The City Council and representatives of UPA agreed on the terms and conditions of a land sale of part of the old City Hall property to UPA this past spring/summer. The attorneys for both groups have finally worked out all of the details of the transaction, a Purchase Agreement has been signed, and a plat has been approved for this property in order to convey land to UPA. A final step for the City Council is to approve the attached resolution finalizing this land sale and authorizing City representatives to sign the necessary documents related to the Purchase Agreement. e Staff recommends approval of the attached resolution. e P.O. Box 490 · 13065 Orono Parkway · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 e e e RESOLUTION 93 - RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION DIRECTING THE SALE OF OUTLOT A, CREAMERY ADDITION TO UNITED POWER COOPERATIVE WHEREAS, the City has entered into a Purchase Agreement with United Power Association to sell a portion of the Old City Hall site, legally described as Outlot A, Creamery Addition (the Property) to UPA; and, WHEREAS, all of the conditions set forth in the Purchase Agreement for sale of the Property have been satisfied; and, WHEREAS, the City Council has considered the relationship of the sale of the Property to the City's Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk River makes the following finding and takes the following actions: 1 . The City Council finds that sale of the Property to United Power Association has no relationship to the City's Comprehensive Plan. 2. The City Council hereby orders the sale of the Property to United Power Association. 3. The City Council directs the Mayor and City Clerk to execute the necessary documents to complete the conveyance of the property to UPA pursuant to the terms of the Purchase Agreement.
