MEETING OF THE ELK RIVER CITY COUNCIL HELD AT THE ELK RIVER CITY HALL MONDAY, SEPTEMBER II, 2006 Members Present: Acting Mayor Farber, Councilmembers Dietz, Farber, Gumphrey, and Motin Members Absent: Mayor Klinzing Staff Present: City Administrator Lori Johnson, Recording Secretary Debbie Huebner 1. Call Meeting To Order Pursuant to due call and notice thereof, the meeting of the Elk River City Council was called to order at 6:55 p.m. by Acting Mayor Farber. 2. Consider 9/11/06 Agenda MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY COUNCILMEMBER GUMPHREY TO APPROVE THE AGENDA WITH THE FOLLOWING ADDITIONS: 7. - COUNCIL UPDATES -ITEM REGARDING NORTHSTAR CORRICOR 8. - STAFF UPDATES - TWO ITEMS BY CITY ADMINISTRATOR LORI JOHNSON MOTION CARRIED 4-0. 3. Consider Consent Agenda MOVED BY COUNCILMEMBER MOTIN AND SECONDED BY COUNCILEMBER DIETZ TO APPROVE THE FOLLOWING CONSENT AGENDA ITEMS: 3.1. AUGUST 14, 2006 MINUTES 3.2. AUGUST 21,2006 MINUTES - CORRECTION TO ITEM 6.1.- $5 MILLION MOTION CARRIED 4-0. 4. Open Mike Noone appeared. 5. Worksession 5.1. Council Open Forum The question was raised as to why the newly installed signal lights at School Street and Lions Park Drive are not working. City Administrator Lori Johnson stated that the wrong connection box was delivered and they are waiting for the correct one to arrive. City Council Minutes September 11, 2006 Page 2 5.2. 2007 Bu<lget and Tax Levy . City Administrator Lori Johnson reviewed the various options the Council has for the proposed 2007 levy. The Council is asked to consider the following resolutions: A. Resolution Authorizing the 2007 proposed Maximum Property Tax Levy B. Resolution Establishing the 2007 Tax Levy for the Economic Development Authority C. Resolution Establishing the 2007 TaxLevy for the Housing and Redevelopment Authority MOTION BY COUNCILMEMBER MOTIN TO APPROVE A RESOLUTION AUTHORIZING THE 2007 PROPOSED MAXIMUM PROPERTY TAX LEVY AT 10 PERCENT. The motion failed. MOTION BY COUNCILMEMER DIETZ AND SECONDED BY COUNCILMEMBER GUMPHREY TO APPROVE RESOLUTION NO. 06-104, AUTHORIZING THE 2007 PROPOSED MAXIMUM PROPERTY TAX LEVY AT 11 PERCENT. MOTION CARRIED 3-1. Councilmember Motin opposed. MOTION BY COUNCILMEMBER MOTIN AND SECONDED BY COUNCILMEMBER DIETZ TO APPROVE RESOLUTION 06-105, A RESOLUTION ESTABLISHING THE 2007 TAX LEVY FOR THE ECONOMIC DEVELOPMENT AUTHORITY. MOTION CARREID 4-0. MOTION BY COUNCILMEMBER MOTIN AND SECONDED BY COUNCILMEMBER DIETZ TO APPROVE RESOLUTION 06-106, A RESOLUTION . ESTABLISHING THE 2007 TAX LEVY FOR THE HOUSING AND REDEVELOPMENT AUTHORITY. MOTION CARRIED 4-0. 5.3. Motion Calling for Truth in Taxation Hearing and Continuation Date MOTION BY COUNCILEMBER DIETZ AND SECONDED BY COUNCILMEMBER GUMPHREY TO SET THE TRUTH-IN-TAXATION HEARING FOR MONDAY, DECEMBER 4, 2006, AT 6:30 P.M. WITH THE CONTINUATION HEARING FOR MONDAY, DECEMBER 11,2006 AT 6:30 PM. MOTION CARRIED 4-0. 6. Other Business Councilmember Motin stated that verbal authorization was given to the Northstar Corridor to move to the fInal design, which is the last stage prior to the funding commitment, and written conftrmation was received last Thursday. He stated that they will be looking at Mayor June 2007 for the ftnal funding commitment. 7. Staff Updates Ms. Johnson stated she, Mayor Klinzing and City Engineer Terry Maurer will be meeting with Mark Matruska of Senator Mark Kennedy's offtce next Monday, to discuss funding of the Highway 169 Study. . . . . City Council Minutes September 11, 2006 Page 3 Counci1member Farber stated that if no progress is made, he suggested that S1. Paul MnDOT officials be invited to take a first hand look at Elk River's dilemma, being located between Highway 101 and Highway 169 north of Elk River which will be freeway-type roadways. Ms. Johnson noted that a Regional of the Minnesota League of Cities meeting will be held in Monticello September 28th which will be attended by a number of candidates and League representatives. She felt it would be helpful to have the support of the League to help put pressure on MnDOT, and possibly introduce legislation to help other cities who are willing to "step up to the plate" as Elk River is, by paying for the Highway 169 Study. Ms. Johnson noted she will email the details of the meeting to the Counci1members. Ms. Johnson noted that a County Transportation meeting will be held Thursday, September 14, 2006 at 2:30 p.m. 8.
