April 18, 1994 File: 230-216-20 Honorable Mayor and City Council City of Elk River 13065 Orono Parkway Elk River, MN 55330 RE: ELK PARK CENTER INTERNAL AND EXTERNAL STREET IMPROVEMENTS Dear Council Members: As directed by City Council on February 7, 1994, we have prepared plans and specifications for the Elk Park Center Internal and External Street Improvements. These improvements include Freeport Street from School Street to Jackson Avenue, the widening of School Street from Trunk Highway 169 to Jackson Avenue, and the widening of Jackson Avenue from School Street to Trunk Highway 169. Also included are the signalization of the intersections of School/Jackson and School/Freeport. In addition, there are improvements to Trunk Highway 169 by the addition of the northbound left turn lane at School Street and the right- in/right-out and short extension of 191st between Trunk Highway 169 and Freeport Avenue. According to the project schedule laid out in the February 1994 feasibility study, these plans and specifications are being brought forward the same time as the final plat and developer's agreement. The schedule indicates that bids would be received in mid-May, contract awarded, with construction to begin immediately after the close of the 1993/1994 school year. Attached is a draft resolution which approves the plans and specifications and authorizes the advertisement for bids. We would recommend City Council adoption of this resolution. If you have any questions regarding this, I will be in attendance at your April 21st special meeting. Sincerely, MSA, CONSULTING ENGINEERS L.~ T~rer, p~ TJM:tp Attachment 216-1703.ape e e e RESOLUTION 94 - A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS AND ORDERING THE ADVERTISEMENT FOR BIDS IN THE MATTER OF THE ELK PARK CENTER INTERNAL AND EXTERNAL DRAINAGE AND STREET IMPROVEMENT OF 1994 WHEREAS pursuant to Resolution 94-10, the Project Engineer has prepared plans and specifications for the Elk Park Center Internal and External Drainage and Street Improvement, which plans and specifications have been reviewed by the City; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. Such plans and specifications, a copy of which is attached hereto and incorporated herein by this reference, are hereby approved. 2. The City Administrator shall prepare and obtain the publication of an advertisement for bids for the making of the improvement pursuant to the attached plans and specifications. The advertisement shall be published once each week for three consecutive weeks, shall specify the work to be done, and shall state that the bids will be received by the City Administrator until 10:00 a.m. on Wednesday, May 18, 1994, at which time the bids will be publicly opened in the Council chambers of the City Hall by the City Administrator and the Project Engineer and will then be tabulated for consideration by the City Council at a meeting thereof at 6:00 o'clock a..m. on Monday, May 23, 1994, in the City Council chambers at City Hall. No bids will be considered unless sealed and med with the City Administrator and accompanied by a cash deposit, cashier's check, bid bond, or certified check payable to the City Administrator in the amount of 5 % of the amount of such bid. Following the completion of that plan, they are in the process of revising their assessment! funding procedure for storm drainage improvements. The City Council, based on staff recommendations, is considering a combination stormwater impact fee and surface water management fee. The stormwater impact fee would be charged to all developing properties at rates estimated to be initially $600 per acre for all non-residential property, $100 per lot for urban residential developments, and $50 per lot for rural residential developments. The surface water management fee would be a user fee for storm drainage, likely billed monthly with the rate based on the type of zoning or development. By instituting these two fees, the City would eliminate any trunk storm drainage assessments. In other words, new developments would pay for any internal storm drainage improvements plus the impact fee, but would not be assessed for improvements outside of the immediate development. Prior to recommending adoption of this policy to the City Council, staff would like to give current Elk River developers a chance to comment. We expect to make a formal recommendation to the City Council by mid to late May. If you have any questions or comments regarding this proposed policy change, please either send them to me in writing or call me at 644-4389. If you think it would be useful to have a developer/City staff meeting regarding this issue, that could also be arranged for some time in early May.
