RE: CONCORD STREET IMPROVEMENTS
BID AWARD AND CHANGE ORDER NO. 1
Dear Council Members:
As you may be aware, Concord Street is a private roadway south of County Road 33 in the
area of the Greenhead Additions. Earlier this year, residents from Concord Street contacted
City staff regarding the possible upgrading and public takeover of their roadway. A visual
survey of the street was performed and an informational meeting was held in February with
the residents, at which time four options for the public takeover were discussed. Those four
options are listed below.

Bituminous roadway 26 feet wide with 3-foot aggregate shoulders.
32-foot wide gravel base roadway.
Bituminous roadway 22 feet wide with 2-foot gravel shoulders.
26-foot wide gravel base roadway.
After the informational hearing, the property owners submitted the attached petition which
is signed by 9 of the 12 to 13 owners abutting the street. The petition requests an
improvement of Concord Street in accordance with Option #3, which is a bituminous
surfaced roadway, 22 feet wide with 2-foot gravel shoulders. The petition goes on to request
a term of 15 years for the assessments at the current interest rate which they believe to be
approximately 6%. You will note on the petition they indicate the only unsigned property
owners are currently in the process of selling their properties and were not in favor of
signing the petition, but are aware of the actions of their neighbors.
Attached for the City Council's consideration is a draft resolution which declares the
adequacy of the petition and orders the feasibility study for the roadway improvement. We
would recommend City Council adopt the draft resolution and proceed with this project based
on the petition submitted.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DECLARING THE ADEQUACY OF THE
PETITION FOR IMPROVEMENT AND ORDERING THE
PRELIMINARY FEASIBILITY REPORT IN THE MATTER
OF THE CONCORD STREET IMPROVEMENT OF 1994
WHEREAS the City has received a petition (the Petition) requesting that the City improve
certain property by upgrading Concord Street to a bituminous surfaced rural section
roadway (the improvements); and
WHEREAS the City has reviewed the Petition and identified the owner of the real property
abutting the streets named in the Petition and determined the Petition has been duly
executed by the owners of not less than 35 % in frontage of the real property
abutting on the streets named in the Petition as the location of the improvements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1.
The Petition is hereby declared to have been signed by the owners of at least 35 % of the
frontage of the real property abutting on the streets named in the petition as the location
of the improvement. This declaration is made in conformity to Minnesota Statutes,
Section 429.035.
2. This Petition is hereby referred to MSA, Consulting Engineers who is instructed to
provided to the City Council a report advising, in a preliminary way, whether the proposed
improvement is feasible and whether the improvement should thus be made as proposed
or in connection with some other improvement and the estimated cost of the improvement
as recommended.
Passed and adopted this 21st day of March, 1994.
