Dear Mr. Klaers:
As directed by the City Council, we have prepared the attached feasibility study for the
bituminous overIayment of the existing streets in the Peterson Addition and the Greenhead
Acres 2nd Addition. As you are aware, this was a project initiated by the City Council based
upon the recommendation of Phil Hals, the City Street Superintendent. The proposed
improvement consists of providing a bituminous overIayment of the existing streets within
.these two developments. According to the City's assessment policy, the entire cost is
proposed to be assessed against the benefitting properties on a per lot basis. The estimated
assessment rate is $1,557 per lot.
In order to proceed with this project, the City Council would need to consider the attached
resolution which accepts the feasibility study and orders the public hearing. Since this
project was initiated by the City Cou.ncil an~ not by petition of the affected property owners,
the attached resolution requires a 4/5 vote for the project to proceed. We have tentatively
scheduled the public hearing for the June 6, 1994, City Council meeting.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION RECEIVING THE FEASIBILITY REPORT
AND ORDERING A PUBLIC HEARING ON THE
IMPROVEMENT IN THE MA TIER OF THE BITUMINOUS OVERLAY
IMPROVEMENT OF 1994
WHEREAS the Feasibility Report ordered by the Council in Resolution 94-17 has been
prepared with reference to the Bituminous Overlay Improvement of 1994 and was
received by the City on May 2, 1994; and
WHEREAS the Feasibility Report recommends that the proposed improvement is feasible;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1.
The City Council will consider the Bituminous Overlay improvement as described in the
Feasibility Report and the assessment of the property abutting this proposed improvement
for all or a portion of the cost of the improvement pursuant to Minnesota Statutes, Section
429 at an estimated total cost for the improvement of $85,700.
2. A public hearing shall be held before the City Council on the proposed improvement on
the 6th day of June, 1994, at 7:00 o'clock p.m. at Elk River City Hall.
3. The City Administrator shall provide two published notices (one week apart) in the official
newspaper with at least three days between the last publication date and the hearing, and
mailed notice ten days prior to the hearing as required by law.

INTRODUCTION
On February 28th, 1994, the Elk River City Council, adopted Resolution 94-17 authorizing a
feasibility study to analyze proposed bituminous overlayment of selected city streets. The streets
included in this recommendation are found in the Peterson Addition and the Greenhead Acres 2nd
Addition. The streets recommended for improvements within the Peterson Addition are: Ogden
Street, 196th Avenue, and Queen Street shown in Exhibit 1. Proposed street improvements within
the Greenhead Acres 2nd Addition are: York Street, 208th Avenue, and Watson Street shown in
Exhibit 2.
These street improvements were initiated based on a recommendation from Phil Hals, Street
Supervisor, in which he noted "significant signs of deterioration" as the reason for the improvements.
It is the City's opinion that it is not economically feasible to continue patching these streets and that
a bituminous overlay would be more economical than total reconstruction.

EXISTING CONDmONS
The streets involved with this feasibility study are between 14 and 16 years old. They show
significant signs of wear, such as cracks and pot holes, and required significant amount of repairs
in recent years.
PROPOSED IMPROVEMENTS
The proposed improvements consist of a two inch bituminous overlay on the existing streets shown
in Exhibit 1 and 2. It is recommended that a 2-inch bituminous overlay be placed to add structural
strength, provide a smooth driving surface, and prolong the life of the existing streets. If these
improvements are not implemented soon, the City's only alternative will be total reconstruction.
COST
The following table outlines the cost of the proposed improvements. The city's Assessment Manual
has established the estimated overhead to 28% of the total construction costs. Because there is a
e limited amount of preliminary and administrative work associated with an overlay project, the
estimated overhead cost has been reduced to 10 % of the construction costs.

FINANCING
In accordance with the Elk River city's Assessment Manual, the cost of a bituminous overlay will
be assessed on a lot unit basis, to the benefiting properties. Therefore, the costs of the
improvements would be divided equally among all of the adjoining properties. In the Peterson
Addition, there are 29 properties that would benefit from the proposed improvements. These
properties would each be assessed $1,570.00 per unit. In the Greenhead Acres 2nd Addition, 26
parcels would be assessed $1,543.00 per unit. Since there is only a 1.7 percent difference in the
costs of the two projects, it may be beneficial to combine the costs and assess each property owner
$1,557.00. It is difficult to predict with exact accuracy the amount of material each street will
require, and since this overlay project involves two different areas in the city, it may impossible
to separate the cost of each street's improvements, depending on the Contractor's method.

CONCLUSION
The proposed overlay project would increase the strength and life of the existing streets in the
Peterson and Greenhead Acres 2nd Additions. The estimated cost of the project is $85,629.00,
with each benefitting parcel being assessed $1,577.00. This project is feasible from ari
engineering standpoint and will benefit the properties proposed to fund them.
