REQUEST
Robert Cross is requesting an administrative subdivision to divide an eighty
(80) acre parcel into a 64.6 acre parcel and a 15.14 acre parcel. The 15.14
acre parcel currently has access to 181st Avenue (County Road No.12) and
the 64.6 acre parcel will have access on either 181st Avenue (County Road
No. 12) or Cleveland Avenue (County Road No. 40).
LOCATION
The SW quarter of the SE quarter, Section 36, Township 33, Range 26,
Sherburne County, MN. The address of the existing home on the 15.14 acre
parcel is 9997-181 Ave, Elk River, MN.
ZONING I LAND USE
RIA (Single Family Residential) / LR (Low Density Residential)

DIMENSIONAL REGULATIONS
The property is currently zoned RIA, which requires a minimum lot size of 2
1/2 acres with 160 feet of frontage. The existing property is also located
within the subdivision moratorium zone, which restricts properties to be
subdivided into parcels less than 10 acres in size. Mr. Cross' administrative
subdivision does exceed the 10 acre requirement, therefore, the moratorium
does not apply to this situation.

Mr. Cross is proposing to create a 64.6 acre parcel (Parcel A) and a 15.14 acre
parcel (Parcel B). Parcel B currently has a single family dwelling and
attached accessory buildings located on this site. Parcel B is bisected by
County Road No. 12. The northern half of the parcel is ten (10) acres in size.
The southern half is 5.14 acres in size, for a total of 15.14 acres. The
southern 5.14 acres was not divided into a separate parcel because a home
could not be constructed on this site without the need for variances,
therefore, this remnant piece was added to the existing home site. Mr. Cross
is considering developing Parcel A in the future.
NATURAL FEATURES
Trott Brook, a DNR protected stream, does bisect both parcels, however,
there is ample room on the 64.4 acre parcel to meet the 100 foot setback from
the ordinary high water mark of the stream. This site also has several
wetlands, however, they can be avoided for the construction of a home.
PARK AND RECREATION RECOMMENDATION

The Park and Recreation Commission recommended a cash payment of $450
for the creation of a new parcel.
RECOMMENDATION
It is recommended the City Council approve the administrative subdivision
request by Robert Cross to divide and eighty (80) acre parcel into two parcels,
one 64.4 acre parcel (Parcel A) and one 15.14 acre parcel (parcel B) with the
following conditions:
1. PAYMENT OF PARK DEDICATION FEES IN THE AMOUNT OF
$450 BE PAID TO THE CITY PRIOR TO RECORDING.
