision to the south. Currently there is one 12'x28' (336 square foot) agricultural "lean-to" structure located on the property. This structure is currently used as a shelter for the horses and to cover the applicants hay. e P.O. The accessory structure will be used to shelter Mr. Peterson's five horses and other equipment related to the horses. A portion of the building will also be used to store items such as trailers and other miscellaneous equipment. Attached is a drawing that shows the outside and inside layout of the structure. The proposed building will be located directly behind the applicants home and will be screened from view from any neighboring homes due to the heavily wooded site. If this application is approved, the applicant will be required to submit engineered drawings in order to receive a building permit. This is a State building code requirement and will need to be submitted before a building permit can be issued. SETBACKS Elk River City Code requires that all metal skinned buildings are set back 300 feet from any neighboring dwellings. There are no existing homes located closer than 300 from the proposed structure. The structure would also be subject to the normal accessory structure setbacks, which are 35 feet from the front property line, 20 feet from the side property lines, and 30 ~ feet from the rear property line. The site plan prepared by .., Mr. Peterson shows that this building would exceed the setback requirements. RECOMMENDATION Staff is recommending approval of the conditional use permit for Richard and Kathy Peterson allowing a 3,180 square foot detached metal skin agricultural accessory building and to allow two agricultural buildings on one lot with the following conditions: 1.
