We will be prepared at that public hearing to give a brief presentation of the project and to answer any questions. As in previous years this bituminous overlay project was intitiated by the City Council and is proposed to be assessed 100% to the benefitted property owners. This is a maintenance type project which attempts to rejuvenate the existing street at a lower cost than reconstructing them in future years. If the bituminous overlay is not undertaken and the roads continue to deteriorate the point will come in the near future where the only reasonable upgrade to the existing roads will be a total reconstruction. The proposed assessment rate estimated in the feasiblity study is $1,577 per residential unit. It has recently been discovered that property owners in the Peterson Addition still have approximately six years remaining on their 20-year assessments for the original street construction. It seems this leaves the City with two options. First, they could simply eliminate Peterson Addition from the project and continue to patch the streets for the next six years. The second option would be to reduce the assessment rate to compensate for the existing assessment. This is a less desirable option since it would open all other overlay projects to similar City participation. At the close of the public hearing, if the Council desires to move forward with this project, consideration should be given to adopting the attached resolution which orders the improvement and authorizes the preparation of plans and specifications. It should be noted since this project was initiated by the City Council, this particular resolution ordering the project requires a 4/5 vote. If you have any questions regarding this, please call. Sincerely, MSA, CONSULTING ENGINEERS T~~ 219-3106.may e e e RESOLUTION 94- A RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION ORDERING THE IMPROVEMENT AND PREPARATION OF PLANS AND SPECIFICATIONS IN THE MA TIER OF THE BITUMINOUS OVERLAY IMPROVEMENT OF 1994 WHEREAS a public hearing relating to the Bituminous Overlay improvement was held before the Elk River City Council after ten days mailed notice and two weeks published notice of the hearing was given; and WHEREAS the City Council has duly considered the Feasibility Report and those matters presented at the public hearing by those persons desiring to be heard on the matter; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. The Bituminous Overlay improvement is hereby ordered as recommended in the Feasibility Report dated April, 1994. 2. MSA, Consulting Engineers is hereby designated as Project Engineer for this improvement. The Project Engineer is directed to prepare plans and specifications for the making of the improvement and the solicitation of competitive bids. Passed and adopted this 6th day of June, 1994.
