PARTNERSHIP: AUTO MALL

At the request of the City Council, a public hearing notice has been mailed to
the paper advertising a public hearing by the City Council for August 1,
1994, to review the Darkenwald Family Partnership proposal. Notices will
also be mailed to property owners within 350 feet of the subject property.
When this item was presented two weeks ago, the City Council directed the
City Attorney to prepare a resolution of denial. At the same time, the City
Council informed the developers that they may take this opportunity to
revise their plans according to the comments and concerns expressed at the
Planning Commission and City Council meetings. The developers have been
in contact with myself and have made some revisions to their plans in
accordance with the concerns expressed at the meeting.
To assist the Council in visualizing the presentation of the auto mall building
and proposed overhead doors for JR Tech towards the Guardian Angels
facility, the developer has installed some 2 x 4's in the ground representing
the proposed building and overhead doors. The northerly post is the north
corner of the building. The cluster of poles in the middle represent the
overhead doors of JR Tech, and the southerly post is the south corner of the
building.

One other issue the Council may wish to take a look at is the area next to
Burger Time where the proposed turn lane will be constructed. At this time,
the proposed turn lane will eliminate the entire green strip along Carson
Street and be replaced with concrete. From an aesthetic standpoint, it would
be most desirable to retain some green strip along Carson Street which could
be accomplished by adjusting the Burger Time parking lot. If the Council has
any thoughts on this issue, staff would appreciate hearing those either prior
to or at the time of the August 1 meeting.

OVERVIEW
The plat consists of approximately fourteen (14) acres of property at the
northeast corner of 193rd and Highway 169. The plat will include the
extension of Evans Avenue north of 193rd to the northern limits of the plat,
which is planned to be extended further north to 197th at some future date.
The platted area is proposed to be developed as a Planned Unit Development
with the first phase consisting of the construction of a 65,000 square foot
grocery store on Lot 1, Block 2.
All the lots within the Hillside Crossing plat meet the minimum one acre lot
. size set forth in the zoning ordinance. In addition, drainage and utility

easements have been provided throughout the plat based on the proposed
utility plan to serve this commercial development. At the time this memo
was written, Terry Maurer has not had a chance to review the drainage
calculations in order to determine the adequate size of the storm drainage
pond in the southeast corner of the plat. Based on Terry Maurer's review of
those calculations and finalizing the utility plans, the drainage and utility
easements will be adjusted accordingly prior to the final plat being recorded.
RECOMMENDATION
It is recommended the City Council approve Resolution No. 94 - _ granting
final plat approval for Hillside Crossing based on the conditions stated in the
resolution.

CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL OF
HILLSIDE CROSSINGS
.
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1 )(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on July 5, 1994; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C.
The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and

siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
D.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E.
The proposed subdivision will not cause substantial environmental
damage.
F.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.

4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.
