RE: IDLLSIDE CROSSING FEASffiILITY STUDY
Dear Council Members:
As you are aware, the preliminary plat and conditional use permit for the proposed Hillside
Crossing development is on your July 5, 1994, City Council agenda. The Developer of this
project has indicated his desire to petition for public improvements, including the sanitary
sewer, water, storm sewer, street, sidewalk, and street lighting within his development. City
Attorney Peter Beck is preparing a petition form for the Developer's signature. The Developer
is anxious to initiate this process; therefore, I have prepared the attached draft resolution which
declares the adequacy of the petition and orders the feasibility study for the Hillside Crossing
development. It is anticipated the petition will be available for the Developer's signature prior
to Tuesday evening's meeting.
In addition to the feasibility study, which will be a relatively small document which lays out
the cost of the improvements and the schedule, the Developer would request that direction be
given to initiate plans and specifications at this time, also. It is anticipated that the project will
be accomplished by change order either to the Arcon Construction or Forest Lake Contracting
projects currently underway in the area. Therefore, along with consideration of the attached
resolution, we would request that the Council give consensus to the initiation of work on the
plans and specifications contingent upon the Developer placing an adequately sized escrow
account with the City to cover such work. At a future meeting, a resolution approving the
plans and specifications and ordering the project will be presented to the City Council.
If you have any questions regarding this project, I will be in attendance at your July 5, 1994,
City Council meeting.

A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION DECLARING THE ADEQUACY OF THE
PETITION FOR IMPROVEMENT AND ORDERING THE
PRELIMINARY FEASIBILITY REPORT IN TIlE MA'ITER
OF THE HILLSIDE CROSSING IMPROVEMENT OF 1994
WHEREAS the City has received a petition (the Petition) requesting that the City improve
certain property by sanitary sewer, water, storm sewer, streets, sidewalk, and
street lighting (the improvements); and
WHEREAS the City has reviewed the Petition and identified the owner of the real property
abutting the streets named in the Petition and detennined the Petition has been duly
executed by the owners of not less than 35 % in frontage of the real property
abutting on the streets named in the Petition as the location of the improvements;
NOW, THEREFORE, BE IT RESOL YED by the City Council of the City of Elk River,
Minnesota:

The Petition is hereby declared to have been signed by the owners of at least 35 % of the
frontage of the real property abutting on the streets named in the petition as the location
of the improvement. This declaration is made in confonnity to Minnesota Statutes,
Section 429.035.
2. This Petition is hereby referred to MSA, Consulting EngineersJ who is instructed to
provided to the City Council a report advising, in a preliminary way, whether the proposed
improvement is feasible and whether the improvement should thus be made as proposed
or in connection with some other improvement and the estimated cost of the improvement
as recommended.
Passed and adopted this 5th day of July, 1994.
