ISSUE
Todd Altenweg is requesting a conditional use permit to operate
an upholstery business out of his home. The applicant's
business will consist of upholstering sofas, chairs, car seats,
etc. The memo to the Planning Commission explaining the
request in detail is attached.

ANALYSIS
e
The applicant has indicated that he will be the only employee
of the business and plans on working approximately 40 hours per
week during normal business hours. The business will consist
of Mr. Altenweg picking up and delivering all items he
reupholsters, therefore, no customers should be coming directly
to the home. Mr. Altenweg will do all the work within the
confines of his insulated garage. This should aid in keeping
noise to a minimum. The tools used for the applicant's
upholstery shop will consist of an industrial sewing machine,
large cutting table, small air compressor, air staple gun,
hammers, etc. There will be no exterior storage associated
with this business.
PLANNING COMMISSION MEETING
At the November 23, 1993, Planning Commission meeting, a
resident did express some concern about the possibility of
excess noise from the upholstery business. In response to this
concern, the Planning Commission added a condition which would
trigger immediate Planning Commission and City Council review
if valid complaints were received concerning noise.
RECOMMENDATION
The Planning Commission unanimously recommended approval of the
conditional use permit for Todd Altenweg with the following
conditions:

BACKGROUND
Mr. Altenweg is applying for a conditional use permit to
operate an upholstery business out of his home. He has
indicated that he will be the only employee of the business and
plans on working approximately 40 hours per week during normal
business hours. Mr. Altenweg is proposing to pick up and
deliver all items he upholsters, therefore, no customers should
be coming directly to the home. The applicant's business will
consist of upholstering sofas, chairs, car seats, etc. Mr.
Altenweg will do the work within the confines of his insulated
garage. This should aid in keeping noise to a minimum. The
tools used for the applicant's upholstery shop consist of an
industrial sewing machine, large cutting table, small air
compressor, air staple gun, hammers, etc. There will be no
exterior storage of related materials. Mr. Altenweg is the
only occupant of the home and, in his opinion, will have ample
room to park his vehicle inside the garage in one stall and run
his business in the other stall.
SIGNAGE
The applicant has indicated that he does not want any signage
for his business. City code allows a two square foot sign to
be mounted flat on the wall of the dwelling for permitted home
occupations. Staff is recommending this amount of signage be
allowed for this use, if the applicant desires.

~ OTHER HOME OCCUPATIONS IN THE AREA
Staff has done some research on other home occupations in this
area. Last year, a conditional use permit for a home
occupation was approved for David & Barb Erbstoesser of
l1796-l95th Avenue NW (Lot 2, Block 2, Schoolview First
Addition), Elk River, for a wood craft business out of his
garage. Ann Bergstrom, located at 19263 Lowell Street, also
received a conditional use permit in 1981 for a hair care
business. Therefore, Mr. Altenweg's business would not be out
of character for this neighborhood.
RECOMMENDATION
Staff feels this request meets the seven standards for a
conditional use permit as outlined in Section 900.2 of the Elk
River City Code of Ordinances as well as the Home Occupation
Ordinance. Staff is recommending approval of this conditional
use permit request to operate an upholstery business out of the
applicant's home, with the following conditions:

My name is Todd Altenweg and I have been in the upholstery
business for 9 years. I am the sole proprietor in the
business. I plan on conducting my business out of the garage
during normal day time hours. The garage will also be able
to function as a normal garage.
The major part of my business consists of automobile seats
which are removed from the vehicle and transported by me to
my shop for upholstery. For furniture I pick up and deliver
all of my jobs. There will be no walk in customers, all will
be by appointment only.
