Dear Mayor, and other City Council Members, August 15, 1994
This letter is in opposition to the unacceptable, unrealistic costs
that may be placed on the shoulders of the homeowners in Sandpiper
Estates if City Sewer and Water are extended to the County Government
Center and beyond. In our case, it will cost us about $50,000 to have the
project run by our property mainly to benefit the City and the County. The
costs are broken down in another letter we wrote to the Editor of the
newspaper. This letter is attached for your information.
We've had our property appraised by the 12J2. real estate agent in this
region of the country. He says the improvements will only increase our
property value by approximately $7,000. A copy of the letter from Mel
Beaudry has been included with this letter for you. You people have said-
Sell half of your lot to pay the assessments. Even if some of the
homeowners would like to, or may have to, 'Who's. going to buy them?'
With all the improved lots in Heritage Landing, Mississippi Oaks, Country
Crossings, Cherryhill Bluffs, Hillside Estates, Meadowvale Heights, and
the remaining lots in Sandpiper Estates, there are several hundred lots - a
surplus in the city, for several years to come. We realize the cost per
foot is the same if you go by a one acre lot or a lot that is one-fourth of
an acre. But your formula just doesn't work for one acre lots with
existing brand new systems already in place. For one thing, even if the
homeowners split their lot and sold one-half, they would pay twice as
much as smaller lots just because of their size. Secondly, the smaller
lots in the newer developments do not have new private systems to
abandon. Thirdly, the smaller lots in the newer developments do not have
perfectly good existing streets that have to be torn apart and replaced.
The city has to take a great deal of the responsibility for the
financial waste and financial burden being placed on the Sandpiper Estates
residents because of the city's irresponsible information and
irresponsible decisions in allowing the developer to proceed in his method
to develop, instead of the way the city had planned.
We were told three to five years, probably not for ten years. This
was in mid August of 1993. We see that we will benefit slightly, but that
the County and the City will benefit the most by running improvements to
the Government Center and improving about 200 acres to the north of our
addition and to the West of the Government Center. If the City and the
County are going to be the big benefactors, we feel they should pay for
most of the improvements in our area too. We feel we have strong legal
grounds to fight these assessments, and we have spoken to an Attorne

Let's be Honest Mr. Heinzman and fellow residents of Elk River.
The homeowners in Sandpiper Estates are being victimized by
circumstances beyond our control because the City Council wants to have
sewer and water available to the North of our addition and to the West of
the County Government Center to Waco Street to develop the 175 to 180
acres into a business park. Also, the County Government Center now
wants to hook up because of a failing private system. The present
systems and roads in Sandpiper Estates are all in excellent condition. Our
system is only six months old!
Mr. Heinzman, we take offense to your remark the homeowners had to
have known sewer and water was coming. As late as the middle of August
of 1993, we were looking for a lot and called City Hall. We thought we
asked the right questions to the right people. We were told possibly three
to five years, probably not for ten. How could we make a quality and
intelligent decision with such poor inaccurate information? The people we
talked to said the city was going to extend water and sewer to the
Northern and Eastern corridors of the city. We will take a lie detector
test if you would like. Based off of this information, we decided to build
in Sandpiper Estates. We closed on our home Feb. 11, 1994, and then three
months later we were informed about sewer and water improvements to
be extended to our area yet this fall of 1994.
The assessments of $13,000 to $21,000 are just the beginning! You
haven't included many other costs, such as: Sewer Hookup $1,300, Water
Hookup $1,000, Filling the present tank and running the line to the street
$2,000, Plumber to hook up lines from present to new system $500. Our
present system to be abandoned is valued at $7,400. That puts the real
cost from $25,000 to $33,000 before any financing is secured. An
example of $30,000 at 7.5% interest for 15 years means a total of about
$50,000 for something we don't want, we didn't ask for, and we Don't
Need!
Wake up citizens of Elk River, we need your support. This could
happen to you! Please call your council member and voice your opinion!

This letter is to inform you that we have consulted with an attorney and are
planning to make a formal objection to our pending improvements at the
September assessment hearing.
For the two of us, this issue is larger than the dollar amount of our
assessment. It is a matter of whether or not a city should have the right to force a
homeowner to pay for unneeded improvements.
The county courthouse has a need for a trunk line. The city has a need to
develop the land around Sandpiper. Put the truck line in, divide the cost between
the two governments, but leave Sandpiper Estates alone.
