SUBJECT: COUNTY ROAD 12/13 DRAINAGE
Work is continuing on the County Road 12/13 drainage improvement project.
Attached for your review is some background material from our City
engineering firm regarding this project. Consistent with City Council
discussions, this project has been incorporated into the spring, 1994 bond
issue. The estimated cost for this project is in the $400,000 range.

This project is somewhat related to the Highway 169/10 culvert project that
the Council authorized a month ago. This Highway 169/10 project was
estimated in the $413,000 range and is also included in the spring, 1994 bond
issue. The Council should note that the actual bid approved by MnDOT was
$490,000.
In addition to these two projects, the City will also have to upgrade the
culvert at the railroad crossing area. This project will be required due to the
Earl Hohlen commercial development proposal as storm water associated
with this project will have a dramatic effect on the drainage and storm water
flow in this vicinity.
If the City Council desires to move forward with this County Road 12/13
project, then approval of the attached resolution should take place.

Dear Councilmembers:
As directed by Resolution 94-11, dated February 7, 1994, MSA, Consulting Engineers has
prepared plans and specifications for the County Road 12/13 Drainage Improvement Project.
The project will alleviate flooding problems along 5th Street, west of County Road 13, and also
eliminate the flooding problem on the Demars property south of 5th Street and west of County
Road 13. The project also includes a new drainage pipe from the wetland area north of County
Road 12 to County Ditch No. 10.
Once the design.was finalized, we staked the alignment of the proposed storm sewer through the
affected properties east of County Road 13 and north of County Road 12. We met with the
affected property owners, including George Deschenes, Industrial Hardfacing, Ronald Guenther,
and also Weldon Schultze. Enclosed are copies of letters they signed, indicating their
concurrence with the proposed easements, and their willingness to provide these easements at
no cost to the City of Elk River. Easement descriptions have been prepared for each of the
above listed property owners, and easement documents could easily be prepared by the City
attorney should the City Council want to proceed with the project.
We are continuing to coordinate the project with Sherburne County and the U.S. Army Corps
of Engineers. The Corps of Engineers has jurisdiction over the wetlands, while Sherburne
County has jurisdiction over the County Road right-of-way, and also the County Ditch.
Enclosed for your consideration is a resolution which approves the plans and specifications and
authorizes the advertisement for bids for the County Road 12/13 Drainage Improvements.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING THE PLANS AND SPECIFICATIONS
AND ORDERING THE ADVERTISEMENT FOR BIDS
IN THE MATTER OF THE COUNTY ROAD 12/13 DRAINAGE
IMPROVEMENT OF 1994
WHEREAS pursuant to Resolution 94-11, the Project Engineer has prepared plans and
specifications for the County Road 12/13 Drainage Improvement of 1994, which
plans and specifications have been reviewed by the City;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
1. Such plans and specifications, a copy of which is attached hereto and incorporated herein
by this reference, are hereby approved.
2.
The City Administrator shall prepare and obtain the publication of an advertisement for
bids for the making of the improvement pursuant to the attached plans and specifications.
The advertisement shall be published once each week for three consecutive weeks, shall
specify the work to be done, and shall state that the bids will be received by the City
Administrator until on , 1994, at which time the bids will be
publicly opened in the Council chambers of the City Hall by the City Administrator and
the Project Engineer and will then be tabulated for consideration by the City Council at
a meeting thereof at o'clock -p.m. on , 1994, in the City
Council chambers at City Hall. No bids will be considered unless sealed and fIled with
the City Administrator and accompanied by a cash deposit, cashier's check, bid bond, or
certified check payable to the City Administrator in the amount of 5 % of the amount of
such bid.
