Overview The subject site is an existing 40.5 acre parcel with three wetlands, one house and several outbuildings. The existing house is serviced by private septic and well systems. The subject site is zoned R1d. The proposed subdivision will create 38 lots and 3 outlots. Applicable Regulations Subdivision These findings are necessary for the city council approval of the preliminary plat and the final plat: (1) The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the zoning regulations and this article. (2) The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. (3) The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. (5) The proposed subdivision will not cause substantial environmental damage. (6) The proposed subdivision will not conflict with easements of record or with easements established by judgment of a court. (7) The proposed subdivision will not have an undue and adverse impact on the reasonable development of neighboring land (8) The proposed subdivision is not premature. A subdivision is premature if any of the following exists: a. Lack of adequate storm water drainage. b. Lack of adequate roads. c. Lack of adequate sanitary sewer systems. d Lack of adequate offsite public improvements or support systems. Rezoning In reviewing a proposed amendment, consideration shall be given to existing conditions within the area directlY and indirectlY qfficted ry the proposal, the conservation if proper(} values, the use to which the proper(} qfficted is being devoted at the time, and relevant provisions, if airy, in the land use plan. Analysis The subject property is zoned R1d, this district is intended to provide single-family residential districts with larger lots and higher quality housing types in areas with full municipal utilities. This district is intended to encourage the design of subdivisions that protect natural features while providing high quality housing sites. The applicant is requesting to rezone this property to R1c, which is intended to provide single-family residences in areas with full municipal utilities in areas that are a continuation of existing residential development patterns and the infilling of existing lots in established areas. There is a large single family development north of the subject site (River Park) an application has been made for residential development to the northeast of this site. At this time municipal utilities are not readily available to this site. Comprehensive Plan The subject property has an Urban Residential designation in the City of Elk River Comprehensive Plan. Urban Residential include residential areas that will be served by the municipal sanitary sewer system. These land uses include: single family detached housing, duplexes, townhomes and multiple-family dwellings. Rezoning - The subject side is zoned R1d, the applicant is requesting to rezone portions of the property to R 1 c, in anticipation of being serviced by municipal utilities. Outlot A will not be rezoned to R1c, it will remain R1d at this time as well as Outlot B; development is not proposed for these lots, staff is comfortable not rezoning these outlots. The submitted plans show a possible subdivision for Outlot A, which staff has not reviewed. All of Outlot C will be encompassed with a drainage and utility easement and be included in the rezoning. Lots - The proposed lots range from 11,050 square feet to 83,331 square feet, the minimum lot size in the R1c district is 11,000 square feet. The R1d district requires larger lots of 14,000 square feet or S:\PLANNING\Case Files\2006\Plat\P 06-18 Preserve Ponds\CC_ll_20_06.doc Case File: 06-18 Page 4 more. The 11,000 square foot lots are more consistent with the development to the north and are that of a typical "city lot" (serviced by sewer and water). A large Xcel Energy Easement encompasses the southwest portion of the development, which occupies a large portion of the backyards of proposed Lots 1-11, Block 3. Staff has concerns that future additions or decks on the back of the house may be challenged due to encroachment in the easement. The applicant responded to this concern as follows: "the pad depth is a nominal 50 feet. It appears there is a minimum depth of 57 feet between front setback and the power line easement. It is reasonable to expect that a conventional deck of 12 feet in width can be added to a house with a width of 44 feet and not encroach. House styles can provide for the house to set ahead of the garage. This condition is most pronounced on Lots 5-10." The overall density is 1.1 unit per acre. Natural Resources Natural Resource Inventory (NRI) - The Natural Resource Inventory provides the City with extensive data related to the location and quality of natural resources in the city. The NRI indicates medium-tall grass nonnative dominated grassland is present and Saturated to seasonally flooded nonnative dominated gramiod vegetation is present typically found around wetlands. While these grasslands are noteworthy in the inventory, they do not merit conservation. Wetlands - There appears to be three wetlands onsite. A wetland buffer of 25 feet is required and an additional structure setback of 20 feet applies. There is a buffer shown on the Site Plan, but it does not include the additional 20 foot setback. Parks Park Plan - The Comprehensive Park Plan does not indicate any park target area in this development. A trail corridor is planned in the wider area and on the east side of this development site. Park and Recreation Commission Recommendation - At the October 11, 2006 meeting the Parks and Recreation Commission recommended cash dedication for this plat and trail connections. A 50- foot trail connection, in the form of an outlot, in the southeast comer (between lots 12&13, Block 3, south to the Foster property) and one somewhere in the southwest area to give connection to the park in River Park. Outlot B should have a trail easement on the east side of County Road 40, which is shown on the plans, a trail easement should be dedicated along County Road 40 on both sides for the trail. Transportation Streets - The subject site is mainly accessed from County Road 40 and has three interior streets. The streets are proposed to connect on the north side and on the west side with future River Park phases. If both of these phases are not in place at the time of development of Preserve Ponds, a temporary cul-de-sac will be needed at the end of the road. The City Engineer will review traffic calming as part of the Final Plat. The turn lane on County Road 40 is addressed in the Sherburne County letter dated October 5, 2006. An easement may be required. Trails - A trail is shown on both sides of County Road 40, a 15 foot trail easement should be provided. The Parks Commission recommended a 50 foot wide trail connection through Lots 12 S:\PLANNING\Case Files\2006\Plat\P 06-18 Preserve Ponds\CC_ll_20_06.doc Case File: 06-18 PageS and 13 in a form of an outlot. The Parks Commission recommended the trail connection in that location to access the property to the south and have internal connections in that area, the Park Plan shows this connection. A trail connection should be provided to the west. Sidewalks - A sidewalk is shown on one side of the street, which does connect to the proposed trail along County Road 40. Utilities Water and Sewer - City water is not presently available to serve this development. The development to the north (River Park) will be providing service to this proposed development; until that time this site will not have access to city sewer and water. In order to approve this development, it will be necessary to provide documentation that sanitary sewer and water will be available from the River Park development. The City Engineer's memo dated November 8, 2006 addresses these issues. Grading/Drainage Drainage calculations have not been submitted at this time. Two ponds are located within the Xcel Energy easements, authorization from Xcel Energy is necessary. Landscaping Buffer - Landscaped screening is shown along County Road 40 consisting of Maple, birch, crab and evergreen trees, along with various large shrubs. According to the Screening Ordinance, "lots along collector or arterial streets shall be screened with a 1S-foot easement area for landscaping. Screening shall be accomplished by a combination of earth berming and planting." An earth berm of an undulating height of 2-4 feet should be installed on Lots 8-12 Block 1, and Lot 14, Block 3. The general screening should be planted in a more grouped order, providing variety in color, texture, and density. Street Trees - The Landscape Plan submitted shows two trees per interior lot and 4 trees per comer lot, meeting minimum landscape requirements. Planning Commission Recommendation The Planning Commission held a public hearing on these items on November 14, 2006 and recommended approval as presented. The Commission had some concerns with the 50 foot trail between Lots 13 and 14, Block 3 when a trail along County Road 40 is just three lots away. The applicant expressed the same concerns. Recommendation Staff recommends that the City Council approve the rezoning from R1d to R1c excluding Outlots A and C for property located at 18776 Cleveland Street NW. Staff recommends that the City Council approve the proposed Preliminary Subdivision to create 38 lots and 3 outlots for property located at 18776 Cleveland Street NW, subject to the following conditions: 1. All comments and conditions of the City Engineer's memo dated November 8, 2006 shall be addressed. S:\PLANNING\Case Files\2006\Plat\P 06-18 Preserve Ponds\CC_ll_20_06.doc Case File: 06-18 Page 6 2. All comments and conditions of the Sherburne County memo dated October 5, 2006 shall be addressed. 3. The development shall meet all applicable building codes. 4. The development shall meet all applicable fire codes. The Fire Chief shall verify location of all fire hydrants, and may require additional hydrants necessary to preserve the health and general welfare of the residents. 5. In addition to the easements shown in the preliminary plat, the following easements shall be provided: a) A 15 foot trail easement is required on both sides of County Road 40. b) A 50-foot trail connection between Lots 12 and 13 Block 3, in the form of an oudot shall be created. c) A 15-foot landscape easement shall be provided along County Road 40 with the proposed landscaping and a berm. 6. An earth berm of an undulating height of 2-4 feet should be installed on Lots 8-12 Block 1, and Lot 14, Block 3. 7. A wedand buffer of 25 feet apply to all wedands and a structure setback of 20 feet from the buffer applies. 8. The applicant shall provide documentation that sanitary sewer and water will be available from the River Park development to serve this development. 9. Storm Drainage calculations are required prior to final plat approval. 10. A NPDES permit application for Storm Water Pollution Prevention Plan (SWPPP) shall be submitted prior to final plat approval. 11. All required subdivision/park information shall be provided in an electronic format (.dwg file) as required by the City Ordinance and Land Use Application prior to recording of the plat. 12. The following fees shall apply: a) Park dedication shall be in the form of cash at the rate applicable at the time of final plat recording. b) A seal coat fee shall be paid, at the rate applicable at the time of final plat recording, prior to releasing the plat for recording. 13. A letter of credit in the amount of 100% of the cost of the improvements shall be submitted prior to the releasing of the plat for recording. 14. The applicant shall execute a developer's agreement outlining the terms and conditions of approval. 15. Approved Street Signage plan shall be submitted prior to Final Plat application. The revised plans were prepared by John Oliver & Associates and contained a October 26,2007 revision date. Based upon our review, we would offer the following comments: A. Preliminary Plat . The proposed plat contains 38 residential lots and 3 large outlots. It also contains approximately 2.8 acres of County Highway 40 right of way. Outlot A is approximately 8.8 acres and will be further subdivided into approximately 16- 17 lots in a future addition of River Park. Outlot B is approximately 3.6 acres and is on the east side of County Highway 40. It contains a small pond and could possibly be further subdivided with future developments on the east side of County Highway 40. Outlot C contains approximately 6.4 acres and is encumbered by wetlands and Xcel Energy easement. . As with the River Park addition, this plat should be required to pay $1,000 per single family residential unit towards the reconstruction cost of County Highway 40. . Limited access should be provided in the plat along the County Highway 40 frontage. This should include both the plat on the east and the west side of County Highway 40. . An additional 15-foot trail easement will need to be provided as a separate document, since it cannot be included on the final plat for the 10-foot wide bituminous trail on either side of County Highway 40. . The proposed plat connects at two locations; one on the north side, and one on the west side, with future River Park phases. If both of these phases are not in place at the time of the development of Preserve Ponds, a temporary cul-de-sac will be needed at the end of the road. The easement for the temporary cul-de- sac will either need to be provided in Preserve Ponds or by River Park. B. Preliminary Grading. Drainage and Erosion Control . It appears that all of the lots meet the new wetland setback ordinance. . The drainage plan shows a concept for a drainage system connecting ponds and wetlands with small diameter storm sewer in the streets to provide a storm sewer with an outlet. A detailed review of drainage calculations has not been completed, since they were not included in the packet we received. Storm drainage calculations will be reviewed in detail when received and additional comments provi~d. . Two of the pond locations are within the Xcel Energy easement. Authorization from Xcel Energy for the construction and long term maintenance of these ponds within their easement will be necessary. . It appears that all ofthe house pads meet the minimum elevations relative to the high water predicted in the ponds, wetlands and emergency overflow areas. C. Preliminary Utility Plan . As noted in my previous memo dated October 12, 2006, there currently is no sanitary sewer or water service available to this site. In order to approve this development, it will be necessary to document that the sanitary sewer and water will be available from the River Park development. . Specific hydrant and valve locations will be reviewed with the Fire Chief and Elk River Municipal Utilities when construction plans are submitted. . In my previous memo I indicated that it would be advisable for the developer to coordinate improvements at the entrance onto County Highway 40 with the Sherburne County upgrade of County Highway 40. I believe this initial contact has been made and I assume that these improvements will be constructed with the County road improvement. . SidewalkS are shown on the south side of is? Avenue, the east side of Edison Street, and the south side of is? Lane. Bituminous trails are shown along both sides of County Highway 40. D. Miscellaneous . A street lighting plan is shown with approximate locations of street lights to be installed. This. plan will need to be reviewed and implemented by the Elk River Municipal Utilities. . If the project does require any wetland impacts, they will need to apply for the above mentioned permit. The City of Elk River Heritage Preservation Commission reviewed the proposed prato There are no known State Historic Preservation Office (SHPO) sites on the affected property; however, the City's archaeological model shows the site to be moderate to high as a potential archaeological site. The HPC recommends the following condition: "Any item or condition found that indicates the site is likely to yield information important to prehistory or history shall be reported to the city immediately. The right of way along CH 40 is 50 feet a'nd has been satisfied with Sherburne County Right of Way Plat No. 30. The proposed 18th Avenue access to CSAH 40 has been approved in the proximity indicated on the drawing. If trails are proposed or planned within or adjacent to County Highway right of way, ten additional feet are required. To minimize noise and fast traffic complaints, we recommend increasing the required building setback from the county highway. This proposed 187th Avenue access and required right turn lane have not been incorporated into the CH 40 construction plans and are not scheduled to be constructed. The grading operation for the construction is under way and will be 95% completed this fall. It is possible to incorporate the construction of this right turn lane into our project, if the developer agrees to compensate the County for the necessary additional work and materials. Engineering staff determined the estimated costs for the additional work and materials, including restoration (based on the contract bid price) to be $9200. If the developer chooses this option, he must field locate the access point of 187th Avenue. We ' must receive notification and payment of $9200, before the contractor reapplies the topsoil. The County will then construct the additional length and width necessary for the right turn lane as part of the road project. Our work will include the class 5 gravel base, the bituminous and restoration. . If payment is not received, the developer will be required to construct the right turn lane when the proposed 187th Avenue> access is constructed. The developer will also be required to account for drainage; if a culvert is necessary, it must be RCP with a minimum 18" diameter and be installed with 1:6 safety aprons and grates. The access must have 40' radii and an access permit and signage fees are required with either scenario. Pavement marking and correction to incorporate the right turn lane will be necessary. Based upon our initial'review, the m~jor issues we see are as follows: 1. The storm drainage system to service this area needs to be designed with an ultimate outlet. 2. Currently, there is no sewer and water available to service this site. In order to approve this development, it will be necessary to document that sanitary sewer and water service will be available from the River Park development. 3. Sherburne County is likely to require a right turn lane and bypass lane at the entrance onto County Highway 40. Since this road is currently under construction, the developers should work with Sherburne County to get these necessary improvements included in the County project and simply paid for by the developers of Preserve Ponds. 4. It will be a condition of the plat that the developers continue the lo-foot wide bituminous trail adjacent to County Highway 40 along the length of their plat on both sides of County Highway 40. This will require a separate trail easement to be granted to the City after recording of the plat. These are the major issues that we see upon our initial review of the submittal. As we review the information in a more detailed fashion, I'm sure there will be other more minor issues to be addressed by the developer.
