RE: WESTERN AREA 2ND PHASE IMPROVEMENTS
Dear Mr. Klaers:
As you are aware, the preliminary plat of Country Crossings was recently approved by the
City Council. We have had discussions with Tony Emmerich regarding his schedule to
proceed with improvements within that plat. Construction of the plat requires extension of
the trunk sanitary sewer, water, and storm sewer along with the street on Orono Parkway
from its current location to at least Joplin Avenue. This plat will also require the
construction of Joplin from County Road 30 to Orono Parkway. There have been
discussions about the further extension of Joplin from Orono Parkway to TH 10. Along with
the street construction, the issue of utilities beneath it need to be explored. Also, the County
Board recently passed a resolution authorizing a petition for City utilities to serve the County
building. I understand City Attorney Peter Beck is currently drafting a petition form which
will waive the County's right to appeal their assessments for these improvements.
If the City Council desires to look at the feasibility of extending trunk utilities to serve the
County building along with the necessary improvements associated with the Country
Crossings Addition, the first step would be adopting a resolution authorizing a feasibility
study. I do not believe that the County action would ever constitute a legal petition since
they do not represent more than 35 % of the affected property to be served by these proposed
improvements. Therefore, I have attached a draft resolution for the City Council's
consideration which authorizes a feasibility study without regard to the adequacy of the
petition from the County. This petition would essentially initiate the project by Council
direction; therefore, it requires a 4/5 vote.
I would envision the feasibility for these improvements to touch on many issues, including
trunk utilities extended out to and possibly across the County property, the extension of
Orono Parkway from its current location to Joplin, the extension of Joplin from County Road
30 to Orono Parkway, and potentially to TH 10. The issue of trunk and possibly lateral
utilities throughout the Sandpiper Estates Development and also the issue of whether or not
a road should be constructed between Sandpiper Estates and Joplin.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION OF THE CITY OF ELK RIVER
ORDERING A PRELIMINARY FEASIBILITY REPORT IN THE
MATTER OF THE WESTERN AREA 2ND PHASE TRUNK SANITARY SEWER,
WATER, STORM SEWER, AND STREET IMPROVEMENTS OF 1994
WHEREAS the City has determined that it should consider improving certain property by
constructing trunk sanitary sewer, water, storm sewer, and streets (the
improvement); and
WHEREAS Council must first secure a preliminary feasibility study in order to consider
making the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
This matter shall be referred to MSA, Consulting Engineers, who is requested to provide
to the City Council a report advising, in a preliminary way, whether the proposed
improvement is feasible and whether the improvement should thus be made as proposed
or in connection with some other improvement and the estimated cost of the improvement
as recommended.

Dear Pat:
This letter is to formally petition the City of Elk River to extend the trunk lines for city
utilities to the Sherburne County Government Center property at the cities earliest
convenience. After review of the onsite sewage treatment system and fresh water supply
for both human consumption and fire protection were evaluated, it was determined that
the current additions to the Government Center may create demands not able to be met
by the current systems at the site. Therefore, city water and sewer lines are essential at
the Government Center as soon as possible. The County Board took this action at their
regular meeting on Tuesday, April 5th, 1994.
I look forward to hearing from you regarding the procedures to formalize the petition.
