Overview
Staff is recommending dle City Council continue tlle request until August 21, 2006 to allow the applicant
to cOlnplete an engineering study.
TIle applicant is requesting an Easement \1 acation to 'vacate a large portion of an existing easement to
construct an in-ground swimming pool.
Staff llas been in con'versations \vitIl the applicant's representative from Atlantis Pools for se\.Teral
mondlS. 1"\.t the initial meeting \vitll Atlantis Pools, planning staff had indicated tllat an easement v~acation
\vas needed for tlle request at this subject property (as \vell as second separate property we discussed that
day). As indicated in IvIt. NIaurer's memorandum, l1e also had previous discussions ,vith Atlantis Pools
and indicated in general, before the City would vacate an existing easement, the applicant would need to
provide an engineering study either documenting that the easement is not needed or tllat there is anotller
method of providing the service of the ~lacated easement.
Planning staff Ilad sent a letter dated July 6, 2006 indicating a similar request that documentation showing
that such an easement \Tacation \vill not ad\.Tersely affect properties within the development. A survey was
pro\rided \Vitll a note stating dlat "No significant drainage from adjacent property goes through tlle
portion of easement to be vacated." TIus document does not pro\ride the needed information to
determine if tllat the 'vacated easement \vill not ad,rersely affect neighboring properties 'Widlln tile
de\Telopment.

SUBJECT: Greg & Cathy Stein Easement Vacation
As requested, I have taken a preliminary look at the Greg aQ.d Cathy Stein proposed
easement vacation on Lot 2, Block 3 Ridges of Rice Lake for installation of a proposed pool.
I have previously discussed this issue with Mark from Atlantis Pool Company. I had
indicated to Mark that in general, before the City would vacate an existing easement, the
applicant would need to provide an engineering study either docmnenting that the easement
is not needed or that there is another method of providing the service of the vacated
easement. Since we have received no engineering study or any indication of how the vacated
easement's operation vrill be accounted for, we must recommend denial of the proposed
easement vacatIon.
