Also being requested is a classic car restoration facility, both of which are allowed as Conditional Uses in the C-3 zoning district. As the City Council may recall, the applicant received an Interim Use Permit to sell cars at a location approximately a quarter mile west of the subject property. If granted approval for a Conditional Use Permit at the subject site, the applicant will voluntarily request that the Interim Use Permit at 13479 Business Center Drive be revoked six weeks after a Certificate of Occupancy is issued at the new site. The applicant is not proposing any building modifications at this time other than general cleaning and maintenance. It appears that a portion of the roof has been painted, and staff recommends that the remainder of the roof and building be painted. The applicant is proposing outdoor storage for trailers and equipment in the proposed privacy / security fencing on the south side of the building. The C-3 zoning district does not allow outdoor storage. S:\PLANNING\Case Files\2006\CUP\CU 06-28 Matthews\CU 06-28_CC.doc Case File: CU 06-28 Page 3 Five (5) signs are being proposed: three (3) business wall signs, one on the north, south, and east sides of the building and two (2) freestanding signs placed at the north and east entrances. This is consistent with the ordinance. The hours of operation will be 9 a.m. to 5 p.m. Monday through Friday and Saturdays by appointment only. The number of employees is anticipated to be two employees. Staff is recommending that advertising on the vehicles shall be limited to one sign per vehicle not exceeding 94 square inches. No signage and/ or decorations of any type, such as but not limited to, banners, pennants, festoons, painted windows and balloons shall be allowed on the vehicles. Parking and Circulation The proposed circulation consists of a one-way drive lane around the north and east sides of the existing building. The site is being improved with paving and concrete curb and gutter. One-way directional signage is being proposed. The parking stalls along the north and east property lines will be dedicated to for-sale vehicles. The four stalls on the west side of the building are for customer parking. The proposed plan meets the requirements for parking. The for-sale vehicles will be delivered to the site under their own power and will not be brought in on a tractor trailer semi. Per the City ordinance, all vehicles shall be parked on an approved surface (not landscaped areas) within the property per setback requirements. No vehicles shall be parked in the public right-of-way or on sidewalks. Landscaping The landscape plan indicates 18 trees: 9 overstory, 6 ornamental, 3 conifers which does not meet the required amount of trees for the site. A total of 24 trees are required, and staff recommends that that the over story trees be located along the eastern property line. This will help screen the building from the park yet still provide visibility to the vehicles under the canopy. Staff would also recommend that the six conifers be located along the southern property line. See Staff Exhibit "A". The landscape plan does not indicate what the "yard" areas are to be, staff recommends that turf be established and be irrigated as required by ordinance. Grading. Drainage and Utilities Grading, Drainage and Utilities are addressed in the City Engineer's memo. Will be served adequatelY ry and will not adverselY tiffect essential public facilities and services including streets, police and fire protection, drainage, refuse disposal, water and sewer !)Istems, parks and schools; and will not, in particular, create trqfjic congestion or inteiference with trqfjic on acfjacent and neighboringpublic thoroughfares. 5. Will not involve uses, activities, processes, materials, equipment and conditions if operation that will be detrimental to a'!Y persons or property because if excessive trqfjic, noise, smoke, fumes, glare, odors, dust or vibrations. 6. Will not result in the destruction, loss or damage if a natural, scenic or historic feature if mqjor importance. 7. Will fullY complY with all other requirements if this Code, including a'!Y applicable requirements and standards for the issuance if a license or permit to establish and operate the proposed use in the ciry. If denial of such a permit should occur, it shall accompany recommendations or determinations by findings or a report stating how the proposed use does not comply with the standards set forth in Section 30-654. Planning Commission The meaning of outdoor storage was the key issue discussed at the meeting. The applicant is proposing an area of privacy fencing for the secured temporary outdoor parking of customer's classic cars. Staff had indicated at a staff meeting with the applicant that this would be considered outdoor storage and staff would recommend that it not be allowed. The Planning Commission discussed the meaning of outdoor storage but made no motion regarding it. Noone spoke at the public hearing. The Planning Commission recommended approval of the request. Recommendation Staff and the Planning Commission recommend the City Council approve the request with the following conditions: 1. All comments of the City Engineer shall be addressed. 2. The building shall meet all applicable building codes. 3. The building shall meet all applicable fire codes. 4. All vehicles shall be parked on an approved surface (not landscaped areas) within the property per setback requirements. 5. No vehicles shall be parked in the public right-of-way or on sidewalks. 6. No outdoor storage shall be allowed. 7. All vehicle maintenance and/or restoration shall occur within the building. 8. Trees shall be planted on the property, as indicated on Staff Exhibit "A". 9. The plan set we reviewed had a revision date of October 27, 2006. Based on our review, we would offer the following comments: 1. The internal layout of the diagonal parking and driving aisle has been modified to provide the necessary 20-foot clearance between the building and parking stalls for emergency vehicle access. 2. Although dimensions are not detailed on the site plan drawing, it appears that additional street easement for Hudson Street can be provided and still meet the required setbacks for parking on the site. The drawing should detail these dimensions and an easement for street, utility and drainage purposes over the area provided for Hudson Street paving, and 10 - 15 feet outside of the paved area for snow storage and small utilities should be provided. 3 . We have received storm drainage calculations and they appear to adequate. 4. We have received a report indicating that the existing septic system on the site is adequate. 5. It appears from the site plan that less that one acre will be disturbed; therefore, the site will not be required to obtain a NPDES permit. However, the site should still be required to follow the City's standard Storm Water Pollution Prevention Plan (SWPPP) requirements. Silt fence is shown around the perimeter of the majority of the work area. There are two openings in the silt fence; one up near the frontage road and one near Hudson Street. Only one construction access should be provided. One of these openings needs to be closed or if two are necessary for logistics of the construction operation, then an additional rock driveway needs to be provided. In the southwest comer of the site there is storm drainage off the lot from the proposed pond to the existing storm sewer system, and there is grading contour shown off the site. These are outside of the silt fence area. These need to be enclosed with silt fence for . . erOSIOn protectIon. There is a note on the plan sheet that indicates all exposed soils area to be seeded, mulched and fertilized within seven days. The pond area needs to be stabilized using a seeding blanket, given the slopes of the area. This note should be shown on the plans with delineation of the area to be blanketed. I am requesting a conditional use permit for used car retail and classic car restoration shop at 13342 Highway 10. This property is Zoned C3 and the request is a permitted use for this location according to city zoning laws. Included in the request and with the approval of this request I am also requesting the revocation of the temporary use permit granted to me for used car sales at the Elk River Tower Crossings Center. Included in this request is a site plan which I will outline here. I am requesting a minimum of 25 retail spaces for late model and classic used cars as well as the required amount of parking for customer, employee, and handicapped according to the city statues. All parking lot area will be compliant with the cities standards of pavement, curb and gutter. I am also including the plan for full landscaping complicit with the cities requirements. The proposed screening will consist of the required amount of shrubs, conifers and over story trees. I have also made provision for water drainage and a storage pond area. Our goal is to bring the appearance ofthe property up to an acceptable level that will change the perception of the property from that of an eyesore to that of a prosperous thriving business. We desire it to be a good representation of us as well as our growing city. At this time we aren't proposing any outside changes to the building other than clean up, painting, repair of broken window panes, patching holes in outside walls and installation of the requested wall signs. I am not requesting any outdoor storage as this zoning doesn't allow that, however I have included an area of privacy fencing for the secured temporary outdoor parking of customer's classic cars. This area is necessary for the classic car restoration shop because of the nature of the business. There are times when a vehicle is waiting for parts to complete and therefore it is better to utilize indoor space for other productive work and not used for stationary vehicles. Our timeline on stationary vehicles typically isn't any longer than a few weeks. The secure fence helps our property look nicer and also helps in "security". We do have an off site parking location for long term project parking; however, it is in another city so it's unpractical to be used for the temporary purpose I am proposing in this fence. This on site fenced area will not be used for long term parking. According to the Floor plan diagram the front portion of the building will be used for the car sales business as well as the outdoor retail spaces. The middle and back of the building will be used for the classic car restoration shop. Since we are a family owned and run business there is only one employee. Our hours of operation for the auto sales and classic car restoration shop will be the standard 9:00 a.m. to 5:00 p.m. Monday through Friday. With auto sales by appointment only on Sat. I am excited to be working with the city on this project and to be able to find an actual long term location for my growing business.
