OVERVIEW
The subject property is currently owned by the City of Elk River and a
majority of the property is utilized as a storm drainage pond. This parcel
was obtained in 1989-90 through the tax forfeiture process. The Boy Scouts
of Elk River are proposing to construct a 30' x 60' (1,800 square feet) building
to store various equipment used by local Troops. The building will be
constructed by professional carpenters and selected volunteers.

The building itself will be construct along 191 1/2 Lane NW, with the storm
drainage pond remaining directly to the north. As part of this building
construction, the storm drainage pond will have to be reconfigured to provide

adequate side slopes and storage capacity for the storm water drainage needs
in the area. The building will be positioned on the property to meet all
required setbacks and will have a bituminous driveway and parking area
servicing the three storage units.
Along with the regrading of the pond, there will be additional landscaping
planted around the perimeter to meet the city's landscaping requirements. It
is anticipated the Boy Scouts will be able to accomplish this through their
volunteer efforts much like the construction of the building.
The building itself will resemble a residential garage and be compatible with
the Mini Storage facility to the west. Three (3) 10 x 8 overhead doors will
face 1911/2 Lane providing access to each of the storage units.

The City Attorney has recommended that, in situations where organizations
construct buildings on city property, the city maintain ownership of those
buildings and enter into a lease agreement outlined with terms and
conditions for the use of that building. At this time, the city is dealing with
two situations that would fit this scenario. The first being the Boy Scout
building and the second is the Chamber of Commerce building at Highway 10
and Main Street. This type of arrangement, whereby the city owns the
building and leases it back, provides the city with the most protection and
control while establishing consistent city policy for future requests.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission unanimously recommended approval of the
conditional use permit request by Todd Anderson, representing the Boy
Scouts of Elk River, to construct a mini storage facility with the conditions
stated in the attached staff report. The Planning Commission also added two
conditions:
5. An authorized representative of the City of Elk River sign the
conditional use permit application as the property owner.
6. The lease agreement be structured providing use of the building
be limited to the Boy Scouts of Elk River and that there be no
other subleasing or commercial activity associated with the mini
storage facility.

RECOMMENDATION
It is recommended the City Council approve the conditional use permit
request by Todd Anderson, representing the Boy Scouts of Elk River, to
construct a mini storage facility with the following conditions:

ANALYSIS

The Boy Scouts are proposing to construct a 30 x 60 (1,800 square feet)
building to store camping equipment. The actual construction will be
performed by professional carpenters and volunteers. A majority of the
material and labor to complete the project has been either donated or

purchased. As illustrated on the attached site plan, the building will be
located along 191st Lane with the storm drainage pond directly to the north.
A bituminous driveway and parking area will be included providing
access to each of the three (3) storage units. In order to meet required
setbacks, the building will need to be a minimum of thirty (30) feet from the
front property line and ten (10) feet from each side lot line. Parking setbacks
are ten (10) feet from all property lines.
STORM DRAINAGE POND
The existing storm drainage pond will need to reconfigured to accommodate
the proposed location of the building and provide adequate storage capacity
for storm water run-off. As with all storm ponds, side slopes must not exceed
a 4:1 slope. During a reconfiguration of the pond and construction of the
building, proper erosion control measures (such as silt fence) will need to be
installed. In addition, once grading of the pond is completed, stabilizing the
side slopes with sod or seed (whichever is necessary) will need to occur.
LANDSCAPING
e
Even though this project is proposed on City property, it is still important to
recognize the zoning ordinance requirements. Therefore, given the size of
this parcel, eighteen (18) trees will be required to be installed throughout the
site. If the Boy Scouts want to plant larger trees, the total number can be
reduced proportionately.
PROPOSED BUILDING
The building itself will resemble a residential garage. Three (3) 10 x 8
overhead garage doors will face 191st Lane. The current proposal includes a
plywood (Tl-ll) material to be used on all four sides and the roof having
asphalt shingles. It is recommended the building be painted to be compatible
with the neighborhood.
BUILDING OWNERSHIP
At this time, it is expected the City will retain ownership of the property as
well as owning the proposed building. A lease agreement with the Boy Scout
Troops will be prepared by the City Attorney outlining the terms and
conditions for use of the building.

The three scout troops in Elk River need storage space to store
their camping equipment. The American Legion has appropriated up to
$15,000.00 to build a storage building for Troops 90, 99 and 111. The
construction of the building will be done mainly by professional
carpenter/volunteers. Material will be acquired at reduced cost and
the building will be placed on city owned property and maintained by
the Elk River scout troops.
BUILDING
The building will initially be sized at 30 ft. by 60 ft. and
subdivided into three parts, one for each troop. Layout allows for
future expansion for use by other corrmunity orientated youth
organizations, as depicted on Plot Plan. Adequate room is set aside for
the existing storm water runoff holding pond on said Lot 4.

their property. In addition, the scouts also have their own liability
insurance which will cover them while at the building site.
