INTRODUCTION
Fees charged by the City are reviewed on a yearly basis. The
Council adopts a resolution to reflect fee changes.
INFORMATION
Attached is a 1994 Fee Schedule. All items marked with an
asterisk (*) reflect changes from 1993. The changes are
explained in the attached memos from the Building and Zoning
Administrator, the City Planner and the City Clerk. All
unmarked items reflect no change from 1993.
ACTION REQUESTED

Motion to adopt the attached resolution setting fees. If the
Council does not concur with staff recommendations, the
resolution can be adopted with amendments to the fee schedule.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION SETTING FEES
WHEREAS, the cost incurred to process the various licenses,
services, zoning requests, etc. has been studied; and
WHEREAS, the study of these fees has resulted in an increase in
certain fees; and
WHEREAS, this resolution reflects the increase in certain
fees and sets the fees charged by the City for 1994;
and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Elk River, Minnesota that fees shall be adopted as
indicated on the attached Fee Schedule.
Passed and adopted by the Elk River City Council this 18th
day of January, 1994.

SUBJECT: FEE SCHEDULE
Of the items Building and Zoning staff deal with (not including
planning requests), staff recommends the following have their
fees raised or established for 1994:
1. Wetland draining or filling permit. This is a new permit
required to deal with the Wetland Conservation Act (see
Wetland Conservation Act memo included in this packet).
Staff recommends the fee for this permit be $75.00 plus
consultant costs (maximum allowed by law).
2.
Heating, ventilation, air conditioning and gas fitting
permit fee. This is partly a new permit and partly an
old. The City currently requires a permit and charges a
fee for gas work but not other mechanical work. Staff
recommends a permit for all types of mechanical work be
required, with a fee of 1% of the valuation of the work
(see City permit fee schedule "B"). Further, to be
consistent with the State law, staff recommends the
maximum mechanical permit for single family home is
$100.00.

SUBJECT: PLANNING FEES
To help evaluate whether the City needs to adjust the existing
planning fees, a survey was completed to see how Elk River
compares to other communities. In making this comparison, it
is important to recognize what neighboring communities charge
for their planning fees, however, it is equally important to
make a comparison with communities with similar characteristics
and development activity.
Therefore, communities such as Coon Rapids, Champlin, Lino
Lakes, and Monticello, may be a better comparison as opposed to
Anoka, Dayton, or Otsego where development is not on a par with
Elk River. Regardless, it is worthwhile to recognize the range
in fees communities charge for planning applications to see how
Elk River compares to other communities.

Towards the bottom of the survey, Elk River's existing planning
fees are listed along with an average fee for the communities
surveyed. Applying the average as a benchmark and objectively
looking at comparable communities, the proposed fee structure
was derived.
Staff believes the proposed fees are fair, competitive with
similar communities, and will have no detrimental affects on
development activity. Therefore, it is recommended the City
Council consider increasing the planning fees as presented.
Lastly, it is worth noting that the fees listed in the survey
are 1993 fees. Several communities did indicate that they are
planning on increasing their fees for 1994.

SCHEDULE
INTRODUCTION
Staff is recommending changes to the fee schedule as follows:
CIGARETTE LICENSE - Existing $15.00 - Recommendation - $25.00
Staff researched 10 cities to determine an appropriate fee to
charge for cigarette licenses. The fees ranged from $0 to
$50.00. The average was about $25.00.

This is a new fee which originated from an ordinance recently
adopted by the Council.
PARKING STICKERS
Parking stickers for the railroad parking lots have been
increased from $1.00 to $12.00 per year. Staff felt that
$12.00 more accurately reflected the cost of the stickers and
staff time to distribute the parking stickers. Those persons
parking in the parking lot are allowed to purchase three
stickers for $12.00. This accommodates those businesses that
have employees who work at different times.
ACTION REQUESTED
Staff recommends that these fees be incorporated in the fee
schedule for 1994.

HEATING, VENTILATION, AIR CONDITIONING AND
GAS FITTING PERMIT FEES
FEES REQUIRED
The Chief Building Inspector, before issuing any permit for the
installation, alteration, or repair of any heating,
ventilation, and air conditioning appliance items, connections
or appendages and all gas piping, or gas fixtures, or device
shall require the payment by the applicant for such permit of
fees in the amount herein.
MINIMUM FEE
In no case shall the fee charged for any permit issued by the
Chief Building Inspector be less than $18.00.
MAXIMUM FEE
In no case shall the fee charged for any permit issued by the
Chief Building Inspector be more than $100.00 for a single
family home.
PERMIT FEE
APPLIANCE
PIPING
FOR HEATING, VENTILATION, AND AIR CONDITIONING
ITEMS, CONNECTIONS OR APPENDAGES, INCLUDING GAS
For any permit for the installation, alteration, or repair of
the above-referenced items, the fee shall be one percent (1%)
of the valuation of the work or as calculated under the Uniform
Mechanical Code, whichever is greater.

CITY OF ELK RIVER
PLUMBING PERMIT FEES
The Chief Building Inspector, before issuing any permit for the
installation of any plumbing work, fixture, or device, shall
require the payment by the applicant for such permit of fees in
the amount herein provided.
MINIMUM FEE
In no case shall the fee charged for any permit issued by the
Chief Building Inspector be less than Eighteen Dollars ($18.00).
BASIC FEES
(A)
The fees for all plumbing permits shall be computed on the
basis of the number of fixture openings, plumbing fixtures, or
devices provided for in such permits, whether subsequently so
installed or not, and the fee for each fixture so provided for
shall, except as hereinafter otherwise specifically provided,
be Six Dollars ($6.00) for each fixture installed or replaced
or set only (no waste or vent piping), the fee for each such
fixture shall be Six Dollars ($6.00).
(B)
Where any such permit is issued for roughing in plumbing
openings only, providing for certain proposed fixtures, which
are to be installed or set later, a fee of Six Dollars ($6.00)
shall be charged for each such opening, which fee shall be in
addition to the fee charged for other plumbing work included in
the same permit.
(C)
For the purpose of this article, a plumbing fixture shall be
taken to mean and include any sink, laundry tub, bathtub, was
basin, drinking fountain, floor drain, or any other plumbing
device arranged to be connected with the sewer or plumbing
system, either directly or indirectly, and required to be
trapped.

ALTERATIONS, REPAIRS
For each permit for the alteration or repalrlng of existing
plumbing work not included above, the fee shall be Six Dollars
and Twenty-five Cents ($6.25) for the first Five Hundred
Dollars ($500.00) or fraction thereof in the estimated cost of
such proposed work. For each additional Five Hundred Dollars
($500.00) or fraction thereof in such estimated cost, Six
Dollars and Twenty-five Cents ($6.25) shall be added to the
above described fee for such permit.
