OVERVIEW
Request for site plan review of Phase I of Elk Park Center consists of the
following:
. 65,800 square feet; Cub Foods
. 90,000 square feet; Target
. 36,600 square feet; 3 Retail Buildings; 36,600 square feet, 29,025 square
feet, and 24,600 square feet.
. TOTAL = 246,025 feet will be included in the fIrst phase.

Street to Jackson Road will occur. Trunk water and sewer will also be
extended to serve the shopping center as well as the area north and east of
Highway 169 and 193rd Avenue.
ANALYSIS
A complete site plan review has been conducted by staff and comments are
included in the letters from Terry Maurer and myself. These letters are
attached to the Planning Commission report and made part of this packet.
Generally, the proposed plans for Phase I comply with the development plan
approved by the City Council on December 20, 1993. However, there are two
areas where the plans deviate from the approved development plan. First of
all, the developers are proposing to eliminate some landscaped/traffic control
islands from the eastern end of selected parking rows (please refer to the
Planning Commission report for further details).

Secondly, signage has been modified in two areas. The monument style sign
at Freeport Avenue and Jackson Road has been increased in size from 64
square feet to 128 square feet and both Target and Cub Foods are identified.
Originally, the sign was to only identify the Center, and not include tenants.
In addition, another sign has been added which measures 6 feet high by 4
feet wide monument style for Target located at the "rear" entrance off
Jackson Road. Both these signs are illustrated on the attached exhibit in
this report.
Please refer to the attached report to the Planning Commission for additional
information.
FURTHER REVIEW
It should be noted that development of any of the outlots or additions to the
main center will require a conditional use permit. Therefore, the Planning
Commission and City Council will have the opportunity to review these
development requests in the future.
PLANNING COMMISSION RECOMMENDATION

The Planning Commission recommended approving the conditional use
permit with staffs conditions as outlined in the report. In addition, the
Planning Commission approved the sign package as presented by the
developers, which included the revised monument sign at Freeport Avenue
and Jackson Road, and the sign for Target along Jackson Road.

BACKGROUND

Over the past two and one-half years, the Planning Commission and City
Council have reviewed various applications and proposed plans for the Elk
Park CenterPUD. On December 20, 1993, the City Council approved a
conditional use permit for a commercial PUD on the entire 50 (plus or
minus) acre site. That conditional use permit included stipulations and
conditions that the entire PUD must comply with. In addition, a set of plans
referred to as the "Development Plan" was also approved as the concept plan,
which review of future site plans will be based upon. This development plan
package includes a site, landscaping, grading, setback, signage, and various
written material all incorporated into a PUD Agreement, which will be
adopted by the City Council.

Furthermore, the approval process also addressed issues that extended
beyond the limits of the project. For example, storm water drainage issues,
traffic impact studies, necessary street improvements, and environmental
reviews have all been completed and satisfied to accommodate the
development of Elk Park Center. Therefore, the purpose of this conditional
use permit, as well as future conditional use permits, will focus primarily on
specific site plan issues within the project limits.
OVERVIEW
Phase I of Elk Park Center will involve the construction and upgrading of
streets and utility lines within and around the Elk Park Center project. The
majority of this work will occur within the project itself, however,
improvements to School Street, Jackson Road, and the extension of Freeport
Avenue, will also occur. In addition to street and utility improvements, a
pedestrian system along Freeport Avenue and Jackson Road will be
constructed to facilitate easy access to the shopping center and other
destination points in the area (i.e., schools) by way of non-motorized methods.

Buildings included in the first phase are as follows:
· .65,800 square feet, Cub Foods
· 90,000 square feet, Target Store
· 3 retail buildings of 36,600, 29,025, and 24,600 square feet
246,025 square feet in total will be included in the first phase.
The package of plans submitted for Phase I are in general compliance with
the development plan approved by the City Council on December 20, 1993.
Also included and made part of the plans are certain improvements that were
specified in the conditional use permit. For example: around the ponding
area in the southwest corner, a chain~link fence with one inch by one inch
mesh has been included for security measures.
Attached is a letter from Michael Shields, AKRW Architects, describing the
architectural character, landscaping element, lighting design, signage plan,
and other miscellaneous items pertaining to the project's first phase.

ANALYSIS
A detailed list of issues are included in the attached site plan review letters
from Terry Maurer and myself. Please refer to these letters for specific
comments regarding the package of plans submitted for review. The
following is a summary of staffs review of the proposed plans.
Site Plan
Overall, the proposed site plan is generally consistent with the
approved Development Plan. The two areas of discrepancy are the
traffic control/landscaping islands along the east end of each parking
row and signage along Jackson Road. These will be described later in
the report.
Parking and Circulation
Considerable attention has been given to the circulation element of
this development. Staff has suggested the following:

Eliminating the cut out parking in front of the northerly retail bays to
reduce conflicts along this major drive aisle.
· Removing the sharp curves from the drive aisle next to the building.
· Improve the intersection of the entrance drive off Jackson Road and
the drive aisle at the northeast corner of the Target Store.
· Redesign the southerly most entrance to the shopping center off
Freeport Avenue.
The developers are proposing to deviate away from the approved
Development Plan by eliminating islands from the easterly perimeter of the
parking rows. The concept would be to retain enough parking islands to
control traffic movements and increase the size of those that are saved. One
advantage of larger islands is to enhance the conditions for shrubs and trees
to survive in a parking area. One disadvantage is, rather than having many
islands with some landscaping, there are fewer with a lot of landscaping.
This, in effect, may not achieve a complete "break up" of parking area with
landscaped areas. Reducing the number of traffic islands does not
compromise any of the traffic circulation concerns.

Landscaping
The proposed landscaping plan provides a diversity of material
throughout the site. A typical entrance planting theme is provided at
most every entrance point to the shopping center. In addition,
landscaping will be provided to adequately screen loading areas and
buffer the residential to the west. Berming and landscaping will line
the perimeter of both Freeport Avenue and Jackson Road providing an
aesthetically pleasing environment around the project.
Signage
The proposed sign package includes the following:

Development sign along Highway 169. This sign is proposed to be
thirty-five (35) feet in height and sixteen (16) feet, eight (8) inches
wide. Staff is recommending a maximum sign of thirty (30) feet high
with a total square footage of 510 square feet. This recommendation
coincides with the development sign shown in the plans sent to the
Planning Commission.

· Development sign at the corner of Freeport Avenue and Jackson Road.
This sign was intended to be eight (8) feet high with a maximum
square footage of 64 square feet, and not have any tenants listed on
the sign. The developer is proposing an eight (8) foot high and sixteen
(16) foot wide (128 square feet) sign that identify both Target and Cub
Foods. With the properly designed sign, staff does not have a problem
exceeding the 64 square feet mentioned above, however, should be
something less than 128 square feet.
· Tenant wall signs. Wall signage is proposed to consist of individual
letters no larger than thirty-two (32) inches for upper case letters and
lower case letters would be no larger than twenty-four (24) inches.
· No signage is proposed along the rear of the building. However, Target
has expressed an interest in having a small (4x4) monument style sign
at the most southerly entrance drive off of Jackson Road.

This is an overview of the issues relating to Elk Park Center. There is
considerable amount of background information relative to the conditional
use permit approval for the PUD that was not included. If any of the

RECOMMENDATION

The proposed buildings include a 65,800 square foot Cub Fc'cds store, a 90,000 square foot

square feet. respectively. The primary building matedals wili be decorative "rockfaced" concrete
masonry with integral color, face brick veneer, and prefinished metal. As indicated on the
drawings, the fronts and exposed ends of the retail buildings wi!: be constructed primarily of face
brick with decorative glazed concrete masonry accenis. The rear surfacas will t)e constructed of
decoratl','e "rockface" concrete masonry in a complementmy color. The majority of the walls for thE:

Architectural Character:
The proposed design combines traditional retail storefronts with large show windows, brick and
decorative masonry elements and metal awnings to cre~t& the character of a small towr. main
street. The design incorporates sidewalk planting areas and pedestrian scale lighting fixtl.ireS to
reinforce the sidewalk character of the retail shops. The smail town main stmet concept is further
reinforced through the use::; a consistent ornamental planting theme and decorative ilghting

Through the use of a consistent palate of materials and colors the design of the smaller retail
buildings are integrated with the prototype design of major tenants. The scale and spacing of
brick and stone-like storefront columns provides for the necessary leasing flexibility at the small
tenant shops.
The design of the monumental pylon sign and the ground monument at the major entrances
reflects the character of the retail shops by incorporating the base building materials and detailing
with the identification of the center and it's major tenants.
Landscaping:
The landscaping plan of Elk Park Center creates visual, environmental and seasonal interest
within and around the site. The surrounding tree lined streets and site entrances, as well as the
shrub-filled islands, create a sense of rhythm and balance while directing the user to and
throughout the site. Entry points are highlighted by entry feature planting which are repeated at
each major entrance. Berming and plant material in areas surrounding the site create a pleasant
screen for the residential neighborhood and surrounding community based facilities. The
landscaping will help the Elk Park Center become a community landmark in the years to come.
Major circulation routes are defined by overstory trees, clustered shrub plantings and berms,
where area permit. Pedestrian pathways are accented by seasonal plantings and ornamental
trees.
Lighting:
Pedestrian and general site lighting needs are satisfied through the use of different type and
styles of lighting fixtures. The general site lighting is provided by high pressure sodium light
fixture on 35 foot high painted steel poles. These light fixtures will provide lighting levels which
vary from 5 foot candles at the entrances to the major tenant spaces to 1.5 foot candles along the
perimeter of the parking lot. All service area lighting fixtures have been designed and placed to
maintain a "good neighbor" philosophy. These inwardly directed fixtures feature low angle cut-oft
type reflectors.
Primary entrances, major interior drives and all pedestrian walkways, within the project site, are
illuminated with an appropriately scaled decorative light fixture. These fixtures will feature a
"whiter" metal halide light source. The decorative globe fixtures will be approximately 20 feet
high.
The lighting fixtures used for the Phase One Development will establish the standard for all future
development within the entire project area.
Signage:
The Phase One plans indicate a "development" sign at the intersection of Freeport Avenue and
the access from Highway 169. This monumental pylon sign is designed to be complementthe
general architectural character of the project. It contains only the name of the development and
specific identification for each of the major anchor tenants. The sign is constructed of decorative
"rockfaced" concrete masonry and face brick. The monumental pylon is 35' high x 16'-8" wide.
The signage portion contains a 10 foot square internally illuminated "panaflex-type" "Target" sign,
an 8 foot by 1 0 foot internally illuminated "panaflex-type" "Cub Foods" sign and illuminated
illuminated, individual letter, shopping center identification. Identification of other tenants will not
be permitted.
An 8'-0" high ground monument type sign, approximately 20' long, will be located at the
intersection of Freeport Avenue and Jackson Road. The design of this monument sign shall be

consistent with the architectural character and materials of the shopping center. The actual
signage shall contain only the name of the shopping center and specific identification for each of
the major tenants.
Individual tenant signage, on the front face of the building, shall be consistent with the "project
development plans". For the Target Store, this includes a 7'.0" diameter "bulls eye" and 6'.0"
high individual, internally illuminated letters. A "Pharmacy" sign with 2'.0" (approximately)
internally illuminated letters shall be placed adjacent to the entrance.
Signage for the other anchor tenant, Cub Foods, shall be compatible with both Cub's
requirements and City approval. All signage shall be internally illuminated, individual letters.

Fascia signs for individual retail tenants shall be for store identity only. Capitol letters shall be no

closer than 3'.4" from the projected lease line. These signs shall be internally illuminated,
individual letters placed on a 4" square electrical raceway, painted to match the brick facia.
No signage shall be permitted on the sides or rear of the building, other than that required for
delivery identification or traffic control.
Individual, pylon type signs will be permitted at designated outlots. These signs shall not exceed
10'.0" in height and 1 00 square feet in area. The actual design shall be subject to the review and
approval of the City Planning Commission and Council. All other outlot signage shall conform the
City requirements, and shall be subject to the Citys review and approval as part of the individual
outlot development PUD process.
Miscellaneous:
Trash enclosures were inadvertantely omitted from the Phase One Development plans submitted
for City review. The trash enclosures shall be constructed of decorative "rockface" concrete
masonry compatible with the general architectural character of the project. These enclosures shall
be screened from the public through the use of both planting and landscaped berms. Specific
locations shall be as follows:
North end of the rear service area at Building A
South end of the rear service area at Building A
Trash Compactor shall located at the north loading dock projection of the Cub Foods
store.
South end of the rear service area at Building B
South end of the rear service area at Building C
Southwest corner of the Target Store.

RESOLUTION NO. 93 - ~
A RESOLUTION MAKING FINDINGS OF FACT REGARDING THE ELK PARK CENTER
PROPOSAL, APPROVING A CONDITIONAL USE PERMIT FOR ELK PARK CENTER,
AND SETTING FORTH THE CONDITIONS FOR ISSUANCE OF A CONDITIONAL USE
PERMIT FOR ELK PARK CENTER
WHEREAS, Elk River Associates, Ltd., together with Kraus Anderson,
Incorporated (the Developers) have applied for a
Conditional Use Permit to develop a shopping center (the
Project) on certain property located north of the School
District property between Jackson Avenue and Highway 169
(the Property); and
WHEREAS, the City Council, on September 31, 1991, and June 15,
1992, took action to rezone the Property to Planned Unit
Development and designate the Property for Highway
Business Uses on the City's Comprehensive Land Use map;
and
WHEREAS, pursuant to Sections 900.12(15) and 900.42 of the Elk
River City Code of Ordinances, a Conditional Use Permit
and preliminary plat approval must be obtained to develop
the Property as proposed by Developers; and
~~EREAS, an application for a Conditional Use Permit and
Preliminary Plat approval was submitted to the City in
July 1992; and
WHEREAS, a public hearing was held on this application before the
Elk River Planning Commission on August 25, 1992, at which
time the Planning Commission heard a presentation on the
Project, took testimony from all those present who asked
to speak on the matter, and continued action on the
application due to a lack of sufficient information; and
WHEREAS, the Developers subsequently submitted additional
information and a second public hearing was held before
the Elk River Planning Commission on June 10, 1993, at
which time the Planning Commission heard a presentation on
the Project, took testimony from all those present who
asked to speak on the matter, and the application was
continued again for lack of sufficient information; and
WHEREAS, the Developers subsequently revised the site plan for the
Project and submitted additional information in support of
the application for a Conditional Use Permit and
preliminary plat approval; and

WHEREAS, the Elk River Planning Commission held a public hearing on
the revised site plan on October 19, 1993, at which time
the Planning Commission heard a presentation on the
Project and received testimony from all those present who
asked to speak on the matter; and
WHEREAS, the Planning Commission, at its meeting on October 19,
1993, recommended approval of the Conditional Use Permit
and Preliminary Plat subject to a number of conditions;
and
WHEREAS, the City Council held a public hearing on the application
for a Conditional Use Permit and Preliminary Plat on
October 26, 1993, at which time the City Council heard a
presentation on the Project and took testimony from all
those present who asked to speak on the matter; and
WHEREAS, the City Council also received a number of written
comments on the Project both before and at the public
hearing held on October 26, 1993; and
WHEREAS, the City Council, at the close of the public hearing on
October 26, 1993, identified a number of concerns and
issues with the proposed project; and
WHEREAS, the City Council, following the public hearing and Council
discussion of the Project on October 26, 1993, adopted
motions denying the Conditional Use Permit and Preliminary
Plat for Elk Park Center; and
WHEREAS, the motions to deny were subsequently amended by separate
motions of the City Council on October 26, 1993, which
motions rescinded the denials of the Conditional Use
Permit and Preliminary Plat and directed City staff to
prepare Findings of Fact in a Resolution of Denial of the
Conditional Use Permit and Preliminary Plat, for
consideration by the City Council on November 15, 1993;
and
WHEREAS, City staff subsequently prepared a proposed "Resolution
Making Findings of Fact Regarding the Elk Park Center
Proposal and Denying a Conditional Use Permit and
Preliminary Plat Approval for Elk Park Center" for
consideration by the City Council, which resolution
identified 12 reasons for denial of the Conditional Use
Permit and Preliminary Plat; and
WHEREAS, the City Council reviewed and considered the proposed
Resolution for Denial at its regularly scheduled meeting
of November 15, 1993 and took the following actions:
o
The Council amended Section C.3. of the proposed
Resolution of Denial regarding enclosure of the
holding ponding area;

o
The Council called a special meeting of the City
Council for December 13, 1993, and continued any
action on the proposed Resolution of Denial until
that meeting;
o
The Council directed staff to advertise a public
hearing for the December 13, 1993, meeting to allow
citizens to express their opinions on any revisions
or new information to be presented on the Conditional
Use Permit and Preliminary Plat;
o
The Council directed staff to work with the
Developers to address the issues identified in the
proposed Resolution of Denial;
o
The Council directed staff to prepare a feasibility
study prior to December 13, 1993, addressing the
traffic and drainage issues related to the proposed
project; and
WHEREAS, on November 22, 1993, a Work Session on Elk Park Center
was held to identify specific traffic and drainage issues
to be addressed by the City Engineer in the Feasibility
Study; and
WHEREAS, this Work Session was attended by the CityCouncil,.City
staff, and representatives of the Developers'and.the
Citizens Who Care organization; and
WHEREAS, the Developer subsequently submitted a revised site plan
addressing the issues identified in the-Resolution of
Denial; and
WHEREAS, the City Council, on December 13, 1993, held a public
hearing on the revised site plan submitted by the
Developer, at which time:
o
City staff reviewed the revisions to the site plan;
o
the City Engineer presented his feasibility study on
the drainage and traffic issues identified by the
City Council as major concerns;
o
the Developer addressed the 12 grounds for denial set
forth in the proposed Resolution of Denial; and
WHEREAS, the public hearing on December 13, 1993, was properly
noticed as a public hearing on the Project and the City
Council received testimony from all those present who
asked to speak on the matter; and

WHEREAS, following the presentations from staff and the Developer,
and the testimony received from the public, the City
Council discussed the proposed project and the grounds for
denial set forth in the Resolution of Denial; and
WHEREAS, at the close of its discussion on December 13, 1993, the
City Council determined to take no action on the proposed
Resolution of Denial, and directed City staff to prepare a
Resolution of Approval of the Project, setting forth the
grounds for approval and all conditions of approval, for
consideration by the City Council at its regularly
scheduled meeting on December 20, 1993; and
WHEREAS, in its lengthy consideration of this project the City
Council has reviewed all of the written materials
submitted by the Developers, the staff and the public
before and during the public hearings held on this matter,
and has considered the recommendation of the Planning
Commission and the testimony received at the public
hearings on October 26, 1993, and December 13, 1993; and
WHEREAS, the Zoning Ordinance of the City of Elk River sets forth
in Section 900.42(4) seven criteria for the issuance of a
Conditional Use Permit;
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Elk River makes the following findings, and approves a
" Conditional Use Permit for Elk Park Center, subject to the
conditions set forth herein:
I. FINDINGS
A. Specific Findings on the Issues Set Forth in
Resolution of Denial
1. Drainage. The revised plan conforms to City
standards and requirements by providing that all
drainage for the Project will be accommodated on
site.
2. Traffic.
o Access from Hiqhway 169.
The Developers have fully investigated the
possibility of obtaining full access to the
Project from Highway 169. The Minnesota
Department of Transportation analysis, as
well as the City Engineer's analysis, is
that full access from Highway 169 is not
necessary at this time. The existing
intersections on Highway 169 will handle
the traffic anticipated from this project.

5. Will not be detrimental to other persons or
property.
This Project has been carefully designed,
and the impacts of traffic on surrounding
streets carefully studied, to ensure that
the Project will not detrimentally impact
other persons or property.
6. Will not result in the destruction, loss or
damage of any natural, scenic or historic
feature of major importance.
The Environmental Assessment Worksheet
(RAW) for this Project, which has been
approved by the City Council, did not
identify any scenic or historic feature of
major importance on the site of the
proposed project.
7.
Will fully comply with all other requirements of
the City's Code of Ordinances.
Following approval of a Conditional Use
Permit for this Project, the Developer will
be required to enter into a Development
Agreement and Planned Unit Development
Agreement. These agreements will ensure
that the Developer and the Project will
fully comply with all requirements of the
City's Code.

C. General Findings.
In addition to the specific findings set forth above,
the City Council further finds that the Project meets
the standards for issuance of a Conditional Use
Permit for all of the reasons stated by the City
Council, the Planning Commission and the public
during the October 19, October 26, and December 13,
1993, public hearings on the Project, including, but
not limited to:
o
The plan revisions presented on December 13,
1993, have significantly reduced the off-site
impacts of the Project and made the Project
considerably better than when it was presented
to the City Council in October.
o
The revised plans and new information submitted
on December 13, 1993, have addressed all of the
major issues with this Project.

Decision.
It is the determination of the City Council of the
City of Elk River, for the reasons set forth above,
that the Developer has met the requirements for the
issuance of a Conditional Use Permit. Therefore, the
City Council hereby approves a Conditional Use Permit
for the Project, subject to the conditions set forth
below.
The Conditional Use Permit for Elk Park Center is
contingent upon the Developer complying with the
following conditions.
A. Plat Approval
1. Approval of the Conditional Use Permit is
contingent upon the Developer submitting
and the City Council approving a revised
Preliminary Plat which conforms to the
conditions of this Conditional Use Permit
approval, including the recommendations of
the City Planner and the City Engineer as
set forth during the December 13, 1993,
public hearing.
2 .
The revised Preliminary Plat will be
considered by the City Council at a future
date, and will be approved subject to such
conditions as the Council shall deem
appropriate.
3. Final plat approval for the Project will
not be granted until the Developer has
entered into a Planned Unit Development
Agreement and Developers Agreement as
required by the conditions of this
Conditional Use Permit approval.
B. Planned Unit Development Agreement.
1. Approval of the Conditional Use Permit is
contingent upon a Planned Unit Development
Agreement (PUD Agreement) being entered
into between the Developer and the City
outlining the standards, uses, and
procedures for development within the Elk
Park Center PUD.
2. The Developer shall submit the following
materials, which the City shall use to
prepare a PUD Agreement:

o
A proposed "Development Plan" for the
Project. The Development Plan will
provide the foundation for future site
plan reviews and shall include the
following elements:
o
A Site Plan for the Project which
incorporates all of the plan
revisions submitted to the City
Council and all of the conditions
for approval imposed by the City
Council.
o
A Landscaping Plan for the entire
Project. The Landscaping Plan
should include a landscaping
theme and demonstrate landscaping
continuity for the entire
Project.
o
A Grading Plan for the entire
Project. The Grading Plan shall
include tree protection measures
to preserve as many of the
existing trees as possible,
particularly along Jackson Road,
to provide maximum screening to
the residential areas towards the
west. The grading plan shall
also provide for extensive
berming along Jackson Road and
Freeport Avenue. The Plan shall
show berms along Freeport Avenue
and appropriate berming along
Jackson Road to screen loading
facilities from the residential
areas towards the west.
o
A Setback Plan showing minimum
setbacks for each proposed
building in the Project.
A complete Sign Plan for the
entire Project outlining the
types and sizes of signs. The
Sign Plan shall also be
incorporated into the PUD
Agreement.
o
o
A written narrative of
Development Standards which shall
set forth and describe:

(1) the architectural theme for
the Project, which shall be
carried out through the
entire Project and
incorporated into the PUD
Agreement;
(2) the proposed building
materials for the Project
which shall, at a minimum,
consist of a combination of
decorative rock face block,
face brick, decorative and
glazed concrete block, and
prefinished metal materials;
(3) the proposed permitted and
conditional uses within the
Project area;
(4) the proposed operational
performance standards for
the Project, including hours
of operation, etc.; and
.
(5) such other development
standards for the Project as
the Developer shall propose.
3.
The Planned Unit Development Agreement
will be prepared by City staff, in
consultation with the Developer, based
upon the materials submitted by the
Developer, the feasibility report
prepared by the City Engineer, and the
conditions of approval of the
Conditional Use Permit as set forth in
this resolution of approval.
4. The Planned Unit Development Agreement
shall include and incorporate the
following:
o
The Project Development Plan,
including:
o
Site Plan
o
Landscaping Plan
o
Grading Plan
.

o Setback Plan
o
Sign Plan
o
The development standards for the
Project, including:
o
permitted and conditional
uses
o
permitted building materials
o
operation requirements and
restraints
o
such other development
standards as the City
Council shall require.
5. The Planned Unit Development Agreement
shall be approved by the City Council.
Amendments to the PUD Agreement,
including amendments to the plans
incorporated in the PUD Agreement,
shall also be approved by the City
Council.
C.
Developers Agreement
1. A Developers Agreement shall be
prepared and executed outlining the
terms and conditions for approval of
the Preliminary Plat for the Project,
including the on-site and off-site
infrastructure improvements that will
be required for development of the
Project.
2. Prior to execution of the Developers
Agreement, a complete feasibility
report shall be prepared by the City
Engineer specifying the necessary on-
site and off-site improvements
relating to the Project.
3.
The Developers Agreement shall provide
that the Developer will pay the costs
of all on-site public improvements
necessary for the project to proceed;
and further that the developer shall
bear its fair share of the costs of
off-site public improvements necessary
for the Project to proceed, as
determined in the feasibility study

Conditional Use Permit approval is
specifically contingent upon Developer
agreeing in the Developers Agreement
to so pay its share of on-site and
off-site public improvement costs.
4.
The Developers Agreement shall provide
that Developer will construct, or
cause to be constructed by petition,
all on-site or off-site public
improvements which the City Engineer
shall deem necessary for development
of the Project to proceed.
5.
The Developers Agreement shall also
provide for Developer's compliance
with the other requirements of the
City Code of Ordinances for
preliminary and final plat approval,
including park dedication, etc.
6. The Developers Agreement shall be
approved by the City Council prior to
approval of the final plat for the
Project. Amendments to the Developers
Agreement shall also be approved by
the City Council.
D.
Site Plan Approvals.
1. Following approval by the City Council
of the PUD Agreement and the
Developers Agreement, the City Council
will consider site plan approval for
Phase I of the Project.
2. Developer shall commence the site plan
approval process by filing an
application therefor with City staff.
This application shall include such
plans and supporting materials as City
staff shall require.
3. Site plan approval shall be required
for each phase of the Project, and for
any substantive amendment to any
previously approved phase of the
project, prior to obtaining a building
permit.
4.
Each site plan approval request shall
be reviewed by the Planning Commission
and City Council and a public hearing
held thereon before approval.

Site plan approval shall be granted to
a particular phase of the Project, or
amendment thereto, only if the City
Council finds that the proposed site
plan is consistent with the terms and
conditions of this Conditional Use
Permit, the PUD Agreement (including
all plans incorporated therein), and
the Developers Agreement.
6. The City Council may, when approving
individual site plans, impose such
conditions as it shall deem necessary
to ensure that the Project complies
with the requirements of this
Conditional Use Permit approval and
the City Code of Ordinances.
5.
E. Special Conditions.

1. The Conditional Use Permit for the
Project is contingent upon preliminary
and final plat being approved by the
City Council.
A security fence shall be provided
around all storm drainage ponds as
determined by. the City Council to
provide for public safety.
3. The appropriate permits shall be
obtained from the Minnesota Department
of Transportation authorizing the
necessary grading and improvements for
right-injright-out access off
Highway 169.

4. All storm drainage ponds shall be
designed in accordance with the Best
Management Practice guidelines. This
calls for a 4:1 side slopes above the
static water level with a bench area
of approximately 10:1 at the water
level and 3:1 beneath the standing
water level.

The Developer shall indemnify and hold
the City harmless from any claim from
the owner or operator of the Burger
King facility located at Highway 169
and School Street related to loss of
access due to a median being
constructed down the middle of School
Street.

Approval of this Conditional Use
Permit is also specifically contingent
upon developer complying with such
other conditions as the City Council
shall require for approval of the
preliminary and final plats, the PUD
Agreement, the Developers Agreement
and the site plan{s) for any phase.
7. A bike path shall be provided along
Jackson Road from School Street to
Highway 169, as approved by the City
Council.
8. The Developers Agreement shall require
Developer to pay its fair share of the
costs for a new intersection on
Highway 169, if and when MnDOT
approves such an intersection.

Dear Mr. Ach:
As requested, we have reviewed the Phase 1 site plan information provided for the Elk Park
Center project. In our review, we avoided those cross-hatched areas which are shown as
future phases. We understand these areas will go through a site plan review when they are
developed. Also, in an effort to add clarity, we have structured our comments by page
number. Some issues which appear on more than one page are only listed once.
Based on our review, we would offer the following comments:

2. Comments by Plan Sheet:
· SHEET A2.2
The 6-foot wide bituminous bike path should be changed to a 6-foot wide
concrete walk.
· SHEET C2.1
Driveway entrances to the main shopping mall (Lot 2) should be widened to
40 feet to accommodate two exiting lanes and one entering lane.
Driveway entrances along Jackson Avenue should- have larger radii to
accommodate semi-truck traffic turning movements.
The loading zone in front of the mall stores north of Cub Foods should be
eliminated. This will only add to traffic congestion and pedestrian/vehicle
conflicts. e)
The driveway in front of the main mall building has a sharp 45 degree reverse
curve at the northeast corner of the Cub Foods store. This should be
eliminated by lengthening the curve.
Loading zone areas should be designated and shown for the main mall
buildings in order to review traffic movements.
Trash container areas for each main mall building should be shown.
· SHEET C2.2
The northerly driveway entrance to "the parking area in front of the main mall
buildings south of the Cub Foods building has an outside turning radius of
35.00 feet. This is far too sharp to facilitate reasonable traffic movement.
The curb line opposite the Target store at the southwest corner has a sharp 20-
foot radius jog which serves no apparent purpose. This should be eliminated
or tapered more to eliminate any traffic or snow plowing problems.
The driveway intersection at the northeast corner of the Target building has eo,)
two sharp curves on the north-south drive. These curves should be
lengthened and the drive going west from this intersection should be radial to
the curve.

· SHEET C2.3
The most southerly driveway to the main shopping mall on the west side of
Freeport Avenue should be moved either north or south so that the centerline
of the driveway lines up with the centerline of a parking lane drive.
· SHEET C3.1
City ordinance requires individual sanitary sewer and watermain services for
each building. We would also recommend the size of the services be
increased from the typical 2-inch water service and 4-inch sewer service.
Additional drainage and utility easements may be requir~ on the final plat for
the hydrant west of the Cub Foods store.

SHEET C3.2
.
The distance between manholes 17 and 19 exceeds the recommended
maximum 400-foot distance.
Additional utility and drainage easements will be required on the plat for the
long hydrant leads on the west and south sides of the main mall buildings.
Domestic water service can be tapped off of the fire sprinkler line if so
desired at the Target store.
The proposed watermain on the west side of the main mall buildings shows
two 90 degree bends within the existing Northern Natural Gas and UP A
utility easements. The proposed watermain should be extended from the
south in a straight line across the existing easement, then 45 degrees to the
west.
· SHEET C3.3
Additional utility and drainage easements will be required for the hydrants
with long leads north and west of the future builds along the south property
line.

The developer must obtain an agreement or easement for the City over the
existing Northern Natural Gas and UP A utility easements for the proposed
Freeport Avenue and any proposed City utility and drainage easements.

The proposed storm sewer line and easement across the school property from
the pond at the southwest corner of the plat to Freeport Avenue must be
shown.
The watermain along Freeport Avenue will be an 8-inch line from the south
plat line to School Street, rather than the 16-inch line shown..
· SHEET C4.1
A landing area should be provided where Freeport Avenue intersects Jackson
Avenue.
The driveway on the south side of Freeport Avenue at station 33+50 needs
the grades to be adjusted to allow for a flatter landing area.
The driveway on the west side of Freeport Avenue at station 27+75 needs a
high point at the right-of-way line to keep the Freeport Avenue drainage in
the street.

Catch basin' #17 rim elevation is shown as 935.08; this should be 936.08.
Drainage over bituminous surfaces should have a minimum of 1 % with a
recommended grade of 1.5 % to 2 %. Several areas are at or below the
recommended 1 % minimum grade. Some areas of concern are as follows:
Drainage going east from in front of the Cub Foods store and the
buildings to the north.
Drainage from islands east of catch basins #39 through 42 to the catch
basins.
Area in loading ramp on north side of Cub Food store to catch basin
#72.
Catch basin #71 is at high point, rim elevation should be checked.
· SHEET C4.2
Why is manhole 64A necessary? Could manhole #64 connect directly to
manhole #63?

The drive along the north side of the Target store has no positive drainage.
If a catch basin was to plug, the water must pond 0.45 feet before it will
overflow the high points into the next catch basin. If this was to occur in
winter, it would ice an area in the drive approximately 65 feet long. The
grades in this area should be reviewed to provide positive drainage to the
pond.
The grades at the top of the loading ramp located at the southwest corner of
the Target store drops 2.88 feet from east to west, which will allow for a part
of the parking and drive area to drain down the ramp to catch basin #83. The
grade at the southwest corner of the ramp should be raised to minimize the
drainage on the ramp area.
Catch basins #79 and #80 could be raised to lessen the drive grade to Jackson
Avenue.
Grades need to be adjusted at Jackson Avenue and the driveway entrance
opposite the Target store to allow for a flatter landing area.
A flared end section needs to be extended from catch basin manhole #78 to
the west to drain the low area on the adjacent property.
The developer must obtain a grading easement from the adjacent property (the
exception) along Jackson Avenue to match their grades along the south line
of the adjacent property.
There are missing proposed contour lines south of catch basin manhole #76
and manhole #77.
Grades along the curb line east of manhole #77 and south of the Cub Foods
store will create a flat area of 932.77 as shown.
In areas where drainage is to be carried along the curb lines and sheeted
across bituminous areas, drainage arrows should be shown. Example: the
parking lot on the east side of the buildings between the Target store and Cub
Foods store indicate the drainage going south along the curb lines, but is the
drainage also intended to sheet across the parking area to catch basin manhole
#67?
The retaining wall along the south property line is shown to be 16 feet high.
The wall should be terraced in four to five foot high increments, as discussed
by the developers at the public hearing.

The flared ends outletting into the pond at the southwest corner of the plat
should be adjusted to outlet at the water level to eliminate any potential
erosion problem.
A fencing layout and detail, as requested by City Council action, needs to be
shown on the plans for the proposed pond at the southwest corner of the plat.
· SHEET C4.3
The rim elevations on catch basin manholes #46 and #60 should be raised.
There is a missing 930 contour around catch basin manhole #27 in the
southeast corner of Freeport A venue and the entrance road off North
Highway 169.
3. Storm Sewer:
The drainage calculations submitted appear to be adequate. However, a fmal review e... .."'.)
of the plan and profile construction documents needs to be made to verify the overall
adequacy of the system.
A Corps of Engineers permit may be needed for work around the pond on the School
District property. This should be submitted for a response from the Corps of
Engineers.
An MPCA permit will be required prior to beginning site grading.
Consideration should be given to redirecting the storm sewer in front of the Target
site southwesterly to the pond rather than northerly.
An easement needs to be provided on the final plat to cover the storm sewer line from
Freeport Avenue to the pond.

Dear Mr. Carlson:
The submitted plans for Elk Park Center, Phase I, have been reviewed by
City staff. The following are a list of comments that should be incorporated
into the plans or given consideration in preparation of the final set of plans
that will be submitted for final review and issuance of a building permit.
Also included is a letter from Terry Maurer highlighting various issues that
will need to be considered and, once again, incorporated into the plans.
GENERAL COMMENTS
1. Review of future phases is not being done at this time. Therefore,
future site designs and building locations are subject to further staff
review at a later date.
2. All parking areas are to be bounded by B612 concrete curb and gutter.
A detail should be provided on one of the plan sheets.
3. Identify all shopping cart "corrals" within the parking area.
4. In the event there will be any outdoor storage or shopping carts stored
next to the building (i.e., Target and Cub Foods), this type of storage
should be screened and incorporated into the building.
5.
It appears as though the traffic control/landscaped islands throughout
the parking lot are forty (40) feet in length. To improve turning
movements throughout the parking lot it is recommended these islands
be shortened to thirty-four (34) feet and have appropriate radius.

All disturbed areas beyond the limits of Phase I will need to sodded to
prevent erosion. This detail will have to be included on the final set of
plans.
7. There appears to some inconsistencies from one plan to another. This
should be corrected and made part of the final set of plans for approval.
8. Throughout the site, and primarily along Jackson Road and the north
end of the project, large masses of existing trees are present. These
areas should be protected with proper fencing during the preliminary
grading process. Thereafter, either custom grading around these trees
or the construction retaining walls will need to occur to preserve these
existing vegetated areas. A tree preservation plan shall be submitted
for approval prior to commencing grading.
The following comments are arranged according to each plan sheet:
SHEET A2.1
1.
The drop off lane in front of those retail spaces north of Cub Foods
should be eliminated to minimize the amount of conflicts with vehicle
turning movement along this major driveway isle.
2. The main driveway that parallels the front of the shopping center has
a few sharp curves in it that should be flattened out to improve the
flow of traffic along this driveway.
SHEET A2.2
1. On the east side of Freeport Avenue the plans indicate a six (6) foot
wide bituminous bike path. Staff would recommend that this be
changed to a six (6) foot wide concrete sidewalk to compliment the
identical system on the west side of Freeport Avenue.
. 2. The southern most access off of Freeport Avenue to the main shopping
center presents some traffic circulation concerns. This particular
entrance should be redesigned to allow more stacking distance for cars
exiting the site and, at the same time, facilitate movements coming
into the shopping center area.

SHEET A2.3
1. Consideration will need to be given to redesigning the area where the
drive isles intersect; at the northeast corner of the Target store, to
improve vehicular movements in this area.
2. The service drive behind the retail stores north of the Target store will
need to maintain a twenty-four (24) foot wide driveway. There appears
to be a narrow section of driveway, north of the retail spaces, listed as
Building B.
3. Entrances to the parking lot in front of Building B need to be
improved to allow better vehicular circulation.
4. The retaining wall along the west side of Target's loading dock should
be a minimum height of three (3) feet.
SHEET A3.1
1.
The building materials, as presented on these elevations, provide an
aesthetically pleasing architectural element. Therefore, these
materials will be accepted by staff and will be presented to the
Planning Commission and City Council for their concurrence.

2. Building elevations of the north, west, or south sides of the building
have not been submitted with this application. Staff is recommending
all elevations maintain the same architectural and material
composition as that found along the front of the building facing
Freeport Avenue. As part of the final plan submittal for building
permit application, all elevations should be included with the
materials specified.
3. All signage comments will be addressed in a separate section at the
end of this memo.
SHEET L2.1
1. All the trees proposed along Freeport Avenue and Jackson Road should
be moved out of the right of way placed within the limits of this
project.

3. The overstory trees proposed along Jackson Road and Freeport Avenue
consist of one species. Consideration should be given to including
another species for diversity protecting against possible disease.
4. The area east of Jackson Road and south of Freeport Avenue is one
example where there are existing trees that should be incorporated
into the plan. This should be reflected as existing trees along with
retaining walls to protect those areas.
5. Additional conifers should be provided along Jackson Road
immediately west of Cub Foods to screen the proposed loading area. In
addition, berming should also be included to provide additional
screenIng measures.
SHEET L2.2
.
1. The landscaping theme that is proposed at other entrance points into
the shopping center should also be included at the entrance drive off of
Jackson Road, behind the Target store.
2.
Additional pine trees should be included along the west side of the
Target store to provide screening of the proposed service area.
Consideration should be given to oversizing these pine trees since they
will be planted on the slope of the ponding area and will need to
increased in size to provide immediate screening measures.
3. At the northeast corner of the Target store, there is a large sidewalk
area that could include a planter similar to those proposed in front of
Cub Foods. Consideration should be given to including a planter with
landscaping that will break up this large sidewalk area.
4. The landscape plan will need to be revised at the south end of the site
to coincide with the proposed retaining wall.
SHEET L2.3
1. There appears the opportunity to provide a few more conifers along
Freeport Avenue to provide some landscaping interest throughout the
year.

2.
Staff is assuming shrubs proposed for all landscaped islands are hardy
enough to withstand snow pack during the winter and be salt tolerant.

If there is any question whether these shrubs can tolerate these
conditions, it is recommended that the species be changed to a hardier
variety to withstand these conditions.
3.
Consideration should be given to exchanging some deciduous shrubs
for more coniferous shrubs.
4.
Some overstory trees should be included along 192nd Avenue between
Highway 169 and Freeport Avenue.
5.
The grading plan does not show berms along Freeport Avenue, these
will have to be included and landscaped appropriately.
SIGNS
1. The proposed development sign illustrated on Sheet A3.1, meets the
sign standards as previously discussed. This sign detail will be
incorporated into the Planned Unit Development Agreement and will
be presented to the City Council for approval.
2.
All signage shown on the building elevations will be accepted as
presented. Specific sign criteria will be outlined in the Planned Unit
Development Agreement and presented to the City Council for
approval.
3. There is a development sign proposed for the northeast corner of
Freeport Avenue and Jackson Road. This sign was approved as part of
the PUD as being a monument style, not exceeding eight (8) feet in
height and sixty-four (64) square feet in area. Any deviation to this
will require City Council approval.
4. All signage requirements will be outlined in the Planned Unit
Development Agreement for future outlot sights.
TRASH ENCLOSURES
.
1.
All trash enclosures shall be strategically located throughout the
service area behind the main shopping center. These enclosures shall
be constructed with material that compliment the building and be
oriented to provide maximum amount of screening from public view. A
specific detail of these enclosures shall be provided for staff review.
