City Council adoption of the resolution, creating a moratorium related to electronic changeable copy
and / or Advertising signs.
Overview
At its workshop on February 5th, the City Council established a moratorium restricting the issuance
of permits for Advertising signs (billboards) and electronic changeable copy. The moratorium was
established to review the City ordinances to determine if they address the recent emergence of
animated Advertising signs in the City's best interest. At that meeting, the Council directed Staff to
draft a resolution with several options for the Council to consider in terms of establishing what
types of permits could be issued, and further establishing goals for the future ordinance amendment.
To date, Staff has received one application for permit for an Advertising sign on the east side of
town, to replace an existing, several legged sign with a one legged sign. The lighting for the sign
would be external.

RESOLUTION 07-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION ESTABLISHING AN INTERIM ORDINANCE (MORATORIUM) ON THE
ISSUANCE OF BUILDING PERMITS FOR "ADVERTISING SIGNS" AND / OR SIGNAGE
THAT UTILIZES "ELECTRONIC CHANGEABLE COpy" FOR ONE YEAR FROM THE
DATE OF THIS RESOLUTION.
WHEREAS, State Statutes, Section 462.355 Subd 4 authorizes a City to enact an interim ordinance for the
purpose of considering the adoption or amendment of official controls as defined in Chapter
462; and
WHEREAS, The Elk River City Council (City Council) recognizes the emergence of new types of
Advertising Signs not contemplated with the City's current official controls; and
WHEREAS, The City Council has observed the proliferation of signs with electronic changeable copy;
and
WHEREAS, The City Council has noted that the city's currant official controls regulating changeable
copy are not clear as to the definition of changeable copy versus animation, and need to be
updated to address new developments with respect to signs with electronic changeable copy;
and
WHEREAS, The City Council desires to review and make necessary changes to the rCity's Official
Controls to ensure that the health, safety, and general welfare of the residents and visitors of
Elk River are preserved; and
WHEREAS, The City Council has determined that it is critical that a comprehensive review of and
potential amendment to the City's Official Controls be conducted without the simultaneous
review of building permits for said signs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, :Minnesota:
1. A Moratorium is hereby established, prohibiting the issuance of building permits for new or existing
Advertising Signs and Electronic Changeable Copy, as defmed in the Elk River Code of Ordinances.
2. However, a building permit may be granted if the following conditions are met:
A. If the permit is for the replacement of an existing Advertising Sign with an identical
Advertising sign and no electrical work is necessary or requested.
B. If the permit is for the repair of an existing Advertising Sign and no electrical work is
necessary or requested.
3. The City Council directs the Community Development Department and the Planning Commission to
complete an analysis of issues associated with Advertising Signs and "Electronic Changeable Copy" signs
and develop an advisory recommendation for the City Council to consider potential City Ordinance
amendments.
