RE: MEADOWV ALE HEIGHTS ASSESSMENTS
Dear Council Members:
In April 1993, a Feasibility Study was done for the extension of trunk sanitary sewer and
watermain to serve the Meadowvale Heights Development. As you recall, this is the project
that crossed the Nord property to serve the development just west of County Road #1. In
that Feasibility Study, we anticipated trunk waterrnain being routed through the Meadowvale
Heights Development. In accordance with the City's assessment policy, we estimated the
lateral benefit from the trunk watennain to be $46,150.00. In actuality, as the Meadowvale
Heights Development proceeded, Dennis Backes constructed his internal improvements
himself, including that portion of trunk watermain we discussed in the Feasibility Study. In
fact, when the assessments were levied, Mr. Backes was given credit for the cost of the trunk
oversizing for that particular piece of watermain. However, we inadvertently continued to
assess the $46,150.00 for lateral benefit. This resulted in an assessment to Meadowvale
Heights Development for a piece of watermain that the Developer actually paid for. In
essence, if this assessment were to be paid, the Developer would pay for this piece of pipe
twice.
In order to rectify this situation, we are asking the City Council to officially rebate
$46,150.00 worth of assessments on the Meadowvale Heights Development for the trunk
sewer and water project. We have had discussions with the Developer, and have indicated
to him that once this action is officially taken by the City Council, we would work with him
to either reduce the assessments across the board on the remaining lots that are unsold, or
he could pick particular lots, and we would rebate the entire cost of the assessment up to the
amount of $46,150.00.

June 6, 1994, City Council meeting.
