Background/Discussion The past couple of years TNT Fireworks has been granted a General Planning Permit to have a temporary sales tent in the Wal-Mart parking lot for the sale of fireworks. To staffs knowledge there have not been any problems in this location. Attachments . Request for Action Action Motion by_ Second by _ Vote Follow Up C:\Documents and Settings\jmiller\Local Settings\Temporary Internet Files\OLK3E\CC report 5 7 07.doc Introduction The applicants are requesting a General Planning Pennit to conduct firework sales from a 30'xSO' sales tent located in the Wal-Mart parking lot, in the same location as last year, Overview The fIreworks sales are proposed from June 22, 2007 through July 4, 2007; however, the tent may be setup a couple days prior to the sales starting, The hours of operation will be from 8 a,m, - 10 p.m, The proposed location is in the parking lot, straight out from the main entrance to the store. It appears that in this location the tent will not disrupt traffic flow nor will it create any parking problems, There is also a temporary greenhouse in this parking lot located to the west of this proposed use, The zoning code does not prohibit two general planning permits for the same property, Recommendation Staff recommends approval of the General Planning Pennit request for temporary fIreworks sales in a 30'xSO' tent in the parking lot ofWal-Mart as indicated on the site plan, with the following conditions: 1. No electrical services shall be across any drive or walking surface. 2. All applicable fire codes shall be met. 3. If traffic becomes a problem around the temporary site, the sales area shall be delineated with a barrier to restrict traffic. 4. The sales tent be maintained free of debris and kept in an orderly condition. 5. The location of the tent is consistent with the submitted site plan. 6.
