ANALYSIS
.
The final plat has been prepared in accordance with the preliminary plat
which has been reviewed and approved by the City Council. One of the
primary issues discussed by the City Council was related to Railroad Drive
right-of-way and the potential of Railroad Drive becoming an east-west
collector. It was determined by the City Engineer that the extension of
Railroad Drive would not be feasible for a variety of reasons, which are stated
in the June 6, 1994, report to the City Council. In addition, the general area

could be considered for a redevelopment site in the future. As such, the
standard width of Railroad Drive is not a major concern as any development
of this area would likely involve the vacation of Railroad Drive to create
larger developable parcel with access off of 4th Street.
RECOMMENDATION
It is recommended the City Council approve Resolution No. 94-_ granting
fmal plat for Hals Addition.

CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
HALS ADDITION
.
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1 )(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as "the
Property"; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on June 6, 1994; and
WHEREAS, the proposed final plat is consistent with the preliminary plat
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C.
The physical characteristics of the site, including, but not limited
to, topography, soils, vegetation, susceptibility to erosion and

siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
D.
The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E.
The proposed subdivision will not cause substantial environmental
damage.
F.
The proposed subdivision will not conflict with easements of record
or with easements established by judgment of a court.
G.
The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3.
The officers of the City are hereby authorized, once the conditions set
forth in Exhibit B are met and complied with, to sign the final plat for the
Property and to issue a certified copy of this Resolution giving final
approval of the plat.

4. The owner of the Property is authorized to record the final plat as required
by law and shall file proof of said recording with the City. No building
permits will be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time.

BACKGROUND
The proposed plat involves 2.3 acres of property currently owned by
Burlington Northern Railroad. The plat will consist of one lot and three
outlots. Attached is a memo to the City Council explaining this request in
detail.

At the February 28, 1994, City Council meeting this item was tabled due to a
question on the width of the Railroad Drive right-of-way and the potential of

Railroad Drive becoming an east-west collector. The attached letter from
Terry Maurer, City Engineer, addresses these issues. It is the City
Engineer's opinion that the extension of Railroad Drive would not be feasible
because of high construction costs due to poor soil, lack of right-of-way, and
poor intersections at Proctor Avenue, Jackson Avenue and Main Street. In
addition, the extension of Railroad Drive would not alleviate the traffic
problem on School Street.
Staff is in agreement that this general area could be considered for a
redevelopment plan sometime in the future. As such, the standard width of
Railroad Drive is not a major concern as any redevelopment of this area
would likely involve the vacation of Railroad Drive to create larger
developable parcels with access off of 4th Street.
RECOMMENDATION
The plan of Hals Addition has been prepared in accordance with the
subdivision regulations. Staff is recommending the City Council approve
preliminary plat for the City of Elk River, Russell Martie, and Thomas Weiss,
with the following conditions:

Dear Mr. Schmitz:
As requested, this correspondence is intended to discuss the potential viability of Railroad
Drive as an east-west connector in the City of Elk River relative to its proximity and affect
on Hal's Addition which is currently being reviewed by the City Council. As part of the
comprehensive transportation study process, we were requested to review Railroad Drive
from Main Street to Proctor Avenue as an east-west connector within the City. We did
review that potential alignment and recommended that it not be pursued further for several
reasons. Those reasons include the fact that Railroad Drive is essentially a non-existing
roadway from Jackson Avenue to Proctor Avenue. Along this alignment, the road would
need to be constructed through Lion's Park, which has relatively poor soils. The cost of
such construction would be very high as compared to the length of roadway.
A more pertinent issue as to why we do not believe it is an appropriate east-west connector
is the types of intersections we would have at Main Street, Jackson Avenue, and Proctor
Avenue. The Main Street intersection would be skewed unless additional land were acquired
and the alignment changed. The location of Railroad Drive at Main Street is adjacent to the
railroad crossings, which are at a relatively high grade, making visibility to the west for
traffic coming from Trunk Highway 10 difficult to see. The intersection at Jackson Avenue
is again relatively close to the railroad crossing and also close to the signalized intersection
of Jackson and Trunk Highway 10. Oftentimes, traffic backs up on Jackson to a point that
it is difficult to get out of Railroad Drive as it currently exists onto Jackson southbound.
Making this an east-west connector would complicate this issue further. At the Proctor
A venue intersection would be the issue of close proximity to both the railroad and to the
north, School Street, making two fairly major intersections relatively close to each other and
excessively close to the railroad crossing.

Finally, our analysis concluded that traffic coming from the north would hit the School Street
crossing first and would continue to take that in an east-west fashion rather than to proceed
further south to the Railroad Drive alignment, which would be difficult to get off of due to
the intersection configurations. We believe that if Railroad Drive was constructed as an east-
west connector, it would carry a relatively low volume of local traffic wanting to access
areas adjacent to it while School Street would continue to carry the much higher volume of
local, school, and commuter traffic through the City.
I hope this brief discussion on the Railroad Drive alignment is helpful to your consideration
of the Hal's Addition plat. If you require additional information regarding this, please give

Discussion was held regarding the road right-of-way in the plat. It was the
Mayor's concern that the road right of way be maintained.
Mayor Duitsman opened the public hearing. There being no one for or against
the matter, the public hearing was closed.

ANALYSIS
The proposed plat involves 2.3 aCres of property currently owned by
Burlington Northern Railroad. The plat will consist of one lot and three
outlots. One of the purposes of the subdivision is to replat right-of-way along
Railroad Drive. The existing right-of-way currently bisects the Sunderman
paint store and River Valley Lumber's office buildings. By redefining and
shifting Railroad Drive's right-of-way to the south, it will remove any
encroachment by the existing buildings. A newly defined right-of-way will
consist of an approximately 42 foot right-of-way area which will encompass
all driving and utility services. It is anticipated that an easement vacation to
vacate the existing right-of-way which bisects the buildings will be
forthcoming if the plat is approved. The platting process' will also allow for
individual ownership of the lot and outlots. Currently the parcels are leased
from Burlington Northern Railroad.
Lot 1 - Lot 1 is currently occupied by Martie's Feed Store. By platting this lot
the site will basically look unchanged, however, it will allow Mr. Martie the
ability to own the site.

Outlot A - Outlot A is currently used as an outdoor storage area for River
Valley Lumber. The outlot has a chain link fence around a large portion of
the perimeter. Again, the outlot would be owned by River Valley Lumber. If
approved, staff recommends the shed which straddles the outlot and railroad
right-of-way either be removed or placed totally within the outlot. The
outdoor storage area should also be screened from view from Highway 10.
This could be accomplished by placing durable plastic strips through the
chain link fence.

Outlot Band C - Outlot Band C are currently leased by the City of Elk River
as public parking lots. If the plat is approved, the City of Elk River will own
these outlots and continue to use them as public parking lots.
PARK DEDICATION
.
The location of Lot 1, Block 1, (Martie's Feed Mill) and outlot A is zoned I-I.
The subdivision ordinance does not require Park Dedication on industrial
property. Therefore, no Park Dedication is being proposed for these parcels.
Outlot B & C are zoned Highway Commercial, and although park dedication
is required on commercial property, the City will retain ownership of these
outlots. Therefore, staff is recommending no park dedication be required.

RECOMMENDATION
The pbt of Hals Addition has been prepared in accordance with the
subdivision regulations. Therefore, it is recommended that the City Council
approve the preliminary plat for the City of Elk River, Russell Martie, and
Thomas Weiss with the following conditions:
1. The final plat be prepared in accordance with the preliminary plat and
submitted to the City Council for approval prior to recording with
Sherburne County.
2. That the outdoor storage along Railroad Drive for River Valley Lumber
be located on Outlot A and be screened from view from Highway 10.
3. The storage shed on Outlot A either be removed from the site 01' placed
totally within the boundaries of Outlot A.
