CU 94-12 ISSUE Request for a conditional use permit to operate an outdoor farmers market in the Jackson Square parking lot. LOCATION Jackson Square parking lot at the intersection of Jackson and Main Street. tt ATTACHMENTS Report to Planning Commission dated April 26, 1994 OVERVIEW The Sherburne County Growers Association received a conditional use permit on February 24, 1993, to operate a farmers market in the parking lot between King Avenue and Jackson Avenue, lying south of Highway 10. Although this location was used by the Growers Association last year, the group is considering moving to Jackson Square parking lot to gain additional exposure and hopefully attract customers downtown. The farmers market would be in operation Wednesdays from 1 p.m. to 7 p.m., and Sundays 12 noon to 5 p.m., May through October. Approximately 8-10 vendors will be offering home grown produce for sale and would occupy those parking stalls on either side of the landscaped island in the middle of the parking lot. The attached site plan clearly illustrates the area intended to be used by the farmers market. tt P.O. Therefore, staff has monitored the parking demands in the downtown area over the past few weeks. The results of this "quick and dirty" survey indicates that roughly 38% to 53% of the parking stalls are vacant at the times the survey was conducted. Based on this survey, there appears to be available parking stalls in the downtown area, even with the operation of the farmers market. Please refer to the attached Planning Commission report for additional information. PLANNING COMMISSION RECOMMENDATION The Planning Commission recommended approval of the request by Sherburne County Growers Association to operate an outdoor farmers market with the conditions as stated in the staff report dated April 26, 1994, with the following modifications: The language in conditions number 1 and number 2 be modified to read: e 1. A CERTIFICATE OF INSURANCE NAMING THE CITY AS AN ADDITIONAL INSURED FOR THE LOT BE SUBMITTED TO THE CITY. 2. AMENDING 1 P.M. TO READ 12 NOON STAFF RECOMMENDATION Staff concurs with the Planning Commission's recommendation to approve a conditional use permit by Sherburne County Growers Association to operate an outdoor farmers market in the Jackson Square parking lot with the following conditions: 1. A CERTIFICATE OF INSURANCE NAMING THE CITY AS AN ADDITIONAL INSURED FOR THE LOT BE SUBMITTED TO THE CITY. 2. DAYS AND HOURS OF OPERATION BE LIMITED TO WEDNESDAY AND SUNDAY FROM 12 NOON TO 7 P.M. ALL REFUSE DISPOSAL SHALL BE THE RESPONSIBILITY OF THE FARMER'S MARKET AND THE LOT BE CLEANED AFTER EACH EVENT. 7. A YEARLY REVIEW BE CONDUCTED BY THE CITY COUNCIL TO ADDRESS ANY CONCERNS THAT MAY ARISE THROUGHOUT THE SEASON. 8. BACKGROUND The Sherburne County Growers Association received a conditional use permit on February 24, 1993, to operate a Farmer's Market in the parking lot between King and Jackson Avenues, lying south of Highway 10. ANALYSIS . The Grower's Association, in conjunction with the support of the Downtown Development Corporation (see attached petition), is requesting a conditional use permit to operate an outdoor Farmer's Market in the Jackson Square parking lot. The Farmer's Market would be in operation Wednesday's from 1 p.m. to 7 p.m. and Sunday's 12:00 noon to 5 p.m., from May through October. The attached site plan illustrates the proposed location. e 8 - 10 vendors will occupy all the parking stalls on either side of the landscaped island within the Jackson Square lot. In total, the Jackson Square lot has 40 parking stalls, therefore, the Farmer's Market will occupy approximately 50% of those parking stalls. The Farmer's Market is hoping to bring additional customers downtown to help support the existing downtown merchants. This type of activity has the potential to create an attractive focal point in the courtyard area of downtown. However, the down side of using the Jackson Square parking lot is occupying the parking stalls intended for customers shopping downtown. Staff has done a survey of the parking usage in the downtown area over the past two weeks. This survey has been conducted a few times per week to obtain a better understanding of the parking demands in the downtown area. Another point to consider in terms of the parking demands downtown is the vacancy of a couple buildings. Depending upon future tenants parking demands may increase and necessitate using all the stalls in Jackson Square Lot. ) SUMMARY OF PARKING SURVEY e The survey has identified the number of vacant parking stalls occurring at selected times during the week in five locations in the downtown area. These locations are as follows and are illustrated on the attached map: Site A - Jackson Square Site B - Public Lot (King & Hwy 10) Site C - On Street Parking (north side of Main Street between King and the Bank of Elk River) Site D - On Street Parking (south side of Main Street between King and Nadeau's) Site E - On Street Parking (Jackson Avenue between Hwy 10 and Snyder Drug) 40 parking stalls 87 parking stalls 24 parking stalls 40 parking stalls 15 parking stalls' ) This survey indicates that all five locations have some stalls available at all times. The Jackson Square lot has a vacancy rate that fluctuates between 38% to 53%. Based on this survey, there appears to be adequate parking if the Grower's Association utilizes a portion of Jackson Square. However, depending upon the tenants that come and go in the downtown area, parking demands may increase upon which parking may present a problem. RECOMMENDATION It is recommended the Planning Commission recommend approval of the conditional use permit by Sherburne County Grower's Association to operate an outdoor Farmer's Market in the Jackson Square parking lot with the following conditions: 1. A BOND BE POSTED WITH THE CITY TO PROTECT THE CITY FROM LIABILITY FOR USE OF THE LOT. 2. DAYS AND HOURS OF OPERATION BE LIMITED TO WEDNESDAY AND SUNDAY FROM 1 P.M. TO 7 P.M. EACH DAY. 3.
