COMMITTEE MEETINGS

The next set of Steering Committee meetings are going involve discussing
residential development throughout the community. To notify all residents
in a cost effective manner, a public hearing notice will be included in next
month's utility bill. This distribution will cover a larger area than just the
residential property owners in the community, however, by using the utility
bill system the notification will be sent out at relatively a low cost to the City
and certainly save a tremendous amount of staff time.
In the event any Council members receive calls from residents with questions
regarding this notice, I wanted to let you know what the notice was for. If
you have any questins, I'll be happy to answer them.

NOTICE OF PUBLIC MEETING
UPDATE OF THE COMPREHENSIVE PLAN
CITY OF ELK RIVER, MINNESOTA
ATTENTION RESIDENTS, PROPERTY OWNERS, AND
CONCERNED CITIZENS
PLEASE TAKE NOTICE that the City of Elk River, Minnesota, has
initiated an update of its existing Comprehensive Plan. This plan will help
guide development decisions in Elk River over the next decade and will be a
valuable document for the City, its Planning Commission, residents, and
businesses.
PLEASE TAKE FURTHER NOTICE that a public meeting on the
proposed update of the Comprehensive Plan will be conducted by the Steering
Committee on Thursday, August '25, 1994, at the Elk River City Hall,
beginning at 7 p,m, The public meeting will address the residential
development of the North Planning Area, Discussion topics may include an
overview of the existing inventory of residential land, the absorption rate of
residential land, and development policies associated with residential
growth.
Because of the diversity of residential development within the community,
the City has been divided into four residential planning areas. Attached is a
map' illustrating the four planning areas. The meeting on August 25, 1994,
will address only the North Planning Area. The remaining areas will be
discussed at a later meeting.
All persons desiring to appear at the public meeting will be afforded an
opportunity to express their view on the issue. Interested persons may also
file written comments expressing their views with the City Planner. For
further information, contact Steve Ach, City Planner, at the Elk River City
Hall, 441-4921.

SUBJECT: TRUNK ASSESSMENT FEES
Dear Mayor Duitsman:
Thank you for the opportunity to discuss this issue with you and
the City Council.
As a local real estate developer, I am very concerned about the
method and rationale used to determine the $3,800 per acre
assessment fee being placed on all development in this City. This
fee hits me unjustifiably hard as the Hillside Estates and Hillside
Crossing subdivisions continue in their logical development. The
raw land carried a higher purchase price due to their proximity and
eventual accessibility to the municipal trunk lines already planned
to be established in this northeast portion of the City. Further,
the assessments are already being incurred by me for these
properties.
These existing conditions actually validate a more accurate cost to
this benefit area of $1,700 to $1,800 per acre, not the
artificially created fee of $3,800 per acre. The result of this
subjective fee is an unjust subsidization of development in other
parts of the community, and in some locations where development has
not begun, but is only hoped to occur sometime in the future.
Please keep in mind that this letter is not to infer that a trunk
fee is not applicable, but is intended to focus on the arbitrary
method that it was established. Fees established by the City are
required to follow the principles outlined in the City's own
Assessment Manual; that is. to assess a fee based on the actual
cost of the proiect. and then assessed to the area which eventually
receives the benefit of the project. The City has deviated from
this manual in the past, but has decreased the fees, not
subjectively increased them.
