RES 06-126 . . . RESOLUTION 06- 126 CITY OF ELK RIVER SHERBURNE COUNTY STATE OF MINNESOTA Council member Gumphrey introduced the following resolution and moved its adoption: RESOLUTION OF THE CITY COUNCIL OF ELK RIVER FINDING THAT THE SHERBURNE COUNTY HOUSING AND REDEVELOPMENT AUTHORITY'S REDEVELOPMENT PROGRAM FOR REDEVELOPMENT DISTRICT NO. 2 AND PROJECT PLAN FOR THE TECHNOLOGY CENTER CONFORM TO THE GENERAL PLANS FOR THE DEVELOPMENT AND REDEVELOPMENT OF THE CITY OF ELK RIVER. BE IT RESOLVED by the City Council (the "Council") of the City of Elk River, Minnesota (the "City"), as follows: WHEREAS, the Housing and Redevelopment Authority for Sherburne County, Minnesota, (the "County HRA") has proposed to adopt a Redevelopment Program for Redevelopment District No.2 and a Project Plan for the Technology Center therefore and has submitted the Program and Plan to the Elk River City Planning Commission pursuant to Minnesota Statutes, Section 469.002, Subd. 14, 16 and 22, and 469.027 Section 1. Recitals. 1.01. The County HRA has proposed to adopt the Redevelopment Program for Redevelopment District No.2 (the "Redevelopment Program") and a Project Plan for the Technology Center (the "Project Plan") therefore (the Redevelopment Program and the Project Plan are referred to collectively herein as the "Program and Plan") and has submitted the Program and Plan to the Council pursuant to Minnesota Statutes Chapter 469, and Section 469.002, Subd. 14, 16 and 22, and 469.028 all inclusive, as amended and presented for the Council's consideration. 1.02. The City has investigated the facts relating to the Program and Plan and has reviewed the Program and Plan as prepared by the County HRA. 1.03. The City has performed all actions required by law to be performed prior to the approval of the proposed Program and Plan, including, but not limited to, a review of and written comment on the Program and Plan by the City Planning Commission. Section 2. Findings for the Adoption and Approval of the Program and Plan. 2.01. The Council hereby finds that the Program and Plan, are intended and, in the judgment of this Council, the effect of such actions will be, to provide an impetus for development in the public interest and accomplish certain objectives as specified in the Program and Plan, which are hereby incorporated herein. The findings of the Council in the Program and Plan are based on various studies, reports and facts available to the Council and are neither arbitrary nor unreasonable. . . . Section 3. Findings for the Approval of the Sherburne County lIRA's Redevelopment District No. 1 and Proiect Plan. 3.01. The Council hereby fmds that the Program and Plan are in the public interest and are a furtherance of the public health, safety and welfare. 3.02. The Council further fmds that the proposed development will afford maximum opportunity consistent with the sound needs of the City as a whole, for the development of the Technology Center by private enterprise as set forth in Exhibit A. 3.03. The Council further finds, declares and determines that the City made the above fmdings stated in this Section and has set forth the reasons and supporting facts for each determination in writing, attached hereto as Exhibit A. The Council has reviewed the attached Exhibit A and fmds it to be accurate, correct and in the best interest of the health, safety and welfare of the City. Section 4. Public Purpose 4.01. The adoption of the Program and Plan conforms in all respects to the requirements of Minnesota Statutes 469.027 and 469.028, subd. 2, and will help fulfill a need to develop an areaofthe City, to provide employment opportunities, to improve the tax base and to improve the general economy of the State and thereby serves a public purpose. Section 5. Approval and Adoption of the Program and Plan. 5.01. The Program and Plan, as presented to the Council on this date, including without limitation the fmdings and statements of objectives contained therein, are hereby reviewed and approved, and shall be placed on file in the office of the Sherburne County lIRA. EXHIBIT A RESOLUTION NO. 06-126 The reasons and facts supporting the findings for the approval of the Sherburne County HRA Redevelopment Plan for Redevelopment District No.1 and the Project Plan for the Technology Center, as required pursuant to the applicable Minnesota Statutes, Section 469.027 and 469.028, Subdivision 2 are as follows: 1. Finding that the Redevelopment District No.1 and the Project Planfor the Technology Center coriforms to the general plan for the development or redevelopment of the municipality as a whole. The Planning Commission reviewed the Plan on November 14,2006, and found that the Plan conforms to the general development plan of the City and is consistent with the City's Comprehensive Plan. 2. Finding that Redevelopment District No. 1 and the Project Plan for the Technology Center will afford maximum opportunity, consistent with the sound needs of the City as a whole, for the development or redevelopment of Redevelopment District No. 1 by private enterprise. The Redevelopment District No.1 and the Project Plan for the Technology Center will result in increased employment in the City and the State of Minnesota, an increased tax base of the State, and add a high quality development to the City.
