TRUNK SANITARY SEWER AND WATER IMPROVEMENTS
Dear Mr. Klaers:
As we have previously discussed, the trunk sanitary sewer and water improvements proposed
in the Elk Park Center feasibility study will serve a much larger area, including many acres
on the east side of TH 169. In order to proceed with these improvements, the property
owners to be assessed will either need to waive their rights to a public hearing or a public
hearing will need to be held. It is unlikely that waivers of the right to a public hearing could
be easily and quickly obtained from the property owners involved; therefore, we would
recommend that the City Council hold the public hearing. This would be primarily for the
Everett Spect property. This property is proposed to be developed in the various phases of
Hillside Estates. However, it is not currently owned by the developer, Rick Foster, but is
owned by Mr. Spect. It may be just as easy to include all other property owners on that side
of the highway in the notification process to eliminate the concern about waivers of rights
of public hearing or entering into a developer's agreement prior to proceeding with the
improvements.
We have attached to this letter a draft resolution which would establish the public hearing
date on the special meeting scheduled for April 21st, when other Elk Park Center issues are
to be discussed. We are also currently working with City Clerk Sandy Thackeray to get the
notification in the paper and the mailed notices to the correct property owners.

RESOLUTION 94 -
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
IMPROVEMENT IN THE MATTER OF THE
TRUNK SANITARY SEWER AND WATER
IMPROVEMENT OF 1994
WHEREAS the Feasibility Report ordered by the Council in Resolution 93-82 has been
prepared with reference to the Elk Park Center improvement and was received by
the City on December 20, 1994; and
WHEREAS the Feasibility Report recommends that the proposed improvement is feasible;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1.
The City Council will consider the Trunk Sanitary Sewer and Water improvement as
described in the Feasibility Report and the assessment of the property abutting this
proposed improvement and properties to be served by these improvements for all or a
portion of the cost of the improvement pursuant to Minnesota Statutes, Section 429 at an
estimated total cost for the improvement of $883,000.
2. A public hearing shall be held before the City Council on the proposed improvement on
the 21st day of April, 1994, at 6:00 o'clock p.m. at Elk River City Hall.
3. The City Administrator shall provide ten days mailed notice and two weeks published
notice on the hearing as required by law.
