ACH, CITY PLANNER~~ MAY 2, 1994 TO: DATE: SUBJECT: REQUEST BY SHERBURNE COUNTY GROWERS ASSOCIATION TO OPERATE A FARMERS MARKET AT ELK RIVER MALL ISSUE To consider a request by Sherburne County Growers Association to operate an outdoor farmers market within the Elk River Mall parking lot. ANALYSIS Growers Association would like to operate an outdoor farmers market at Elk River Mall. As illustrated on the attached site plan, vendors would utilize parking spaces adjacent to the landscaped island which extends towards Freeport Avenue. The market is proposed to be open on Friday's from 2:00 p.m. to 6:00 p.m. from the months of May through October, (weather permitting). The primary purpose of the market is to sell homegrown goods, including crafts, if they are made from homegrown products. The one concern that staff would have is to make sure that everything sold is in fact a homegrown product. Therefore, ideally this farmers market should be limited to items that are commonly associated with a farmers market (i.e. vegetables and other homegrown produce). e P.O. Staff would recommend that this signage be limited to one sign and that the sign be displayed only on those days the market is in operation. This sign can be placed along either Highway 169 or Freeport Avenue at the choice of the farmers market. TEMPORARY GREENHOUSE It should be pointed out that the farmers market will not be the only activity within the malls parking lot. Plant Place, Inc.lNelson Nursery, Zimmerman, received approval from the City Council to operate a temporary greenhouse within this same parking lot. The attached site plan illustrates the exact location of the proposed greenhouses which will be erected in late April or early May, and be in place through July 1st. PARKING e Certainly one of the issues with the request to utilize a parking lot for outdoor sales is to make sure necessary parking stalls are not occupied. The parking stalls proposed to be used are in a location that are not part of a major drive isle or an area that would disrupt traffic. In addition, although some of the parking stalls are in close proximity to the mall's shopping area, the actual proximity to an entrance is less convenient. Therefore, the selected location should function adequately without disrupting the traffic circulation within the parking lot, nor utilizing primary parking stalls for the mall. PERMIT FOR VENDOR SALES Elk River Mall is a Planned Unit Development. Typically, a conditional use permit is needed for most activities in this development. However, Sherburne County Growers Association has applied for the same permit that has been granted to Plants Place Inc. In the future, it is recommended that requests for greenhouses, farmers markets, or other temporary uses be reviewed as conditional use permits. e ccgrower-council Farmers Market Request Page 3 e RECOMMENDATION It is recommended that City Council approve Sherburne County Growers Association's request to operate an outdoor farmers market within the Elk River Mall parking lot with the following conditions: 1. SIGNAGE BE LIMITED TO ONE 4 X 8 SIGN TO BE PLACED EITHER ALONG HIGHWAY 169 OR FREEPORT AVENUE, AND THE SIGN BE DISPLAYED ONLY ON THOSE DAYS THE MARKET IS IN OPERATION. 2. FARMERS MARKET BE ALLOWED TO OPERATE EVERY FRIDAY FROM 2:00 PM TO 6:00 PM, FROM MAY THROUGH OCTOBER PER THE LETTER DATED APRIL 6, 1994, FROM KIM PASTURE OF THE ELK RIVER MALL. 3. FARMERS MARKET BE LIMITED TO THOSE PARKING STALLS IMMEDIATELY ADJACENT TO THE LANDSCAPE ISLAND AS ILLUSTRATED ON THE SUBMITTED SITE PLAN. e 4. IN THE EVENT PARKING PROBLEMS ARISE DUE TO THE FARMERS MARKET, THE CITY COUNCIL HAS THE OPPORTUNITY TO REVIEW THIS REQUEST FOR NECESSARY MODIFICATIONS AND POSSIBLY HAVING TO TERMINATE THE OPERATION. 5. A YEARLY REVIEW BE CONDUCTED BY THE CITY COUNCIL TO ADDRESS ANY CONCERNS THAT MAY ARISE THROUGHOUT THE SEASON. 6. ALL REFUSE DISPOSALS SHOULD BE THE RESPONSIBILITY OF THE FARMERS MARKET AND/OR THE ELK RIVER MALL, AND THE AREA BE CLEANED AFTER EACH EVENT. e ccgrower-council - e e APR7 1994 April .6, 1994 Kennedy Gardens 10205 201st Ave. NW Elk River, MN 55330 Dear Bill, Per your request I am writing you a.letterto outline our agreement to have a Farmer's Market at the Elk River Mall this year. It is my understanding that the Market will operate from May through October, weather permitting. The Market will be open every Friday from 2pm to 6pm (again weather and daylight permitting). The location of the Market will be on the west side of the mall with the vehicles parking along the median where the marque sign is featured and if need~d, have a second row parked within the parking spaces facing the already parked vehicles. The productstha't will be sold are to be home grown and if crafts are sold they are to be from home grown goods. We will be providing two 4'x8'road signs that will be positioned along Hwy. 169 to help with advertising. We will also try to promote the Farmer's Market with special days at the mall depending on the various products you will be selling. It is my understanding that you will be providing the man power to put the signs out each week. If you have any questions regarding any of the abovementioned items please call me at 478-6647.
