Overview
The applicant is proposing the final plat for the fifth addition of West Oaks. This plat consists of 37
to\vnhouse lots.
One of the areas to be platted is in the center of the de\Telopment, north of 183rd A "\Tenue, west of
Xerxes Street and east of Yankton Street. The plat only includes the 15 townhouse lots as all the
street right-oE-ways have been platted and the streets installed.
The second area is north of 183rd Avenue and east of Xerxes Street. The plat only includes the 22
townllouse lots as all the street rigIlt-of-ways ha"\Te been platted and the streets installed. TIus area
has been previously platted and five 2-story town home units ha\Te been constructed.
TIle location of right-of-\vays and the general location of town homes are consistent with the
preliminary plat approved by the Council on July 215\ 2003.
During the preliminary plat appro\Tal process, the lots \vere sho\vn to reflect the two story
townhomes, but the application did have examples of possible one story to"\vnhomes that could be
built. Due to market issues, the applicant is platting both areas to provide larger building sites for
one story townhomes. Some areas of tlle proposed plat are reducing the number of lots from four
units to three units. This ,vill result in fewer units overall than \vhat was approved widl the
preliminary plat.
The final plat for the fourth addition ,vas a similar request and t:\Vo 3-unit one-story units ha\Te
already been consttucted. With appro\Tal of tills request, tlle development \vill result in a mi~ture of
one and t:\Vo-story to"\vnhome units.
The City Engineer has reviewed the plat; his comments are included in the attached memo.
Parks and Recreation Dedication Recommendation
The park dedication requirement was met \vith land dedication included in the first phase.

Recommendation
Staff recommends that dle City Council approve the request, as shown on drawings stamped date
recei\Ted 7 14/2006, "vith the following conditions:
1. The City Engineer's comments shall be incorporated into the plans.
2. Surface water management fees shall be paid in the amount required by the City at the
time of final plat prior to releasing the plat for recording.
3. The letter of credit shall cover wetland mitigation. Drainage easements shall be in
place over the wetland and the wetland mitigation areas.
4. Restrictive covenants shall be recorded on the wetland and the wetland mitigation
areas.
5. A three year monitoring report on the wetland mitigation is required.
6. Street lights be installed as required by Elk River Utilities
7. A sealcoat fee in the amount to be determined by the City Engineer shall be paid prior
to releasing the plat for recording.
8. A grading and erosion control plan shall be approved by the City Engineer prior to the
issuance of building permits.
9. A development plan shall be approved by the City Engineer prior to the issuance of
building permits.
10. All grading be certified prior to the issuance of building permits.
11. All mailboxes shall be clustered.
12. A tree preservation plan shall be approved prior to releasing the plat for recording.
13. Any trees off site or on site, near the limit of grading that are to be preserved, shall be
fenced with a snow fence at the drip line to prevent grading, compaction, or storage of
equipment, debris or materials. Staff shall inspect fencing prior to grading
commencmg.
14. Water accessibility fees in the amount determined by the City shall be paid prior to
releasing the plat for recording.
15. Townhouse elevations shall comply with the design standards of the R3 zoning
district.
16. The developer shall pay $750 for each townhouse lot as part of their contribution
towards the cost of the Waco Street improvements.

Final Plat
As requested, we have reviewed the final plat for West Oaks 5th Addition. As you are aware,
the rights-af-way in this plat were originally platted "With the first addition and all public
infrastructure was constructed at that time. The multiple unit home sites were platted as
outlots and have subsequently been re-platted into buildable lots as the development has
progressed. This represents the final phase of the platting of the multiple unit building sites.
We understand that the developer is proposing some minor modification to the buildings
themselves, however, it appears that these changes have no impact on the already
constructed public infrastructure. Therefore, from an engineering standpoint, we would
recommend approval of the final plat of West Oaks 5th Addition.

A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
West Oaks Fifth Addition
Case No. P 06-12
WHEREAS, application has been made for final plat approval, pursuant to Article
V. Section 30-374 of the Elk River City Code of Ordinances, of the property legally
described on attached Exhibit A and hereinafter referred to as "tlle Property"; and
\VHEREAS, tlle application for preliminat)T plat appro1lal has been referred to the
Planning Commission which has given its advice and recommendation to the City Council;
and
WHEREAS, a preliminary plat of the Property \vas approved by the City Council on
July 21, 2003; and
\VHEREAS, the proposed final plat is consistent \vith the preliminary plat as
approved by the City Council; and
WHEREAS, tlle proposed final plat complies with each of the conditions set forth
by the City Council in its appro'Tal of the preliminary plat of the Property;
NO\'\!, THEREFORE, BE IT RESOL \TED BY THE CITY COUNCIL OF THE
CITY OF ELI( RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk Ri\Ter as follows:
A. TIle proposed subdivision is consistent with the Zoning Ordinance and
conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional plans including, but not limited to, the City's
Comprehensive De\relopment Plan.
c. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility
to flooding, and drainage are suitable for the type and density of development and
uses contemplated.
D. The proposed subdivision makes adequate provision for water supply,
storm drainage, sewage transportation, erosion control and all other setvlces,
facilities and impro'Tements othenvise required herein.
E. The proposed subcli,rision will not cause substantial environmental
damage.
F. The proposed subdivision \vill not conflict \vith easements of record or ,vitll
easements established by judgment of a court.
G. The proposed subdivision will not have an undue or ad,Terse impact on the
reasonable de\relopment of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. TIle officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied ,vith, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within dlat time.
The foregoing resolution \vas introduced by Council ivlember and
