REQUEST
Bart Boese is requesting a conditional use permit to construct
a non agricultural metal skin accessory structure greater than
1,000 square feet in size within the plat of Deerfield First
Addition. The proposed building will be located at 20337
Auburn Street NW. This parcel is approximately 2 1/2 acres in
size. The memo to the Planning Commission is attached.
ANALYSIS
.
The proposed structure measures 30'x46' (1,380 square feet) in
size and will be located on the lot meeting all RIa accessory
setback requirements. The metal skin building will be located
directly behind the applicant's home, which is placed towards
the rear of the parcel. The structure does meet the required
300' setback from any neighboring dwelling. Mr. Boese plans on
using the building to store vehicles, snowmobiles, a tractor,
and yard maintenance equipment.
One resident at the public hearing was concerned that Mr.
Boese, being a contractor, may want to place some of his
commercial contracting equipment in this structure. In
response to this concern, the Planning Commission added a third
condition which explains that if the applicant wants to store
contracting equipment in this structure, an amendment to the
conditional use permit will be required.
RECOMMENDATION
The Planning Commission unanimously recommended approval of the
conditional use permit for Bart and Lisa Boese to construct a
non agricultural metal skin building greater than 1,000 square
feet in size, with the following conditions:
1. THE COLOR OF THE BUILDING BE COMPATIBLE WITH THE
EXTERIOR OF THE HOUSE.
2. THE APPLICANT BE REQUIRED TO SUBMIT SIGNED ENGINEERED
DRAWINGS IN ORDER TO RECEIVE A BUILDING PERMIT.
3. THIS BUILDING MAY NOT BE USED FOR ANY COMMERCIAL USE
WITHOUT CITY APPROVAL.

BACKGROUND
The applicant, Bart Boese, is requesting a conditional use
permit to construct a 1,380 square foot non agricultural metal
skin building within the plat of Deerfield First Addition.
Metal skin accessory structures constructed within a platted
area must go through the conditional use process. Any non
agricultural metal skin structure larger than 1,000 square feet
is also required to go through the conditional use process.

The proposed structure measures 30'x46' (1,380 square feet) and
will be located directly behind the applicants home. The shed
will be located over 300 feet from any neighboring home and
meets all RIa accessory structure setback requirements. Mr.
Boese's lot is approximately 2 1/2 acres in size. Mr. Boese
plans on using the structure to store extra vehicles,
snowmobiles, and other miscellaneous equipment inside rather
than having them outside. If this application is approved, Mr.
Boese will need to submit engineered drawings in order to
receive a building permit. This is a State building code
requirement and will need to be submitted before a building
permit can be issued.

RECOMMENDATION
Staff is recommending approval of the conditional use permit
for Bart and Lisa Boese, to construct a 1,380 square foot

a platted area with the following conditions:

Re: Construction of a Utility Shed
Dear Elk River Neighbors & City Council Memebrs,
I am writting to you in hopes that the council will approve my request for the construction of a
utility shed.
It has been brought to my attention that the City of Elk River will only allow a 1000 square foot
building within the city limits (other than a home). Therefore, it is my request that the city allow
me to construct a utility shed with the dimensions of30' x 44' (1320 sq. ft.).
We own a home that is situated on 2.5 acres. The landscape of the property is widely varied. In
the front half, there is a large wetland that is untouchable. The house is in the middle of the lot, not
leaving much room on either sides of the house. The back half of the property is the only part that
is open. This is where we hope to build this shed. The attached diagram (A) will give you a better
idea of the lot.
Since we have moved in to the home, November &, 1992 , we have made the following
adjustments to its appearance:
1) Laid down rock
3) Repaired the driveway
6) Graded the back yard making it level
2) Planted 15 mature trees
4) Put gutters and downspouts on
There are a couple of reasons why we are making this request. They are as follows:
1) We own four vehicles ( two pick-ups, one car, and a antique car). We also own a
tractor, snowmobiles, and yard maintence equipment. With limited space in the the
attached two car garage as well as in the front yard, we feel this shed would help us hide
these items and keep the aesthetic value of our neighborhood for us and others.
2) We feel that by having these items out of sight, they will be out mind. Our neighbors
will feel comfortable with the situation and the young children will not be tempted to
explore. Safety is a big concern of mine and I would hate to be liable for someone's
negliagence. Therefore, by building this shed we be taking the necessary precautions to
prevent such an accident.
We have taken a copy of this proposal to our neighbaors for their reviewal. As you will see on the
attached exhibit (B) we have obtaned our neighbors approval of the idea.
In addition please refer to exhibit (C) to show you some sample designs we are looking at using.
We have also taken a photo from the street looking staright in to where the shed will approximately
be. As you will notice the line of trees that seperates our lot from the neighbors, completely
blocks off the view of the shed from the street.

Lastly, we would like to thank you for your consideration in this matter and look forward to your
