RE: 221st Avenue Construction Bids
Dear Council Members:
On Monday, September 20, 1993, bids were opened for the realignment and reconstruction
of 221st Avenue in the northern part of the City. There were a total of four bids. The
following table provides a list of the bidders and their bids.

Since the opening of the bids, City staff has been working with the two landowners in
question to review the proposed realignment and to secure the necessary easement documents.
We have also been working with the landowners in an attempt to secure Class 5 material to
help reduce the total cost of the project. At this point in time we have not yet completed
these processes and feel that the low bid, which is slightly over $100,000, is too high to
proceed with at this time. We believe that given a little more time to work with the property
owners, we will be able to get cooperation from them which should help to reduce the total
cost of the project. Therefore, at this point in time, City staff is recommending that all bids
be rejected and the project be reconsidered in 1994. I have prepared a draft resolution
attached for your consideration which rejects the bids.
If you have any questions, I will be at attendance at Monday evening's meetings.

SUBJECT: CIP OVERLAY PROJECT PETERSON ADDN.
The streets in this development were paved in 1978 or 1979 and are in poor
condition. I would recommend a two inch thick bituminous overlay that
would add to the structural strength of the existing pavement.
I believe that there would be 29 benefited properties.
The estimated cost for the overlay is $40,500, with City overhead of 10% or
$4,050 for a total of $44,550; this total divided by 29 properties would come to
a total of $1,536 per lot.

in poor condition. I would recommend a two inch thick bituminous overlay

RESOLUTION NO. 94 -
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION REQUESTING VARIANCES FROM MINNESOTA DEPARTMENT
OF TRANSPORTATION RULES FOR STATE AID OPERATIONS TO ALLOW
RECONSTRUCTION OF JACKSON AVENUE USING MUNICIPAL STATE
AID TURNBACK FUNDS.
WHEREAS, the segment of Jackson Avenue from Trunk Highway 10 to Trunk Highway
169 was reverted from TH 201 (old 169) to the City of Elk River's
Municipal State Aid System in September 1987, and
WHEREAS, the segment of Jackson Avenue from TH 10 to School Street was
reconstructed to a 44 foot urban section in 1988, and
WHEREAS, the segment of Jackson Avenue from School Street to TH 169 was overlaid
as a temporary measure to improve the driving surface at that time in 1988,
and
WHEREAS, the City understood in 1988 that Municipal State Aid Tumback Funds could
be utilized in the tumback, 1987 to 1997, to further reconstruct Jackson
Avenue from School Street to TH 169 once development of the adjacent area
occured, and
WHEREAS, the City of Elk River has plans to reconstruct Jackson Avenue from School
Street to Trunk Highway 169 by lowering the rural road section and
constructing an urban road section to meet the growing needs of the
community, and
WHEREAS, this improvement does not meet the Minnesota Department of Transportation
rules for State Aid Operations, Chapter 8820.2900;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. That the City requests a variance from Minnesota Department of Transportation's,
State Aid Operations Rules, Chapter 8820.2900, to allow the use of Municipal State
Aid Tumback Funds for the reconstruction of Jackson Avenue from School Street
to Trunk Highway 169.

That the City agrees to credit back the Municipal State Aid Tumback Funds spent
for the overlay of this road segment in 1988.
3. That the City directs MSA Consulting Engineers to prepare and submit the
necessary documents to the State for said variance request.
