BID AWARD AND CHANGE ORDER NO. 1
Dear Council Members:
As you are aware, the storm drainage improvements in the Deerfield 3rd area to relieve the
drainage problem on the Poppen property were bid last October. The low bid was submitted
by W. B. Miller, Inc., in the amount of $122,307. Since that time, we have been
negotiating with Mr. Steve Hartman for an easement to cross his property in Royal Oaks
Ridge for the outlet to the storm sewer improvement. Those negotiations have been
completed and the result is Change Order No.1, a copy of which is attached. Change Order
No. 1 extends the storm sewer pipe across Mr. Hartman I s property outletting to the wetland
south of his home. The total increase in cost of this change order is $16,637, for a total
project cost of $138,944.
In order to proceed with this project, it is necessary to accept the bid and order the execution
of the contract withW. B. Miller for the completion of the improvements and to approve
Change Order No. 1 to meet the intent of the easement agreement with Mr. Hartman.
Attached is a draft resolution which accomplishes these two items. We would recommend
City Council adopt the resolution if they desire to proceed with this project.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ACCEPTING BID AND AUTHORIZING
EXECUTION OF CONTRACT IN THE MATTER OF THE
DEERFIELD 3RD STORM DRAINAGE IMPROVEMENT OF 1994
WHEREAS pursuant to Resolution 93-60, competitive bids were solicited and received for the
Deerfield 3rd Storm Drainage improvement as set forth in the bid tabulation
attached hereto and incorporated herein by this reference; and
WHEREAS the City Council has considered the amount of the bids and the responsibility of the
bidders and determined that W. B. Miller, Inc., is the lowest responsible bidder;
and
WHEREAS the City Council has considered Change Order No. 1 to extend the storm sewer
pipe in accordance with the Hartman easement agreement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. The Mayor and City Administrator are authorized and directed to execute, on behalf of the
City, such contract and Change Order No.1 with W. B. Miller, Inc., as is approved by
the City Attorney for the completion of the Deerfield 3rd Storm Drainage improvement
according to the approved plans and specifications designated in Resolution 93-60.
2. The City Administrator is authorized and directed to forthwith return to all bidders the
deposits made with their bids upon execution of the contract above specified.

DEERFIELD 3RD ADDITION STORMW ATER SYSTEM IMPROVEMENTS
February 23, 1994
Change Order No.1 extends the outlet pipe from north of the Hartman property driveway
in Royal Oaks Ridge (Lot 11), through lot 12 and into an existing wetland. The new design
involves additional 36" RCP, an extra manhole, driveway removal and restoration, a conduit
through the driveway embankment for a sprinkler system, and rip-rap.
The original design terminated the outlet pipe north of the driveway, with a 42" RCP
through the driveway embankment. In exchange for the drainage easement through the Hartman
property, the Owner requested a buried pipe rather than a swale-type arrangement.
All prices are either unit prices from the original bid or new prices for additional items not
in the original bid. Two items, the 36" RCP and 2" Bituminous Driveway, were requested by the
Contractor to be modified from the original bid unit price. The cost change is shown below.

From $8.00 to $12.00 per square yard
A permit, dated February 15, 1994, was received from the U.S. Army Corps of Engineers
for the work required under the Change Order in the fringe wetland area around the existing
pond/wetland.
It is understood that the homeowner, Mr. Hartman, will contract independently for the
restoration of the area disturbed by the construction. The contractor is obligated to salvage any
topsoil and respread it after construction.
Costs associated with this Change Order are shown on the attached Change Order cost
breakdown.
