Overview
The applicant is proposing to combine four lots and two Outlots into two parcels. Upon staff
review it was determined that the dedicated right-of-way for future 156th Avenue needed to be
adjusted due to a pond being located with in City Right-of-way south of the subject site. In order to
correct the situation re-platting two of the lots to the south is necessary along with vacating certain
easements. Staff and the applicant decided the easiest way to accomplish all of the changes is to
process the applications together.

Parks
Park Plan - The Comprehensive Park Plan does not indicate any park target area nor is trail corridor
in the wider area; but a trail easement recommended along the entire length of Jarvis Street, as it
adjoins the subject plat.
Park and Recreation Commission Recommendation - Given the Comprehensive Park Plan, staff
recommends that the Parks and Recreation Commission recommend that park dedication be paid in
the form of cash for the portion of the Outlot (3.92 acres) that will be platted into Lot 1, Block 1,
Renner Third Addition. .
Recommendation
Staff recommends approval of the Easement vacation and Preliminary and Final Plat request, as
illustrated on drawings dated received February 22,2007 with the following conditions:
1. All comments of the City Engineer's memo dated February 28,2007 shall be addressed.
2. The development shall meet all applicable flte codes. The Fire Chief shall verify the location
of all flte hydrants, and may require additional hydrants necessary to preserve the health and
safety of the residents.
3. Easements shall be vacated as shown on exhibit A and B.
4. In addition to the easements shown on the preliminary plat, the following easements shall be
provided:
A. Trail easement - 10-foot trail easement along the entire length of Jarvis Street, as it
joins the subject plat.
B. A 10-foot drainage and utility easement be provided along the frontage of Outlot A.
5. Park dedication shall be provided in the following manner:
a. Cash dedication for 3.92 acres at the rate applicable at the time of final plat approval.
6. All required subdivision/park information shall be provided in an electronic format (.dwg
file) as required by the City Ordinance and Land Use Application prior to recording of the
plat.
7. This approval of the Preliminary Plat shall expire after 1 year, unless the property owner or
owners agent has submitted a Final Plat or letter of request for extension.

As requested, we have reviewed the information submitted by John Oliver & Associates for
Renner Third Addition. The submittal included a preliminary plat, a final plat and two
easement vacation exhibits. It is our understanding that the purpose of the plat is two-fold:
First, Renner Well Drilling is trying to combine all of the property they currently use for
their business operations together with another nine acres into one lot and block. The
second purpose of the third addition is modify the alignment of 156th Avenue right of way,
as the detention pond for Lot 2, Block 2 (Furniture & Things) has been determined to be
partially in the existing right of way. Based upon our review, we would offer the following
comments:
1. The proposed easements to be vacated within Lots 4, 5, 6 and 7, Block 1 ofR.R.
Industrial Park are appropriate based on Renner Third Addition. The easement
vacations should be conditioned on the recording of Renner Third Addition.
2. Since 156th Avenue is not currently constructed, any building that Renner Well
Drilling undertakes on the expanded Lot 1, Block 1 should be focused towards their
existin~ facility and utilize the existing access points from their site onto the portion
of 156t Avenue, which is currently built.
3. The proposed right of way vacation for a portion of 156 th Avenue is appropriate,
again, conditioned upon the recording of the plat of Renner Third Addition.
4. The only additional comment we have regarding the plat would be a 10-foot drainage
and utility easement should be provided along the frontage of Outlot A.
5. Even though Lot 1, Block 2 is being replatted to be slightly larger with this third
addition, the original condition placed on that lot with the second addition should
remain in place. That condition states that no building permit would be considered
for that lot until the construction of 156th Avenue.

That portion of I 56TH Ave NW lying across an existing retention pond has been vacated
and realigned and dedicated on the proposed plat of RENNER THIRD ADDITION.
Outlot A, Lots 4, 5, 6 and 7, Block I, R.R. INDUSTRIAL PARK are being replatted as
Lot I, Block I, on the proposed plat of RENNER THIRD ADDITION. Therefore the
unused interior existing drainage and utility easements are being vacated to allow for
potential building sites.

RESOLUTION NO. 07-
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
RENNER THIRD ADDITION
Case No. P 07-03
WHEREAS, application has been made for final plat approval, pursuant to Section
30-374 (a-g) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property";
NOW, THEREFORE, BE IT RESOLVED BY TIlE CI1Y COUNCIL OF THE
CI1Y OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed plat is consistent with the Land Use Regulations and conforms
with all of its requirements.
B. The proposed plat is consistent with all applicable general and specialized
city, county, and regional plans including, but not limited to, the City's
Comprehensive Development Plan.
C. The physical characteristics of the site, including, but not limited to,
topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to
flooding, and drainage are suitable for the type and density of development and uses
contemplated.
D. The proposed plat makes adequate proVlslon for water supply, storm
drainage, sewage transportation, erosion control and all other services, facilities and
improvements otherwise required herein.
E. The proposed plat will not cause substantial environmental damage.
F. The proposed plat will not conflict with easements of record or with
easements established by judgment of a court.
G. The proposed plat will not have an undue or adverse impact on the
reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
5. This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.
The foregoing resolution was introduced by Council Member and
duly seconded by Council Member . The following voted in favor
of the Resolution.

EXHIBIT B
1. All comments of the City Engineer's memo dated February 28, 2007 shall be
addressed.
2. The development shall meet all applicable fire codes. The Fire Chief shall verify the
location of all fire hydrants, and may require additional hydrants necessaty to
preserve the health and safety of the residents.
3. Easements shall be vacated as shown on exhibit A and B.
4. In addition to the easements shown on the preliminaty plat, the following easements
shall be provided:
A. Trail easement -10-foot ttail easement along the entire length of Jarvis
Street, as it joins the subject plat.
E. A 10-foot drainage and utility easement be provided along the frontage of
Oudot A.
5. Park dedication shall be provided in the following manner:
a. Cash dedication for 3.92 acres at the rate applicable at the time of final plat
approval.
6. All required subdivision/park information shall be provided in an electronic format
(.dwg file) as required by the City Ordinance and Land Use Application prior to
recording of the plat.
7. This approval of the Preliminaty Plat shall expire after 1 year, unless the property
owner or owners agent has submitted a Final Plat or letter of request for extension.

RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING STREET, DRAINAGE AND UTILITY
EASEMENTS
Case No. EV 07-_
WHEREAS, the property owner abutting the street, drainage, and utility easements has
requested the City Council in a petition February 22, 2007, to vacate such
easements according to law; and,
WHEREAS, a public hearing was held on March 19, 2007, before the City Council at the
Elk River City Hall on such petition after due published and posted notice
had been given as well as personal notice to affected property owners on
February 8, 2007, and all persons interested were given an opportunity to be
heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve such
petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the street, drainage, and utility easements described as follows are hereby
vacated:

That portion of 156TH Ave NW lying across an existing retention pond has been vacated
and realigned and dedicated on the proposed plat of RENNER THIRD ADDITION.
Oudot A, Lots 4, 5, 6 and 7, Block 1, R.R. INDUSTRIAL PARK are being replatted as Lot
1, Block 1, on the proposed plat of RENNER THIRD ADDITION. Therefore the unused
interior existing drainage and utility easements are being vacated to allow for potenria1
building sites.
