OVERVIEW

The proposed amendments to the Development Plan and Site Plan for Phase
I of Elk Park Center has come about as the result of Target's desire to
construct a new prototype store, which is different than any store currently
operating in Minnesota. The concept is to develop what is currently termed a
"Super Target" including 40,000 square feet of grocery store and roughly
120,000 square feet of merchandising. This new store proposed by Target

would eliminate any grocery tenant on the north end of the site and combine
the two anchors originally proposed into one building.
PROPOSED CHANGES
· Relocating the entrance drive off of Jackson Road further north
approximately 500 feet. This new entrance would become more
centralized to the development and provide a more even distribution for
vehicle access to the project.
. The elimination of the retail stores on the south end of the project to be
replaced with additional parking to serve the Super Target.
. The landscaped area along the south end of the project has been reduced
approximately 10-15 feet to allow for the additional parking to serve the
Super Target.
. Square footage of the balance of the project beyond the Super Target store
has been adjusted creating a mid-sized anchor at the north end of the
facility.
SUMMARY
e
Overall, the total square footage included in Phase I will actually increase
from 246,000 square feet to 293,000 square feet. On the other hand, the
overall square footage that can ultimately be developed as part of Elk Park
Center has decreased by roughly 40,000 square feet.
PLANNING COMMISSION RECOMMENDATION
The Planning Commission unanimously recommended approvmg the
Conditional Use Permit.
RECOMMENDATION
Staff is recommending the City Council approve the following:
A. The amended Development Plan for Elk Park Center's Commercial
Planned Unit Development.
B. A Conditional Use Permit amending the Site Plan approval for Phase I
of Elk Park Center Commercial Planned Unit Development with the
following conditions:

anchors for the entire project, the site plan has to be adjusted and plans
reconfigured to balance the tenant spaces throughout the project.
PROPOSED CHANGES
· Relocating the entrance drive off of Jackson Road further north
approximately 500 feet. This new entrance would become more

ACCESS TO THE SITE
e
Staff has requested the developer redesign the southern most access point
into the shopping center to allow for vehicles to enter the site conveniently
with the least amount of confusion. Redesigning this access point will also
provide more opportunity for vehicles stacking and waiting to leave the
center onto Freeport Avenue. This point of entrance is of concern because
staff believes that the majority of vehicles will be turning in at this point as it
provides the first access point to the proposed Super Target.
SUMMARY
Overall, the total square footage is not necessarily changing. The original
tenants as proposed, are being shifted around to accommodate Target's desire
to construct this new store. If fact, this store is such a fresh idea from Target
that the construction plans have not been prepared yet. Therefore, building
elevations have not been submitted to'staff for any review, however, it has
been indicated by the architect that Target is considering a front elevation
similar to a Target Greatland, but will be slightly larger as a result of the
increased square footage of the store. The architects have also indicated that
they plan on having some renderings available for the Planning Commission
at Tuesday night's meeting.

It is my understanding from Carl Carlson of Kraus-Anderson of Elk River, Inc. that
a question was raiSed at the June 28 Planning Commission meeting as to the authority of
Kraus-Anderson of Elk River, Inc. to request on behalf of Elk Park Center Limited
Partnership an Amendment to. the Development Plan and Conditional Use Permit for Elk
Park Center Commerdal PUD, Case No. CU 94-24. As attorney for the partnership, I
assure you that Kraus-Anderson of Elk River, Inc. has authority to apply for the proposed
amendment. The limited parmers of Elk Park Center Limited Partnership do not have
the right to prevent such an application. As you have been informed, however, there is a
dispute between the general partner and limited partners of Elk Park Center Umited
Partnership. We will keep the City of Elk River informed as to the status of resolving this
dispute, which is in the arbitration process.
Should you have any questions as to this letter or this matter, please let me know.
If the Mayor, City Council, or Oty Attorney have any questions as to this matter, I would
appreciate your bringing it to their attention before, if possible, or otherwise at the City
Council meeting on July 5th. In the meantime, should you have any questions at all,
please give me a call.

Dear Mayor and Members of the City Council:
We are attorneys for Orrin A. and Scott L. Ericson, Limited
Partners in Elk Park Center Limited Partnership, the developer of
the above Project. As such, we appeared before your Planning
Commission last Tuesday on the application for a conditional use
permit to change the Target store on the subject property from the
previously approved 90,000 square foot store to a 162,000 square
foot "Super Store."
The Ericsons oppose this change, and there is an arbitration
proceeding pending relating to whether this change will be
implemented. Accordingly, we believe that it is premature for the
City to approve the change in the Project until the arbitration
proceeding is resolved. The Demand for Arbitration of the General
Partners is enclosed for your reference. A substantial Counterclaim
will be asserted in the arbitration by the Ericsons, who also
intend to pursue all other remedies against all other persons until
this is satisfactorily resolved.

We suggest that the pending application for a conditional use
permit to expand the Target Store be tabled until the various legal
proceedings have been concluded. Please incorporate this
communication into the record of the public hearing, which we
understand will be held next Tuesday evening, July 5.
