SUBJECT: BEAUDRY EXPRESS - PLACEMENT
OF SIGN WITHIN 6TH STREET RIGHT
OF WAY
REQUEST
Construct a sign within 6th Street right of way prior the vacation request
being acted upon by the City Council.
OVERVIEW
e
Beaudry Express Convenience Store and Gas Station, at the corner of Proctor
Avenue and Highway 10, is nearly completed and ready for business.
However, Mr. Beaudry has realized that the best location for his free
standing sign would be within 6th Street right of way. Therefore, a request
to vacate 6th Street in front of the new Beaudry Express Convenience and
Gas Station has been submitted.
This vacation request will be brought before the City Council either late
February or early March. Unfortunately, the time to process this vacation
request conflicts with Mr. Beaudry's desire to have a sign up and operational
during the opening of the store. Mr. Beaudry would like to install the sign
prior to the vacation request being acted upon by the Council. Staff has
reviewed this vacation request and believes 6th Street is no longer needed
since its connection with Proctor has been eliminated. There are utilities
however, within 6th Street that will require a utility easement be retained to
protect these existing utilities.
RECOMMENDATION
It is recommended the City Council allow Ken Beaudry to construct a sign
within 6th Street right of way prior to the vacation request being acted upon
by the City Council, with the following stipulations:

IN THE EVENT THE VACATION REQUEST IS DENIED BY
THE CITY COUNCIL, THE SIGN SHALL BE REMOVED
WITHIN A 7 DAY PERIOD FROM THE DATE OF COUNCIL
ACTION (See attached letter from Ken Beaudry accepting these
terms).
2. A SIGN PERMIT BE OBTAINED PRIOR TO CONSTRUCTING
THE SIGN.
