SUBJECT: UPDATE ON COUNTY DITCH #28
At the December 22 County Board meeting, the Redistributionment
of Benefit for Ditch 28 was discussed. It is likely the County
will apply future assessments to the City for city streets that
ultimately drain into County Ditch #28. The issue of turning
that portion of Ditch #28 that lies within the City limits over
to the City was also discussed.

Staff was in attendance at this County Board meeting and
encouraged the County Board to discuss these issues with the
Elk River City Council before making any decisions. The County
Board moved to create a Task Force made up of appropriate
County staff members and possibly one or two County
Commissioners to discuss Ditch #28 with appropriate City staff
and possibly one or two Councilmembers. The County would like
to have this discussion some time in January.
Ditch #28 appears to be an ongoing problem that does not seem
to be getting resolved very quickly. Staff recommends that the
Council establish a Task Force made up of myself, Terry Maurer,
Peter Beck, and one Councilmember, to formulate a
recommendation to the entire Council on the City's position
regarding Ditch #28 after discussions with the County's Task
Force.
