MEMORANDUM TO: MAYOR & CITY COUNCIL FROM: PAT KLAERS, CITY DATE: MARCH 3, 1994 SUBJECT: WAGE INCENTIVE PROGRAM UPDATE The Wage Incentive Program (WIP) associated with the 1993-94 Police Union Contract went into effect on 12/31/93. The first tests (skills and physical fitness) are scheduled for mid to late April. . The draft program was approved by the City Council on 3/1/93 with some minor changes being reviewed. Regarding the issues discussed at the 3/1/93 meeting (see attached minutes) the following WIP items should be noted: 1. The community service activity is not required to take place in Elk River; 2. The education incentive must be job related; 3. There is no reference to illegal drugs as this in included in our City Personnel Ordinance; and, 4. There are no weight restrictions included in this voluntary plan. The weight restriction issue was the most difficult to address. The physical fitness standards are higher than normal, so it was the belief of the Committee that an employee would have to be in good physical condition and not overweight if they could achieve the physical fitness wage incentive. Also, the ADA law is in effect and can relate to obesity and discrimination issues. These and other factors were reviewed by the WIP Committee at a number of meetings and led to the recommendation that no weight restrictions be incorporated into this voluntary plan. A motion to this effect was unanimously approved at the most recent Committee meeting. Attached for your review is the final draft WIP. The Council approved the first draft a year ago and it is appropriate that they also accept and approve this final draft. . Call Executive Session of City Council to Order Pursuant to due call and notice thereof, the Executive Session of the Elk River City Council was called to order at 6:00 p.m. by Mayor Duitsman. The Wage Incentive Program (WIP), which is being proposed in lieu of the longevity benefit, was discussed by the Council. The City Administrator noted that the WIP document that the Council is reviewing should also include a requirement regarding employee weight control in the physical fitness area and that the education incentive must be job related. The issue of community involvement was discussed. The Council discussed whether or not the officers should be allowed to participate in community activities in their own community. e COUNCILMEMBER HOLMGREN MOVED TO OFFER THE WAGE INCENTIVE PROGRAM RATHER THAN LONGEVITY WITH COMMUNITY SERVICE TO BE ALLOWED IN THE OFFICERS OWN COMMUNITY. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-1. Councilmember Scheel opposed. The Council discussed the health insurance issue and the fact that the City employees cannot consider another type of plan unless it is accepted by the Police Union. The Council directed the City Administrator to try to negotiate with the Police Department alternatives to the current insurance plan because the current plan is too expensive. The Council decided to select option one as submitted by the Police Union on 10/12/92 with the WIP being offered instead of longevity. It was the consensus to not have a City Council representative present during Union negotiations. COUNCILMEMBER CITY COUNCIL. CARRIED 5-0. THE MOTION The Executive Session of the Elk River City Council adjourn at 7:02 p.m. Respectfully submitted, . ~'::fA~ ~ Sandra Thackeray City Clerk e December, 1993 CITY OF ELK RIVER POLICE DEPARTMENT WAGE INCENTIVE PROGRAM (WIP) The Elk River Police Officers are members of a Police Union. The Elk River Police Officers are represented by the Minnesota Teamsters Public and Law Enforcement Employees Union Local #320. In 1991, during negotiations for the 1991-92 Police Union Contract, extensive discussion took place over the issue of longevity. Longevity is a program that is in many metropolitan municipal police union contracts and is a program where officers are provided additional wages based on the length of service with the City. After lengthy negotiations, the 1991-92 Police Contract between the City and the Union was settled without including any longevity program or benefits. During the negotiations, the City indicated its interest in establishing a committee to review additional police officer wage incentives above and beyond the typical wage plan. e The City believed that it was inappropriate to award Police Officers additional wages based solely on years of service. Instead, the City indicated it would consider an alternative program that provided additional wage compensation above the annual pay increases. The goal of the WIP is to help encourage a healthy, well-rounded work force through the non- use of tobacco (wellness), participation community service, a physical fitness program, an education program, and through a skills evaluation program. This type of program benefits the employees, the employer, and the community as a whole. The City felt that additional wage incentives based on a program of this type was more relevant than paying straight longevity. The WIP is a voluntary plan and is open to all full-time Police Officers excluding the Chief of Police. The components of the program are summarized in the following pages. The program has been approved by the City Council. . e December, 1993 2 of 8 Pages WIP OVERVIEW The Wage Incentive Program is a voluntary plan. The components of the WIP include a physical fitness section, a wellness section, a community service section, an educational section, and a skills evaluation section. The goal of the WIP is to help develop a health, well-rounded work force which will provide benefits to the employee, employer, and the community as a whole. If all of the guidelines for the WIP are met by the employee, they will have the opportunity to obtain additional wages in the following amounts: After 5 years - Up to 30/0 of top patrol prorated per month After 9 years - Up to 4.50/0 of top patrol prorated per month After 13 years - Up to 60/0 of top patrol prorated per month After 17 years - Up to 7.50/0 of top patrol prorated per month e Only full-time years of service qualify. Based on the priorities of the WIP, the wage incentives are offered in the following breakdown: 400/0 for Physical Fitness 100/0 for Wellness 200/0 for Education 100/0 for Community Service 200/0 for Skills Employees are eligible to begin obtaining additional wages starting in the month after they have reached the minimum length of service required. The tests for the physical fitness and skills sections will be conducted in April and October each year. Evidences of compliance to the requirements of the community service, wellness, and education sections will be evaluated in December of each year. Payments for the education, wellness, and community services sections will be on December 31 and payments for the skills and physical fitness sections will be on April 30 and October 31. . e December, 1993 3 of 8 Pages WIP OVERVIEW (Continued) EXAMPLES: # 1 - An employee achieves fIVe (5) years of service as a full time Elk River police officer in mid January. The employee is eligible to take the April skills and physical fitness tests. If passed, the wages available in these two sections will be paid on April 30 for the eligible months of February, March, and April. In October, the employee is eligible to take the skills and physical fitness tests and, if passed, to receive the wage incentive available for the six months since the April tests. In December, the employee is eligible for all the wages available in the other sections of the WIP for the eligible months. e #2 - An employee achieves fIVe years of service as a full time Elk River Polices Officer in mid August. The employee is eligible to take the October skills and physical fitness tests. If passed, the wages available in these two sections will be paid on October 31 for September and October. In December, the employee is also eligible for the wages available in the other sections of the WIP (community service, well ness, and education) for the last four months of the year subject to the maximum wage guidelines. The WIP is a voluntary plan and, as such, all components of the plan are nongrievable and nonarbitrable. The Chief of Police will establish a Committee or Committees to oversee the administration of the program. The determination of these Committees on which employees successfully complete the requirements of the WIP is final. The Committee members will be appointed annually by the Chief of Police, and an employee may serve on the Committee as long as deemed appropriate by the Chief of Police. e e December, 1993 4 of 8 Pages PROGRAM: Physical Fitness WAGE INCENTIVE: 400/0 of the total available COMPONENTS: Physical Fitness - This is a voluntary plan. In order to obtain the wage incentive available within this section of the plan, the employee will have to meet the standards in three physical fitness areas. These three physical fitness areas are running, sit-ups, and push-ups. The employee will have to successfully complete tests twice per year in accordance with established standards. These standards are attached to this document as Appendix A. Employee must pass all three tests in accordance to the standards in order to obtain the additional wage incentive that is available. Either all or none of the wages offered will be obtained and nothing in between will be offered for meeting only parts of the standards. e The employees participating in the WIP shall take the running, sit-ups, and push-ups tests on their own time. A committee assigned by the Chief of Police will administer these physical fitness tests. The employees administering the tests are allowed to do so on employer time. In order to participate in the physical fitness section of this Wage Incentive Program, the employee must sign off on a waiver form. e If an employee participating in this section of the Wage Incentive Program cannot complete the running, sit- ups, and push-ups tests due to injury or illness beyond the control of the employee, then an alternative test will be established by the Committee. If the Committee is unable to arrive at a satisfactory alternative testing plan, the employer may implement an alternative testing plan. The program will be administered and will be in compliance with all local, state, and federal laws governing discrimination based on handicap, disability, race, gender, or age. e December, 1993 5 of 8 Pages PROGRAM: Wellness WAGE INCENTIVE: 100/0 of the total available COMPONENTS: Wellness - In order to obtain the wage incentive available from the voluntary wellness section of this program, the employee will have to verify that hel she has not used tobacco for the last twelve months. If an employee has stopped the use of tobacco at some point in the year and has continued to not use tobacco through the end of the year, the Committee appointed by the Chief of Police to administer the WIP may recommend to the Chief of Police partial payment for this wellness section of the WIP. There are no tests that are required for this section of the program. It is acknowledged that this section of the program is voluntary and somewhat on the Ilhonor" of the employee. e e e December, 1993 6 of 8 Pages PROGRAM: Education WAGE INCENTIVE: 200/0 of the total available COMPONENTS: e e The employee participating in this voluntary section of the WIP can obtain the additional wage incentive in one of two manners. One way to obtain the additional wage offered is to have received a four-year bachelor's degree from an accredited college or University. The degree must be job related. The second way in which the additional wage incentive may be obtained is to successfully complete classes from an accredited college or University. This continuing education part of the WIP is above and beyond individual POST licensing requirements or classes. The employee must successfully complete twelve ( 12) quarter credits or the equivalent in semester credits per year in order to achieve the wage incentives. A grade of C or better is required. The classes must be job related. To encourage continuing education for all City employees, the City will reimburse employees for college courses consistent with the City's tuition reimbursement policy that is annually approved by the City Council. e December, 1993 7 of 8 Pages PROGRAM: Community Service WAGE INCENTIVE: 100/0 of the total available e COMPONENTS: This voluntary section of the Wage Incentive Program must be completed on employee's time. The employee must show evidence of participation in community services or activities. The employee must be active for the entire year in at least one community service or activity. The activity or community service does not need to be based in Elk River. The community service or activity must be preapproved by the Chief of Police. Examples of community services or activities include membership and participation in such groups as the Arts Council, Jaycees Organization, Lions Club, Rotary Club, Community Theater, Church Groups, Community Outreach Programs, Youth Organizations, United Way activities, CAER, etc. Evidence of participation must be shown annually. Any participation in a community service organization that is required by the Chief of Police as part of the employees duties as a police officer will not be considered an eligible activity for meeting the requirements of this section of the WIP. e e December, 1993 8 of 8 Pages PROGRAM: Skills WAGE INCENTIVE: 200/0 of the total available COMPONENTS: Two separate tests will be developed to evaluate the skills of the employees. One test will be for Patrol Officers and a second test will be for employees assigned to Juvenilellnvestigator activities. A Committee will be appointed by the Chief of Police to develop the test questions. The tests will be taken on employee time if they choose to participate in this voluntary program. The majority of the skills assessment will be based on the Department's Policy and Procedure Manual, Criminal Code, City Ordinances, traffic laws and other information deemed appropriate by the Committee. e The test will be offered twice per year. The test will be composed of 24 questions each. A passing grade of 750/0 is required in order to obtain the wage incentive available. The Committee will determine the mix of the questions in terms of how much of each test is related to the special assignments of the employees. e .. . ~ .-. -..., .
