TO: MAYOR AND CITY COUNCIL FROM: STEPHEN ROHLF, BUILDING AND ZONING ADMINISTRATOR JANUARY 18, 1994 ~~ DATE: SUBJECT: ORDINANCE AMENDMENT TO 1006 "GAS FITTING AND REGULATIONS" BY THE RIVER SECTION INSTALLATION CITY OF ELK The City of Elk River currently has a permit and charges a fee for gas fitting and installation of gas appliances. However, other mechanical work including duct work for gas furnaces and ventilation systems does not currently require a permit (it is covered under the general building permit). . Not having a specific permit for this type of work leaves two issues: 1) the contractor doing the work is not signing-off on the permit and; 2) the cost of the time consuming inspections for this type of work are not being covered. The inspection costs are especially important with commercial jobs. State law mandates the maximum permit for mechanical work on a single family home is $100.00. Staff recommends a permit for all mechanical work be required and the fee be 1% of the valuation of the work (see City permit fee schedule "B"). This recommendation also requires changes to Section 1006 of the Elk River Code of Ordinances entitled "Gas Fitting and Installation Regulations." An ordinance amendment to accomplish this is included with this memo. This amendment does not require Planning Commission review or public hearing. - P.O. ORDINANCE 94 - 1 AN ORDINANCE AMENDING SECTION 1006 GAS FITTING AND INSTALLATION REGULATIONS The City Council of the City of Elk River does ordain as follows: Section 1. That the heading of Section 1006 of the City of Elk River Code of Ordinance titled "Gas Fitting and Installation Regulations" be amended to read as follows: HEATING, VENTILATION, AIR CONDITIONING AND GAS FITTING AND INSTALLATION REGULATIONS Section 2. That Section 1006 be amended to read as follows: 1006.00 - DEFINITIONS GAS FITTER- The term "gas fitter" shall mean any person engaged in the business of installing, altering, repairing, testing, or extending any fuel tanks, power plants, gas or oil burners, gas or oil piping or gas appliance items or connections. HEATING, VENTILATION, AND AIR CONDITIONING- Includes installing, altering and repairing all heating, ventilation, and air conditioning appliance items, connections and appendages, no matter what the fuel source. Section 3. That Section 1006.04 be amended by adding the following: 4. The installation, alteration or repair of non-gas heating, ventilation and air conditioning appliance items, connections or appendages does not require a City license, but a proper permit must first be obtained. Section 4. That Section 1006.06 (3) be amended to read as follows: 3. The applicant shall state the precise nature of the work for which the permit is sought, the location where such work is to be done, and the valuation of work. If a permit is issued, it shall only be valid for the work and the location specified by the applicant. . . . Section 5. That Section 1006.06 be amended by adding the following: 6. The City Council shall by Resolution, from time to time, establish a schedule of fees for permits required by Section 1006.06. Section 6. That this ordinance shall take affect and be in full force from and after the date of its publication. Passed and adopted this 18th day of January, 1994.
