Concord Street is a private road south of County Road 33 and west of Greenhead Acres First Addition. Earlier this year the abutting property owners to Concord Street requested information on the cost of upgrading their street city standards with the idea that the City would take over ownership and maintenance after that point. In February an informational meeting was held with the property owners and four options were discussed. Based on this information, the property owners submitted a petition to the City requesting a bituminous upgrading of their road with the City taking over maintenance after completion. The attached feasibility study discusses this proposed improvement. In order to proceed with this project the City Council would need to consider the attached resolution which accepts the feasibility study and orders the public hearing. We have tentatively scheduled the public hearing for the June 6, 1994 City Council meeting. Since this project requires each of the property owners to dedicate right-of-way to the City before proceeding, it may be appropriate to require all of the affected property owners to sign a letter of understanding indicating that they will sign the appropriate easement documents dedicating the right-of-way to the City at no cost once the project proceeds. The City may want to consider sending such a letter with an explanation, along with the public hearing notice. If you have any questions, regarding this information, please call. E. 212-2703.apr e e e RESOLUTION 94 - A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION RECEIVING THE FEASIBILITY REPORT AND ORDERING A PUBLIC HEARING ON THE IMPROVEMENT IN THE MATTER OF THE CONCORD STREET IMPROVEMENT OF 1994 WHEREAS the Feasibility Report ordered by the Council in Resolution 94-25 has been prepared with reference to the Concord Street improvement and was received by the City on May 2, 1994; and WHEREAS the Feasibility Report recommends that the proposed improvement is feasible; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The City Council will consider the Concord Street improvement as described in the Feasibility Report and the assessment of the property abutting this proposed improvement for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Section 429 at an estimated total cost for the improvement of $116,600. 2. A public hearing shall be held before the City Council on the proposed improvement on the 6th day of June, 1994, at 7:00 o'clock p.m. at Elk River City Hall. 3. The City Administrator shall provide two published notices (one week apart) in the official newspaper with at least three days between the last publication date and the hearing, and mailed notice ten days prior to the hearing as required by law. No. 15315 PreparrA by: Ill' Ii FEAS-230.212 e e e INTRODUCTION This feasibility study was initiated by a petition from the property owners on Concord Street, and was authorized by Resolution 94-25, which was adopted by the Elk River City Council on March 21, 1994. The petition calls for public street and drainage improvements on Concord Street. This area is currently a private road located south of County Road 33 and west of Greenhead Acres 2nd Addition as shown on Exhibit 1. The property owners are asking that the city assume ownership of the street, improve the existing street to city standards, and assess the property owners the costs of the improvements The purpose of this study is to analyze the existing conditions, the feasibility of a new bituminous road along Concord street, and estimated project costs. PROJECT HISTORY The residents from Concord Street contacted the city regarding upgrading and public take over of their street. A study of the street was undertaken followed by an informational meeting in February with residents to discuss four options for public take over. The four options were: Option 1: A 26-foot wide bituminous roadway with 3-foot aggregate shoulders. Option 2: A 32-foot wide gravel base roadway. Option 3: A 22-foot wide bituminous roadway with 2-foot aggregate shoulders. Option 3: A 26-foot wide gravel base roadway. After the informational hearing, the property owners presented a petition to the City, containing nine signatures of effected property owners. The petition requests improvement of Concord Street using the design outlined in option 3, which is a bituminous roadway 22 feet wide with 2- foot gravel shoulders. The petition also requests a 15 year assesment at the current interest rate, at which the owners beleive to be 6 %. The petition contains nine signatures of effected property owners, there are an additional three property owners who would be assessed for improvements, who are not included on the petition. According to written comments attached to the petition, these unsigned property owners are in the process of selling their property and do not feel that they would benefit from the proposed improvements. FEAS-230.212 -1- EXISTING CONDITIONS e Currently Concord street is a private, narrow gravel road approximately 3100 feet in length. The existing road is filled with ruts, holes and a uneven driving surface. In the past the road has required much maintenance with little improvement to the overall condition of the road. PROPOSED IMPROVEMENTS The proposed improvements consist of constructing a new bituminous surfaced road 22 feet wide with 2 foot aggregate shoulders as shown in Exhibit #2. Constructing this new road will involve excavating the existing road, placing a 5 inch aggregate base under a 2.5 inch bituminous driving surface with 16 foot driveway aprons to each property. The improvements will also include new driveway culverts, ditch cleaning work to improve drainage, and the construction of a cul-de-sac at the end of the street. The city of Elk River would assume the existing 66 foot roadway easement and maintenance of the new road. EASEMENT AQUISITION e Before Concord Street can become a public street, the city will have to assume a 66-foot easment along the property. Research of the Sherburne County records indictes there currently exists a 66 foot easement which allows each property owner to use their neighbor's portion of the existing roadway. This easment is described on each of the property owner's titles. If Concord Street is to become a public street, each property owner must be willing to dedicate their portion of this 66 foot easement to the city at no charge. COST The following table outlines the cost of the proposed improvements. The city's assessment manual has established the estimated overhead to be 28 % of the total construction costs. This covers items such as fiscal, engineering, legal, and city administration costs. e FEAS-230.212 -2- e e e Table 1. There are 12 properties along Concord Street that would benefit from the proposed improvements. Each of these properties would be assessed $ 9,725. The estimated cost of this project is $116,600.00, fmanced by assessment to each of the benefitting properties in the amount of $9,725.
