98-097 RESRESOLUTION 98-97 EXTRACT OF MINUTES OF A MEETING OF THE CITY COUNCIL OF TME CITY OF ELK RIVER, MINNESOTA Pursuant to due call and notice thereof, a regular or special meeting of the City Council of the City of Elk River, Minnesota, was duly held at the Elk River City }{all on Eepte~ber !4, 1998, commencing at 6:00 o'clock P.Mo The following Councilmembers were present: Mayor Duitsman, Council Members Dietz, Thompson, Farber and Holmgren and the following were absent: None Council Member Farber introduced the following resolution and moved its adoption: RESOLUTION CALLING FOR AN ELECTION ON THE ISSUANCE OF $3,950,000 OF GENERAL OBLIGATION BONDS OF THE CITY FOR PUBLIC PARK ~ RECREATIONAL FACILITIES BE IT RESOLVED by the City Council of the City of Elk River, Minnesota, as follows: 1. Pro__~. This City Council has investigated the facts and does hereby find, dete~ine and declare that it is desirable to acquire, build, equip and better public park and recreational facilities for the City. 2. ~. The proposition of authorizing the issuance of not to exceed $3,950,000 of general obligation bonds of the City for said purpose shall be submitted to the qualified electors of the City at the general election to be held on Tuesday, November 3, 1998. Said election shall be held between the hours of 7:00 o'clock a.m. and 8:00 o'clock p.m. The polling place shall be the same ~s the polling places for the general election. 3. NQtice ~nd Ballot. The City Clerk is hereby authorized and directed to po~= and publish according to law a Ballot and Notice of Election combining the information required as to offices to be filled with the information met forth on the following form, and to prepare ballots for the question (which shall be blue in color) for use at said election, which information relating to the question in the combined notice (as provided above) and ballot shall be in substantially the following forms: 358744.1 NOTICE ELECTION NOTICE IS HEREBY GIVEN that an election on a question will be held in and for the City of Elk River, Minnesota, on Tuesday, November 3, 1998, between the hours of 7:00 o'clock a.m. and 8:00 o'clock p.m., at which time the following question will be submitted: "Shall the City of Elk River, Minnesota, be authorized to issue its general obligation bonds in an amount not to exceed $3,950,000 to defray the expense of the acquisition, construction, equipping and betterment of an outdoor aquatic center and other public park and recreational facilities for the City?" The maximum amount of increased levy as a percentage of market value i~ .047 The amount that will be raised by the new referendum tax rate in the first year it is to be levied is $ 332,782 INSTRUCTION TO VOTERS: If you wish to vote in ~avor of the above proposition, mark a cross (X) in the square before the word "YES" If you wish to vote against the above proposition, mark a cross (X) in the square before the word "NO". The list of persons who are appointed judges for said election is attached to this Resolution. 5. Manne~; Canvass. Said election shall be held and conducted in accordance with the statutes of the State of Minnesota applicable, and the City Council shall meet as required by law for the purpose of canvassing said election and declaring the results thereof. Adopted on September 14, 1998, the Elk River City Council. The motion for the adoption of the foregoing Resolution was duly seconded by Councilmember HolmKren and, upon a vote being taken thereon, the following Councilmembers voted in favor thereof: Mayor Duitsman, Council Members Dietz, Thompson, Father and Holm§ren and the following voted against the same: None Whereupon said Resolution was declared duly passed and adopted. 358744.1 4 STATE OF MINNESOTA COUNTY OF SHERBUR/~E CITY OF ELK RIVER I, the undersigned, being the duly qualified and acting city Clerk of the City of Elk River, Minnesota, DO HEREBY CERTIFY that I have carefully compared the attached and foregoing extract of minutes with the original minutes of a meeting of the City Council duly called and held on the date therein indicated, which are on file and of record in my office, and the same is a full, true and correct transcript therefrom insofar as the same relates to an election on the question of authorizing bonds to defray the expense of proposed public park and recreational facilities.
