That feasibility study has now been completed. Discussion An informational meeting was held with the residents of the Deerfield 3rd Addition on December 5, 2006. In the feasibility study's appendix is the informational meeting presentation, a sign-up sheet of property owners, and minutes of the informational meeting. As you might expect, the biggest issue at the information meeting was whether or not sidewalks are needed on all streets and where they would be located. This will be a controversial issue in this development, given the topography of the area. Since many of the driveways are relatively steep, a sidewalk cannot be placed on some sides of the road because it makes already steep driveways unbearably steep. There was also some discussion regarding the original construction of the Deerfield 3rd Addition and the problems dealt with over the years with the original developer. The next step in proceeding with this project would be to accept the feasibility study and order the public hearing. The attached resolution orders the public hearing to be held on January 16, 2007. Financial Impact As with previous street reconstruction projects, the City will have a significant contribution to the cost of the street and storm drainage. Due to the fact that the original construction of the Deerfield 3rd Addition did not have a significant storm sewer component so that the storm sewer system will need to be built with the street reconstruction and the fact that the native soils will require a i-foot sub cut and sand fill replacement, approximately 75 percent of the cost will be funded by the City. The feasibility study recommends an assessment rate of $6,650 per residential lot. A reasonable estimate of the impact of the assessment will be available at the hearing. 2. A fublic hearing shall be held before the City Council on the proposed improvement on the 16 day of January, 2007, at 6:30 o'clock p.m. at the Elk River City Hall Council Chambers. The City Clerk shall provide two published notices (one week apart) in the official newspaper with at least three days between the last publication date and the hearing, and mailed notice ten days to the hearing as required by law. INTRODUCTION On October 2, 2006 the City Council adopted Resolution 06-115 .ordering the feasibility study for the 2007 Deerfield 3rd Addition Reconstruction Project. The area to be included in the project includes all of the streets originally platted as Deerfield 3rd Addition in 1986 and is shown in Exhibit 1. The proposed 2007 Deerfield 3rd Addition Reconstruction Project includes the reconstruction of streets, sidewalks, and storm drainage facilities. The streets included in the proposed project are listed below: Dod e Street 190th Court 189th Avenue Elk Lane Baldwin Street 190th Avenue 191 st Avenue Xavier Street 192nd Avenue 192nd Court 192nd Lane Yale Street Zane Street 192nd Avenue II. PROJECT SCOPE 189th Avenue Dod e Street Dod e Street 189th Avenue Elk Lane Baldwin Street Zane Street 191 st Street Xavier Street Xavier Street Xavier Street 193rd Avenue 193rd Avenue Dod e Street The purpose of this study is to analyze the reconstruction of the proposed streets included in the 2007 Deerfield 3rd Addition Reconstruction Project. In addition, existing sanitary sewer, water, and storm sewer systems will be evaluated to determine the necessity for improvements. The study will discuss the existing conditions, proposed improvements, estimated construction costs, and overhead costs which include city administration, engineering, fiscal, and legal expenses. Past City practices on similar types of projects will be used as a guideline to discuss financing methods for the proposed improvement. III. NECESSITY AND COST-EFFECTIVENESS The improvements proposed in this study are necessary for a number of reasons. The reconstruction of the streets is a cost-effective means of continuing the City's proactive street efforts and ensuring an adequate means of transportation for the residents. In addition to rehabilitating street pavement, a total street reconstruction will allow for correction of existing drainage problems through the construction of concrete curb and 1 I I I I I I I I I I I I I I I I I I I gutter, modifying street grades, and the installation of an improved storm sewer collection system. The proposed improvements will provide a project large enough to ensure a competitive bidding environment and therefore will be cost-effective. Based on the information contained within this report, the proposed improvements are necessary, cost-effective, and feasible from an engineering standpoint. IV. EXISTING CONDITIONS Street Below is a table summarizing the existing conditions including information regarding street length, width, curb & gutter, and sidewalk. Twenty two soil borings were taken at depths from four to ten feet on throughout the study area. The soils encountered below the existing street section were mainly glacial till soils consisting of silty sands susceptible to moisture variations. The geotechnical report is provided in Appendix A. each street block of the project. The soil borings indicated between 2-inches and 8- inches of existing bituminous and between 3-inches and 7-inches of aggregate base material 2 I I I I I I I I I I I I I I I I I I I Sanitary Sewer Within the area affected by the 2007 Deerfield 3rd Addition Reconstruction Project 8- inch sanitary sewer is located on all the streets with the exception of 189th Avenue, Baldwin Street, 191 st Avenue, and Xavier Street where 10-inch sewer pipe exists. The existing sanitary sewer consists of PVC pipe. The existing sanitary sewer system is shown on Exhibit 2. . Watermain Existing watermain is located throughout the project area consisting of 6, 8, and 10-inch pipe. Dodge Street, 190th Court, Elk Lane, 190th Avenue, 192nd Avenue, 192nd Court, 192nd Lane, Yale Street, and Zane Street were constructed with 6-inch watermain. The remaining streets within the project including 189th Avenue, Baldwin Street, 191 st Avenue, and Xavier Street were constructed using 10-inch watermain with the exception of 192nd Avenue which was constructed with 8-inch watermain. The existing watermain is shown on Exhibit 3. Storm Sewer There is currently storm sewer located in many areas throughout the project, but. it consists of what would be found in a rural area. Most of the storm sewer lines simply convey overland stormwater flow through the existing streets from swales and low areas. The main storm sewer line is located on 191 st Avenue. The 36-inch storm sewer line begins in the adjacent lots along 191st Avenue between Zane and Yale Streets and drains portions of 192ND Avenue east of Baldwin Street, Zane Street, Yale Street, Xavier Street, and 192nd Lane. It continues along 191 st Avenue to Xavier Street where it turns to the southeast along a side lot line which eventually conveys the stormwater into a regional pond. This storm sewer line was constructed by the City after Deerfield 3rd Addition was developed in response to drainage concerns. The stormwater along 192nd Avenue from Baldwin Street drains west across Dodge Street. The portion of 192nd Avenue east of Baldwin drains to a series of catch basins located just to the west of Zane Street that outlet into adjacent lots. Dodge Street within the project area drains to the south past 189th Avenue. 190th Court drains east into the cul-de-sac from Dodge Street and then through storm sewer into the adjacent lots. The water then flows overland to an inlet eventually crossing 189th Avenue. The catch basins on 189th Avenue collect street drainage from portions of Baldwin Street, Elk Lane, and 189th Avenue. The stormwater eventually drains south to a pond located in the rear of the southwest corner lot on 189th Avenue and Elk Lane. The stormwater along the north half of Baldwin Street flows south to a set of catch basins which outlet into adjacent lots to the southeast. The stormwater drainage along 192nd Avenue from Xavier Street drains to the east into a catch basin which outlets into an adjacent property. Drainage along 192nd Court also flows east into a catch basin and outlets onto an adjacent property. The existing storm sewer is shown as Exhibit 4. 3 I I I I I I I I I I I I I I I I I I I Existinq Private Utilities Private utilities that have facilities in or near the project area will be notified of the project and requested to incorporate repairs and replacements with the project as needed at their cost. Private utilities include Elk River Municipal Utilities, Qwest, Center Point Energy, Charter Communications, Great River Energy, Northern Natural Gas, Northstar Access, and Sherburne Telephone Systems. V. PROPOSED IMPROVEMENTS The proposed improvements for the 2007 Deerfield 3rd Addition Reconstruction Project include street and storm sewer construction. A detailed description of each proposed improvement is provided below. Street The proposed typical section for the streets in this project will be in accordance with the section adopted as part of the Pavement Rehabilitation Report with the exception of the aggregate base thickness. The proposed street section consists of a 28 to 32 foot wide street with concrete curb and gutter. The section generally mimics the existing pavement width plus the width of the proposed curb and gutter. One exception to the section listed above is Dodge Street where the width of the existing street will be retained. The proposed pavement and subgrade materials for all the streets consists of 12 inches of select granular borrow, 8 inches of Class 5 aggregate base, 2 inches of bituminous base course, and 1.5 inches of bituminous wear course. The proposed street section has been verified by a geotechnical investigation. The geotechnical evaluation performed by Independent Testing Technologies concluded that a 12-inch subcut of the existing silty sand will be necessary to achieve a 9-ton design. The material within the subcut area will be replaced with 12 inches of select granular borrow. The proposed street section is shown in Exhibit 6. In accordance with City Council direction to construct pedestrian facilities with new street construction, the proposed improvements also include a 6-foot wide sidewalk located on one side of each of the streets within the reconstruction area. With a 32-foot street width there are numerous locations where retaining walls will be required in order for the proposed sidewalk to fit adequately with existing grades. A 28-foot street section was also considered which alleviates some potential retaining wall locations. During final design, locations where sidewalk may not be feasible will be considered further. With the proposed sidewalk improvements, a connection to an existing sidewalk location will be made at Dodge Street. Proposed street and sidewalk locations are shown in Exhibit 7. As with the previous street reconstruction projects, the 2007 Deerfield 3rd Addition Reconstruction Project proposes to have Elk River Municipal Utilities install decorative street lights in accordance with their lighting policy as part of the project. 4 I I I I I I I I I I I I I I I I I I I Sanitary Sewer The sanitary sewer within the project area will be televised to determine the extent that repairs or replacement would be necessary. A review of the Closed Circuit Televised Sewer Inspection Report is expected to show that the existing system will not need any repairs at this time. The report will also be discussed with Mr. Gary Leirmoe, Chief Operator. The existing sanitary sewer is shown in Exhibit 2. Watermain Proposed watermain improvements were discussed with Mr. Bryan Adams, General Manager of Elk River Municipal Utilities (ERMU). There does not seem to be a need to perform any watermain improvements at this time although there may be some hydrant relocations performed to allow for sidewalk placement. Storm Sewer A review of the drainage patterns and pavement conditions reveal that many locations do not currently drain runoff effectively and has contributed to the significant deterioration of the pavements. Replacement and addition of curb and gutter, sUght grade revisions, and storm sewer extensions are needed to facilitate suitable drainage patterns. Additional storm sewer is proposed along all of the streets within the project area. All of the bituminous flumes and drainage across streets to adjacent lots will be eliminated with the addition of concrete curb and gutter. By in large, all stormwater reaching the streets will flow into catch basins. Additional catch basin locations will also help alleviate drainage problems. The existing storm sewer outlets on 1891h Avenue and 19151 Avenue will remain due to their connection to existing ponding areas. Much of the proposed storm sewer will connect into these locations. The proposed storm sewer improvements are shown in Exhibit 5. VI. RIGHT-OF-WAY, EASEMENTS, AND PERMITS Riaht-of Way and Easements No right-of-way will need to be acquired for the street improvements. Temporary construction easements may be required throughout the project area to accommodate driveway repair, water service replacement, and/or finished grading. Verbal permission will be secured from private property owners during the construction process should work need to be completed on private property. Permits Several permits will be required prior to construction of the proposed improvements. INFORMATIONAL HEARING An informational hearing was held on December 5, 2006 with the affected property owners. The project was discussed and residents were encouraged to voice their concerns and to ask questions. Approximately 31 of the 190 properties notified for the informational meeting were in attendance. The major issue appeared to be whether or not to include sidewalks. A walk through will be scheduled with the residents prior to construction. Appendix B describes the informational hearing in more detail including minutes and the signup sheet. VIII. ESTIMATED PROJECT COST The estimated construction costs and associated overhead costs for the proposed improvements are summarized in Table 1. Based on past experiences on similar projects in the City, the overhead costs have been estimated at 28% of the total construction cost. The overhead costs include city administration, engineering design, fiscal, and legal costs. FINANCING AND ASSESSMENTS The improvements discussed in this report are proposed to be financed through a number of different methods. Benefiting properties would be assessed on a per unit basis for street, curb and gutter, sidewalks, and storm sewer. A residential lot that could not be further subdivided would be assessed as one unit. Lots that can be subdivided would be assessed as multiple units as appropriate. The number of assessable units is approximately 190, as shown on Exhibit 8. In accordance with the adopted Pavement Rehabilitation Report, the proposed assessment is $6,650.00 per unit. The total assessment amount would then be $1,263,500. Based on the estimated total project cost of $4,730,500, and total assessments of $1,263,500, the remaining project cost to be funding by the City is $3,467,000. 6 I I I I I I I I I I I I I I I I I I I X. CONCLUSION The total estimated project cost for street, storm sewer, and watermain including overhead costs is $4,730,500. The project is necessary and cost-effective. As previously stated, this cost will be financed through a combination of assessments to benefiting properties, Elk River Municipal Utilities funds, and City Street Reserve funds. The project will consist of bituminous street reconstruction with curb and gutter and some storm sewer improvements. Some water main will also be replaced. In accordance with your 'written authorization, we have conducted a subsurface exploration program for the proposed proj ect. Scope of Services: Our authorized scope of services included the following: 1. To investigate the subsurface soil and water conditions encountered at nventy-two (22) split-spoon soil boring locations. The boring depths were planned to be 4 to 10 feet at each location. The approximate locations are shown on the boring location plan in Appendix 1. To provide a report of our findings including the results of our subsurface investigation and recommendations regarding earthwork, fill and compaction, utility installation, subgrade preparation, and a design R-value for pavement design. General Site Conditions: The proposed project site is located in an existing residential neighborhood east of US Highway 169, North of 189th Avenue NW and south of 192nd Lane NW in the City of Elk River. The existing residential streets are bituminous surfaced with no curb and gutter. The site is gently rolling with slopes of 6-12 percent. The streets _ throughout the neighborhood are generally showing their age with distress cracking common. Available Subsurface Information: According to the Geologic Map of Minnesota, Quaternary Geology, prepared by Howard C. Hobbs and Joseph E. Goebel (1982, Minnesota Geological Survey), this site lies within an end moraine of the Pine City Moraine association. It is associated with the Des Moines Lobe glaciation of Pleistocene, Late Wisconsinan age. The till of this moraine consists of grey, calcareous drift with shale and limestone clasts derived from parent material in Manitoba and eastern North Dakota, but is often mixed with reddish till incorporated from the underlying Superior Lobe. According to the Soil Survey of Sherburne County prepared by the Soil Conservation Service, this site lies within the Hayden-Braham-Emmert Soil Association. These consist of undulating to steep soils over limy, grey glacial till mixed with red till or gravel or capped with fine sand. B~ ~xplo~ati~~_ ?_,:"~g~a~ Twenty-two (22) split-spoon soil borings were conducted on this project. The borings were advanced to depths of 4 to 10 feet using a 3 1/4 inch I.D. hollow stem auger. Samples were obtained every 2 1/2 feet using a 2-inch O.D. split-spoon sampler in accordance with the American-Sodety foyTestingana Matenals (ASTM Dt586): Stafiaafd"penetratloli" values ---- (N-values) were obtained at each sample interval by driving the sampler into the soil using a 140-pound hammer falling 30 inches. After an initial set of 6 inches, the number of blows required to drive the sampler 12 inches is known as the standard penetration resistance or N- value. Where the sampler can not be driven-at least 6 inches by 50 blows of the hammer, the total number of blows as well as the distance driven is reported on the boring logs. __ Groundwater levels were noted during drilling and immediately after completion. The holes were backfilled with the auger cuttings and patched with bituminous cold patch. Some settlement of the bore holes may be expected. All of the borings were conducted with a truck mounted rig. The boring locations were staked by us. Exploration Results: All of the borings were conducted on existing bituminous paved streets. The borings encountered bituminous to depths of2.0 to 4.5 inches and aggregate base to depths of3.0 to 7.0 inches. The bituminous depth was 8.0 inches in boring B-16, which was an area that had been overlaid. Below the pavement, the borings generally encountered fine to medium grained silty sand (SM) glacial till soils. Borings B-1, B-7, B-8, B-I0, B-20 and B-21 encountered outwash SCll1<fS_ _c?ns~st~~_?f ~ltle ~~~~d~_ p~?~ly waded _ san~ ~~~. silt (S~~_S~! "an~ c~eaIl~po~~ly graded sand (SP) to termination. Boring B-1 encountered some silt layers :from 4 feet to 5 feet. Boring B-14 encountered silty-clayey sand (Se-SM) to termination. Boring B-16 encountered silty-clayey sand (SC-SM) to 7.0 feet, followed by silt (ML) to 10 feet and silty sand (SM) to termination. Boring B-18 encountered clayey sand (SC) to termination. Most of the soil encountered in the shallow borings was likely fill. No organic soils or other unsuitable material was encountered. Penetration Test Results: . The blow counts in the sand soils ranged from 3 to 29, which are low to high, indicating they are in a loose to very dense condition. Refusal of the spoon or auger did not occur in any of the borings and the drilling was relatively easy in the all of the borings. Water Level Observations: . __ __u.u. _ _ __ _ __ ____ _._ _ ____ __ _ _ _______ Observations of the subsurface water conditions were made during drilling operations. Groundwater was not encountered in any of the borings during drilling. Although the water levels were observed over a short period of time, we feel they are an accurate representation of the water levels on this site at the time of our exploration because of their high permeability. It should be noted that fluctuations in the level of the groundwater can occur due to variations in rainfall, temperature, spring thaw and other factors not evident at the time of our investigation. Mottled soils were not observed. Mottled soils are a historical indication of a temporarily or seasonally saturated soil condition. Grey soils were also not observed. Grey soils are an indication of a permanently saturated soil condition. Engineering Review Discussion: Based on our [mdings, this site appears to be well suited for the proposed street reconstruction. The existing soils on this site are suitable for support of the utility pipes and structures. The sand soils encountered on this site consisting of silty sand and clayey sand (SM, SC-SM, SC) are fair for bituminous pavement support. These soils can often be wet, especially during wet periods of the year. These soils may require drying or mixing to reach optimum moisture for sub grade preparation. We recommend the pavement section include a layer of select granular borrow between the subgrade and aggregate base to aid in construction and internal drainage. In addition, subsurface drain tile should be installed in sumps and low areas to drain the granular layer away from the subgrade soils. D. Recommendations The following recommendations are based on our understanding of the proposed project. If our understanding of the project is not accurate or if-changes are-made-to-the-prujectscope, please inform us so that our recommendations can be amended, if necessary. We have included recommendations regarding earthwork and construction that may help in cost estimates and aid in design. We should be allowed to review the proposed construction plans to provide further detailed recommendations, if necessary. Without the opportunity to review the final construction plans, the recommendations made in this report may no longer be valid. Utility Installation: We recommend that all utility pipes lay in non-organic mineral soils capable of supporting the pipes. Excessive over-excavation beneath the pipes should be avoided. We recommend that 2 to 6 inches of granular bedding material be placed and compacted around the pipe to aid in aligning the sanitary sewer pipe for line and grade. Compaction should be done very carefully by hand to prevent the pipe from shifting. We recommend that the backfill be compacted with a static sheep's foot roller after the backfIll is 2 feet above the top of the pipe. Vibratory compaction should only be used on clean sands or silty sands at or below optimum moisture. We recommend that excavations slope at a 1.5:1 (horizontal: vertical) ratio from the bottom of the excavation to the surface. Stockpiled material should be kept at least 2 feet from the edge of the excavation. This is the minimum required by OSHA. We recommend all construction vehicles be kept at least 5 feet from the edge of the excavation. An escape ladder should be provided at all times while workers are in the excavation. All excavations must meet OSHA standards (29 CFR1926). Earthwork: We recommend that any unsuitable, uncompacted, or unstable soils exposed during construction be removed from beneath the proposed utility structures and street section. In addition, we recommend that any excavation below a utility structure or street section be oversized one foot for every foot of fIll placed to reach planned grade (1: lover sizing). Structural Fill: The onsite soils consisting of silty sand (SM) and silty clayey sands (SC-SM) are considered fair material for use as street sub grade material. These soils are somewhat susceptible to moisture variations and would need to be dried or mixed if they become wet prior to compaction. In addition, they will likely have moisture contents above optimum for compaction and will require drying or mixing to reach optimum moisture for compaction, even in their natural state. No organic soils, roots, stumps, logs, brush, etc. should be used as structural fill below any utility structure or pavement section. We recommend that all fill and utility trench backfill material be free of soft, wet or frozen soils, highly expansive soils, rubble, debris and rocks in excess of 6 inches in diameter. The fill and utility trench backfill material should be as uniform as possible both in composition and moisture content. We recommend that all fill and utility trench backfill material be placed in 12-inchloose lifts and compacted to a minimum of 95% of standard proctor maximum density (ASlM ----- ...--...-.---------. -- ------.-------.-------...-.---.-...----.--- --------------.---- -------.- - -.---- ---" D698). Any fill placed in the top 3 feet of the road subgrade should be compacted to at least 100% of standard proctor maximum density. All fill and utility trench backfill material should be compacted at a moisture content within plus or minus 2% of the optimum moisture as determined by a standard proctor. We recommend compaction tests be taken at a minimum rate of one test per two feet of fill per 200 linear feet of the utility trench backfill, roadway sub grade, and aggregate base material. E. Pavement Recommendations The majority of the expected subgrade soils in the Deerfield 3rd Addition consist of silty sands (SM) and silty- clayey sands (Se-SM). These soils are classified as A-2-4 soils in accordance with the American Association of State Highway Transportation Officials (AASHTO) classification system. A-2-4 soils are rated as fair material for use as roadway subgrade material. Without benefit of a laboratory R-value determination and based on Mn/DOT guidelines, an R-value of30 can be assumed for the onsite soils. The native, undisturbed soils may need preparation (drying and compacting) to pass a proof roll. If the subgrade is not compacted, uniform and capable of passing a test roll, then we recommend the subgrade be scarified and recompacted or sub cut and geotextile fabric placed along with select granular material meeting Mn!DOT specification 3149. The top of sub grade should be compacted to a ~_l!_lll_~~.!~O_~of.~t~~ard.pr()~tor_I?~~!Il.~~~s~o/..._ .._ _.___... n.n _._ _.._..___ The subgrade should be sloped towards the edges to provide drainage. We recommend installing subsurface drain tile in the granular layer to aid in drainage. We recommend the drain tile consist of a 4-inch perforated pvc pipe wrapped in filter fabric (sock type). The drain tile should be installed in the granular borrow behind the curb. We can note that our crew did not detect any obvious contamination by sight or smell during drilling operations. However, human senses are limited in terms of contamination detection and, therefore, the lack of detection through human sensing does not preclude the possibility of the presence of contamination of the site. This report represents the result of our subsurface investigation and is based on information gathered at specific locations. Subsurface conditions can change a great deal over short horizontal distances. Also, the actual interface between strata will likely be a gradual transition rather than an abrupt change as represented on the boring logs. Geotechnical engineering is based extensively on opinion. Therefore, the data contained in this report should be used as a guide, and we recommend that construction monitoring be performed by a qualified geotechnical engineer or technician. Attendees See Attached Sign-up Sheet 2. Presentation City Engineer T eny Maurer went through the attached PowerPoint presentation. He indicated that the project being discussed this evening is the reconstruction of roadways within the Deerfield 3rd Addition. Together with the reconstruction, street lights and a storm sewer system would be built. Also, sidewalks are being considered as part of the reconstruction project. 3. Questions and Answers After the presentation. WaS complete, the informational meeting was open to questions. The following is a summary of the questions asked and the answers given: Q: There seems to be a substantial amount of parking in areas of the neighborhood, especially along Baldwin Street. How will this be handled; will there be any restrictions with the new street? A: Generally, the City's practice is to not regulate parking unless it becomes a problem. Periodic parking along the street will generally not pose a situation where parking will need to be regulated. Q: I see the sidewalk thickness is 4 inches and the pavement on the road is only 3 ~ inches thick. Why would the street only be this thick, when the sidewalk is 4 inches? A: The street strength is provided by both the bituminous pavement thickness and the gravel thickness. Since gravel is readily available and generally much cheaper in the City of Elk River, we t1y to find the best fit for the combination of gravel base and bituminous surfacing to meet a 9-ton design. Q: Are sidewalks up to the. City Council for approval? A: The Council will give the final direction for the placement of the sidewalks. They have given general direction in the past that in all reconstruction projects, they want pedestrian facilities to be looked and determined if they are possible to be installed. Q: Will we have a chance for future meetings to talk about sidewalks? A: Yes, tonight is just an opportunity to introduce the issue. It will be discussed further at the public hearing. The Council could give direction there, or even wait I I I I I I I I I I I I I I I I I I I Deerfield 3rd Addition Informational Meeting. December 5, 2006 Page 2 until final plans are completed and a walk-thru, so that further discussion on the issue can take place. Q: You .presented estimated costs. What if the contractor bids substantially less?- Will the assessments go down? A; No. The assessments are proposed at a unit rate. As I have indicated in the presentation, the Council's desire is to try to assess 1/3 of the cost. Due to the construction of a storm sewer system and sub-cut that is necessary in Deerfield 3rd right now, we are projecting that the assessment will only cover 26 - 27 percent of the cost. If the bids are lower, the percentage that the assessments cover will just get closer to the targeted goal of one-third of the total cost. Q: Are the sidewalks and retaining walls included in the estimate? A; Yes Q: What areal properties benefit more from this project? A; This project is really only a benefit to the Deerfield 3rd Addition. Storm sewer is.not designed for any areas outside of the Deerfield 3rd Addition. Sidewalks are deemed to be a neighborhood benefit and not necessarily of regional significance. Q: Where does the City come up with their portion of the funding? A; The City has a street infrastructure fund and they will also have the ability to bond for their portion of the project. Q: Who usually bids these projects and are they competitively bid? A; Yes, it will be competitively bid. Since this is mostly a street project with a substantial amount of dirt work, I would guess that either a grading contractor or a street contractor would be the general for this project. Q: I have heard that the original developer is still in legal trouble with the City, and that the City is trying to get repayment for some items from the past? A; I have no knowledge that there is anything ongoing with legal action against the developer. I am aware of the action that took place a number of years ago, where the developer had to come back and correct some of the deficiencies in the original plat, such as tees buried in building lots. Q: Is the developer responsible for the shoddy storm sewer system? A; The developer built the storm sewer system that was approved and was based on the standards at the time. The developer was not required at the time of this plat in 1986 to construct an urban-style street with concrete curb and gutter and a storm sewer system. It was rather more of a rural-type development with bituminous streets, catch basins, small culverts and spillways leading off the street through side yards and rear yard areas. I I I I I I I I I I I I I I I I I I I Deerfield 3rt! Addition Informational Meeting December 5, 2006 Q: I live at the comer of 1915t Avenue and Baldwin Street. There seems to be a problem with the curve at that point. Every year there are people that go off the road. Can the alignment be changed there? Page 3 A; The alignment cannot be changed unless more right of way acquisition is provided. We could look at potential ways to provide traffic calming to lower the speed of the traffic so that the curve in the road is driven at a safe speed. Q: Baldwin Street is the most congested street with the highest volume of traffic: What can be done in this area? A; I am currently working with representatives of the Police Department and Street Department to come up with a traffic calming policy for the City Council to consider. Some of the items we are looking at are "chokers", where the street is narrowed to slow traffic dovm over short stretches of the street. We are also looking at the potential for installing speed humps and traffic circles at intersections. Once a final policy is approved by the City Council, items contained in the policy could be considered for inclusion in the street reconstruction project. Q: Are handouts of the presentation you showed available? - A; Not at this time. It will be a part of the feasibility stUdy. I typically wait until the feasibility study and the information is provided to the City Council before providing it to the general- public;- That way it avoids Couilci1 members receiving questions on something they have not seen. Q: Can you explain options for paying the assessment? A:. The assessment can be paid in full when it is levied to avoid any interest. Partial - payments can be made to lower the yearly annual payment. The assessment can also be prepaid at any time during the life of the assessment. However, it is somewhat different than an installment loan. If you pay off the assessment at any time during its life, you will be asked to pay the full interest amount for the year in which you are prepaying the assessment. Therefore, if you decide to prepay the assessment during its life, it is better to do it later in the year, but preferably before November, because the City will be certifying the next annual payment to the County for collection. Q: The City approved sub-par work in 1986. Will the City increase their funding, thereby lowering the assessment to the property owriers? - - - - - - A; The City approved plans in 1986 were in compliance with the standards of the time. As I indicated in the presentation, this is the last development of an urban nature that was allowed in with the standards. After this development was completed, the standards were changed. As you can see from the adjacent neighborhoods, they were built with concrete curb and gutter. The street section was also changed to add a second lift of bituminous. Therefore, it is unlikely that the City would contribute anything additional thereby lowering the assessment, based on the argument that the original construction was sub-par. Q: We have been here since the plat was originally built. We were told by someone that the first layer of blacktop was not the completion of the project; they would be back and put in another layer of blacktop. That never happened. I I I I I I I I I I I I I I I I I I I Deerfidd 3m Addition Informational MeetiBg - December 5, 2006 Page 4 A:. The approved plans for this development and the record drawings on file with the City show a street section with only one layer of blacktop. That was the standard at the time. I don't know where the information would have been obtained to give to you that there was two lifts of blacktop planned. The developer was never required to place two layers of blacktop. Q: Why are not surrounding neighborhoods being included? A:. The surrounding neighborhoods already have curb and gutter and were built to a slightly different street section. Also, the size of the project, the amount of monies available to do reconstruction from the City's standpoint, and the amount of needs are vastly different. The City takes on reconstruction projects in odd-numbered years. The size projects and-the areas that they believe are in the greatest need and can be funded. Q: Why B618 curb and not surmountable curb? .A:. The barrier style curb provides better -drainage with the higher curb. It also provides an edge for snow plowing activities, and with the barrier style curb Y01.!get a much smoother and more gradual driveway approach. The barrier style curb.can be used because the driveways are all set and can be identified. The surmountable curb is used in new developments because the homes are not built yet and the driveway locations are not yet established. . - - Q: Why would you do a small portion of Elk Lane and not go further? A:. The project ends at the plat bounda1y of Deerfield 3rd Addition. The area further east on Elk Lane is in the Elk Hills Addition. That will be reconstructed at some point in the future; at that time, the curb and gutter and street section would be continued easterly. Q: Why would the cost to the homeowners not go down if sidewalks are not built? A:. As I discussed before, the assessment is set on a unit basis with the hope of assessing approximately one-third of the cost of the project. If sidewalks are included with everything else I have shown, the assessment will only cover about 26 percent of the project estimated cost. If the sidewalks are removed, the percentage the assessments cover would increase and get closer to that one-third goal. Q: What is the typical location of the sidewalk within the right-oE-way? A:. Typically we would like to see sidewalks located within one foot of the right of way line; however, with the topography, vegetation and other issues in the Deerfield area, that certainly will not be possible in many locations. We would start a design, hoping to have the sidewalk out near the right-of-way bounda1y, and then would adjust as the topography and vegetation requires, trying to find the best fit to minimize disruptions and removal of vegetation. A:. Is the project a certainty? I I I I I I I I I I I I I I I I I I I Deerfield 3rd Addition Informational Meeting December 5, 2006 Q: The project is never a certainty until the City Council acts on the project. There will be a public hearing and an assessment hearing, at which the City Council will take testimony from the public and will make determinations at the close of those hearings whether or not to proceed. Once the assessment roll has been adopted, the contract can be considered for award. At that point, the project is a certainty. Page 5 Q: Who is responsible for sidewalk maintenance? A:. The residents who end up with sidewalks in front of their homes would be responsible for snow removal. The City would be responsible for repair of any damaged sidewalk. Q: I have a sprinkler system in myyard. Who is responsible for moving and! or relocating it? . A:. We will have many opportunities for you to let us know where your sprinkler system is. It will be up to the homeowner to either remove the heads or locate the heads so that the contractor can remove them. We will have the contractor do that with due care. . We will not salvage the plastic pipe between the heads. .After the project is complete, you will be asked to get a quote from your sprinkler company for the _ repair of the sprinkler system. The City will reserve the right to review the quote prior to authorizing payment. We will either pay the sprinkler company directly based on an approved quote, or we will reimburse the homeowners if they paid the sprinkler company. . . Q: Why has it taken 18 years for rehabilitation of the roads in Deerfield? A:. The City initiated a pavement rehabilitation program in the early 2000's. In the odd numbered years, we do construction projects. There are certainly more needs for construction in the City than there are monies available. We are slowly getting to some of the worse streets in the City for reconstruction. Q: Are .there issues of tree removal within the right of way? A:. There will be a few trees in the right of way that likely will need to be removed, especially if sidewalk is added. City policy would not replace trees that are removed from within the right of way; however, the removal of the tree would be a cost to the project. Q: What is the life expectancy of the road? A:. The road certainly will not be reconstructed in anyone's lifetime within this audience; however, during the life of the road there will be sealcoats applied and at appropriate points, maybe 20 years out, the surface would need to be milled and overlaid to rejuvenate it. Q: What if someone wants to have their driveway replaced? A:. Whenever we get a bid from a contractor, we always ask if they are interested in doing private driveways. Some contractors are, some are not. If the low bidder on this project is interested in doing driveway work, we will notify the public through a newsletter. December 5, 2006 Page 6 to determine how much of your driveway replacement is a function of the street construction, and will be paid by that project. You can then negotiate a price with the contractor for the replacement of the remainder of your driveway. . If you reach a reasonable agreement, the contractor can then replace your driveway all at the same time. The City will facilitate getting the contractor and you together, but will not be party to the agreement to replace a driveway. Q: There are a few old lights on power poles. Will those all be removed with the new decorative lights? A:. Yes, it is my understanding that all that's on the poles are lights which will be removed. Therefore, I assume the Elk River Municipal Utilities will remove the poles also. Q: How long will we be out of our driveways when the concrete curb and gutter is poured? A:. Typically, it would be 4 - 5 days. Some contractors will allow you back in as early as three days. The maximum I have seen is 5 days. The contractor who pours the curb will tell us how long they want people to stay off of it. As long as it is a reasonable time line, we will follow the contractor's recommendation. Q: How will the project be phased? A:. We will give the contractor some general guidelines in the specification and look for the contractor to give us a schedule to review and approve. Typically, the contractor will only be allowed to open up and sub-cut a short portion of the project at a time, backfilling as the area is completed, and placing gravel. I am sure the contractor will want to this to get the area sealed up and draining so that they don't lose their work in the event of a rainstorm. We will need to give the contractor a reasonable amount that can be open and constructed to gravel before we require curb and gutter to be placed, due to the expense of mobilizing a concrete company. Q: What will be the length of construction? A:. There will be some portion of Deerfield under construction throughout the 2007 construction season. As I indicated in my presentation, the final lift of blacktop, final repairs and restoration, will be done in the early -sU.mrrier of 2008: Q: Will our property values be driven up by the assessment? A:. The County has always indicated to the City that there is no direct correlation between levying an assessment against a property and the increase in the property value. However, as we all know, property values continue to rise and I would expect that the property values in this area will also continue to rise. Should the assessor come out to reassess the property, certainly having curb and gutter, lighting, and potentially sidewalks throughout the neighborhood will affect the property values. 4.
