P 94-02 ISSUE Consider a request for final plat approval of Country Crossings by Country Ridge Partnership to subdivide approximately forty (40) acres into seventy- three (73) single family lots. LOCATION e Northeast corner of the extension of Joplin Street and County Road No. 30 ATTACHMENTS Memo from Terry Maurer dated June 16,1994, Final Plat, Resolution 94-_ ANALYSIS The final plat has been prepared in accordance with the action taken by the City Council and Planning Commission. The plat will consist of 73 single family lots with park land being dedicated along Orono Parkway to preserve the existing stand of oak trees. Both Joplin Street and Orono Parkway will be constructed as part of this proposed plat. In addition, one of the conditions is that ninety (90) feet of street, drainage and utility easement be granted for the extension of Joplin Street from Orono Parkway to Highway 10. . The only correction that needs to be made to the plat is eliminating Outlot A, which is the Hudson Lane extension between the proposed plat and Orono Parkway and dedicating that segment of street as public right-of-way. This in turn will require the two remaining outlots to be re-titled to Outlot A and B, respectively. P.O. This cable has to be relocated outside the Joplin Street right-of-way. There is a cost associated with this relocation which should be borne by the developer. We find that the final plat addresses all the issues brought up during the preliminary plat and site plan review. There is one item we would note, however. We believe that Outlot A, which is the extension of Hudson Lane north to meet Orono Parkway, should be platted as right-of-way rather than as an outlot. The only other item we would note is the City has initiated brief discussions with Sherburne County relative to the potential acquisition of slightly more fairgrounds property in an effort to minimize tree loss when Orono Parkway is extended westerly to Joplin. If, in fact, the City does acquire additional right-of-way from the fairgrounds, the alignment of Orono Parkway through the Country Crossings plat may be modified slightly. No additional right-of-way for Orono Parkway would be required from Country Crossings; in fact, a small portion of the Orono Parkway as platted would likely stay in its native state, leaving the existing trees. T. 33, R. 26, is assumed to bear South 890 44' 14" West. f6 6 r--- II II -'?1___.J L___ll~ GRAPHIC o 50 SCALE IN FEET N ~ SCALE 100 32, 200 e COUNTRY CROSSING CITY OF ELK RIVER, SHERBURNE COUNTY, MN. e RESOLUTION NO. 94 - CITY OF ELK RIVER A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR: COUNTRY CROSSINGS e WHEREAS, application has been made for final plat approval, pursuant to Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property legally described on attached Exhibit A and hereinafter referred to as "the Property"; and WHEREAS, the application for preliminary plat approval has been referred to the Planning Commission which has given its advice and recommendation to the City Council; and WHEREAS, a preliminary plat of the Property was approved by the City Council on April 21, 1994; and WHEREAS, the proposed final plat is consistent with the preliminary plat as approved by the City Council; and WHEREAS, the proposed final plat complies with each of the conditions set forth by the City Council in its approval of the preliminary plat of the Property; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELK RIVER, as follows: 1. It is hereby determined by the City Council for the City of Elk River as follows: A. The proposed subdivision is consistent with the Zoning Ordinance and conforms with all of its requirements. B. The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans including, but not limited to, the City's Comprehensive Development Plan. C. The physical characteristics of the site, including , but not limited to, topography, soils, vegetation, susceptibility to erosion and e e siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. D. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements otherwise required herein. E. The proposed subdivision will not cause substantial environmental damage. F. The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. G. The proposed subdivision will not have an undue or adverse impact on the reasonable development of neighboring land. 2. Final plat approval is hereby granted for the Property, subject to the conditions set forth in attached Exhibit B. 3. The officers of the City are hereby authorized, once the conditions set forth in Exhibit B are met and complied with, to sign the final plat for the Property and to issue a certified copy of this Resolution giving final approval of the plat. _ 4. The owner of the Property is authorized to record the final plat as required by law and shall file proof of said recording with the City. No building permits will be issued for the Property until the final plat is recorded. 5. This final plat approval shall expire two years from the date of this resolution if the final plat is not recorded within that time.
