Location
The Home Depot is located east of Trunk Highway 169, south ofWal-Mart, west of Twin Lakes Road
Introduction
The applicant is requesting approval of a General Planning Permit to allow outdoor storage/display of
nine accessory structures ranging from 64 square feet to 400 square feet in area. The proposed location is
in the west central portion of the parking lot east of Zane Street north of 179th Ave.

Overview
The subject site is part of the Elk River Crossings Planned Unit Development (PUD). In 1996 a
Conditional Use Permit (CUP) was approved for the subject site to build a Home Depot. The
applicant is requesting approval to allow outdoor display/storage of nine accessory structures in the
parking lot from April to October. The proposal is subject to the outdoor storage and display
ordinance.
Analvsis
The outdoor storage and display ordinance states no storage of any type shall be permitted within
one-half of the required front or side street setback nearest the street. The required one-half setback
is 35 feet, the setback long Zane Ave is not indicated and will be required to meet this setback.
Building permits will be required for this display. The narrative indicates there will be signage
attached to the sheds; all signage is subject to the City of Elk River Sign Ordinance and will require a
permit.
The existing CUP conditions limits outdoor storage and/or display to the designated areas in front
of the store or within in the outdoor garden center. The request for the accessory structure display is

within the parking lot and is not consistent with this CUP condition. Upon this request, staff did a
site inspection and discovered that pallets, lawn mowers, cardboard and other miscellaneous items
are being stored outside on the south side of the building, which is violation of condition 18 and 20
of the CUP. Condition 18 prohibits outdoor storage of these sorts of items and condition 20
prohibits storage on the 45'x60' concrete pad.
There are sheds and trailers on display in front of the store and there are some plants for sale in
front of the garden center/seasonal sales area. The 6,000 square foot seasonal sales area is on the
south side of the building. This area was also approved with the CUP; staff suggests the nine
accessory buildings be placed within the approved seasonal sales area due to visibility and
parking/ access issues.
Staff not only has concerns with the size and location of the proposed display but also with the
violations of the CUP that exist today and the inconsistency of this request with the approved CUP.
A great deal of time and consideration was put into upgrading this area; this type of storage/display
visible from Zane may not be suitable for this area.
If outside display is necessary, staff suggests moving the display area to the south side of the
building in the seasonal sales area, or closer to the building and providing additional landscaping
along Zane.
Parkine: and Circulation
According to the Site Plan there are 605 parking stalls onsite; the proposed storage/display will
occupy 26 of those parking stalls for seven months (April through October) out of the year. If the
storage/ display is allowed, the required parking will no longer be met. As proposed the display will
occupy two rows of parking back to back, the accessory structure plan shows a depth of 76 feet for
the designated area, which is longer than the parking area, resulting in storage/display in the drive
aisles. Fire access must be maintained at all times, with this scenario it may be difficult to achieve.
To get a feel for what the storage area could look like the picture below by staff, superimposes the
sheds currently displayed on site into the proposed storage area.

Staff recommends that the City Council deny the request.

Should the Council desire to approve the request, staff would recommend the following conditions
apply:
1. The buildings shall meet all applicable building codes and required permits.
2. The buildings shall meet all applicable fire codes, and all drive aisles remain open.
3. The storage/display area should be set back a minimum of 35 feet from the public right-of - .
way.
4. All signage is subject to the City of Elk River Sign Ordinance and will require permits.
5. The storage/display is limited to 9 accessory structures as shown on the accessory building
plan.
6. The storage/display area shall be located as shown on the Site Plan.
7. The storage/ display shall only be up from April to October each year.
8. Any storage or display not consistent with the CUP should be removed pnor to any
additional display.

CONDITIONS NOTED IN THE PRELIMINARY PLAT APPROVAL. COUNCILMEMBER
THOMPSON SECONDED THE MOTION. THE MOTION CARRIED 5-0.
COUNCILMEMBER MOTIN MOVED TO APPROVE THE CONDITIONAL USE PERMIT
REQUESTED BY HOME DEPOT TO CONSTRUCT A 120,000 SQUARE FOOT HOME
IMPROVEMENT STORE WITH THE FOLLOWING CONDITIONS:
1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED.

4. ALL SIGNAGE SHALL BE REQUIRED TO APPLY FOR A CITY SIGN PERMIT.
5. NO FREESTANDING SIGN HAS BEEN APPROVED AS PART OF THIS
CONDITIONAL USE PERMIT.
6. ANY FUTURE EXPANSIONS OR ALTERATIONS TO THE SITE SHALL REQUIRE A
CONDITIONAL USE PERMIT.
7. THE RACKS WITHIN THE OUTDOOR STORAGE AREA/GARDEN CENTER SHALL BE
PAINTED BLACK AND STORAGE SHALL NOT EXTEND ABOVE THE TOP OF THE
FENCE.
8. SEMI TRAILERS, DROPPED TRAILERS OR CONTAINERS OR OTHER TRUCKS SHALL
NOT BE KEPT ON SITE OR USED FOR STORAGE.

4.6. Administrative Updates
City Administrator Pat Klaers informed the City Council that Director of Economic
Development Paul Steinman has submitted his resignation.
COUNCILMEMBER THOMPSON MOVED TO REGRETTABLY ACCEPT PAUL STEINMAN'S
RESIGNATION. COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION
CARRIED 5-0.
The City Administrator informed the council that the county has requested a joint
meeting with the City Council at the Sherburne County Government Center on
April 1 O. 2000 at 7 p.m.
The City Administrator informed the council that annual reports will be given by the
department heads at the April 24 City Council meeting.

Weare requesting the permit for a proposed sales display area.
The area to be used would be 6,000 sq. ft. in the west central portion of the parking lot.
The proposal is for seasonal display of storage sheds for the months of April through
October.
The total number of displays would be 9 structures of various sizes.
Signage will be attached to the storage sheds.
The proposed site would not interfere with fire or emergency access, and would not
impede the flow of traffic.
