PREPARATION OF FEASIBILITY REPORT
FOR ELK PARK CENTER
ISSUE
Attached is a letter from Terry Maurer requesting the City
Council take formal action on a resolution ordering preparation
of a feasibility report for Elk Park Center. A portion of this
report was presented to the Council last Monday evening,
however, work remains to be completed to finalize this report.
RECOMMENDATION
It is recommended City Council approve Resolution No. 93
ordering the preparation of feasibility report for Elk Park
Center.

RE: ELK PARK CENTER FEASIBILITY STUDY
Dear Mr. Ach:
At their December 20th meeting, City Council will be considering a resolution approving
the conditional use permit for the proposed Elk Park Center development. It would be
appropriate for the City Council to also consider a resolution formally authorizing the
preparation of the feasibility study. The work we have done to date as authorized by
motion of the City Council. As such, it does not represent the formal authorization of a
feasibility study. I have attached a draft resolution for the City Council's consideration.
The feasibility study will not only deal with the issues already presented at the December
13th meeting, but also sanitary sewer, water, and internal street improvements, along with
cost, funding scenarios, and timing relative to the phasing of the Elk Park Center
development.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DECLARING THE ADEQUACY OF THE
PETITION FOR IMPROVEMENT AND ORDERING THE
PRELIMINARY FEASmILITY REPORT IN THE MATTER
OF THE ELK PARK CENTER IMPROVEMENT OF 1993
WHEREAS the City has received a petition (the Petition) requesting that the City improve
certain property by the installation of City Utilities, City Streets and upgrade
of adjacent infrastructure (the improvement); and
WHEREAS the City has reviewed the Petition and identified the owner of the real property
abutting the streets named in the Petition and determined that the Petition has
been duly executed by the owners of not less than 35 % in frontage of the real
property abutting on the streets named in the Petition as the location of the
improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:

The Petition is hereby declared to have been signed by the owners of at least 35 % of
the frontage of the real property abutting on the streets named in the petition as the
location of the improvement. This declaration is made in conformity to Minnesota
Statutes, Section 429.035.
2. This Petition is hereby referred to Maier Stewart & Associates who is instructed to
provide to the City Council a report advising, in a preliminary way, whether the
proposed improvement is feasible and whether the improvement should thus be made
as proposed or in connection with some other improvement and the estimated cost of
the improvement as recommended.
Passed and adopted this 20th day of December, 1993.
